' � On June 22, 2006, Sue Homewood from the Division of Water Quality (Division) conducted an�on-site visit with representatives of NCDOT — PCDEA to review a stream and wetland feature located adjacent to SR 2643 (Union Cross Rd) in Forsyth County for applicability to the mitigation rules (I SA NCAC 2H .0506(h)). The features reviewed (Site 17) were not reviewed in a previous on-site determination dated December 16, 2005. This letter sliall be considered an addendum to the determination dated December 16, 2005 and in no way modif es the previous determination. ' Site 17 is located on the south side of the I-40 Eastbound on-ramp from Union Cross Rd (see attached map). The Division has determined that the stream features noted on the attached surnmary (initialed and dated) are accurate, and that the perennial portion of the stream feature is subj ect to mitigation rules. This on-site determination shall expire five (5) years from the date of this letter. ' � Landowners or affected parties that dispute a detern%ination made by the Division or Delegated Local Authority that a surface water exists and that it is subject to the mitigation rules may request a determination by the Director. A request for a defermination by the Director shall be referred to the Director in writing c/o John Dorney, Division of Water Quality, Wetlands/401 Unit, 1650 Mail Service Center, Raleigh, NC 27699-1650. Individuals that dispute a determination by the Division or Delegated Loeal Authority that "exempts" a surface water from the mitigation rules may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. Applicants are hereby notified that the 60-day statutory appeal time does not start until the affected party (including downstream and adjacent landowners) is notified of this'decision. The Division recommends that the applicant conduct this notification in order to be certain that third party appeals are made in a timely manner. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina Gerieral Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,. Raleigh, N.C. 27699-6714. The features aze noted on the attached summary initialed by Sue Homewood on December 16, 2005. The Division has determined that the stream features noted as perennial on the attached summary are subject to mitigation rules. SITE 1: - UTl to Abbotts Creek — consistent with blue line on topo map (north and south of I-40). Stream determined to be perennial, mitigable. SITE 2: [see Photo Sheets 1& 2] - UT2 to Abbotts Creek — consistent with blue line on topo map (north and south of I-40). Stream determined to be perennial, mitigable. UT2A to Abbotts Creek — located on north side of I-40. Determined to be perennial stream and mitigable [DWQ Stream Form score: 26 and 32.5] (iJSACE Form score: 66]; - Wetland 1— located between and adjacent to UT2 and UT2A to Abbotts Creek (north side of I- 40). USACE Wetland Forms completed. SITE 3: - Area assessed due to blue line feature located to west, outside of project boundary. Determined to be no jurisdictional features. SITE 4: [see Photo Sheets 3& 15] - Area assessed due to crenulation on topo map and neazby blue line feature. Deternuned to be a non jurisdictional ephemeral feature (DWQ Stream Form score: 9.5) from black corrugated pipe to a point downgradient, outside of the project azea (DWQ form score: 22.5) (USACE Stream Form score: 28). Determined to not warrant mitigation. NOTE: jurisdictional portion begins well outside of project study area. SITE 5: - Area assessed due to blue line feature located outside and to the west of the property boundary. Determined to cleazly be an ephemeral feature — ephemeral drainage along south side of school pazking lot. No jurisdictional features. SITE 6: [see Photo Sheets 16 & 17] - Area assessed due to blue line shown on topo map, on west side of Union Cross Road. Feature is ephemeral to a point outside of the project study azea, where it transitions into a perennial headwater stream (UT to Swaim Creek) [DWQ Stream Form score: 30]. This stream continues flowing northwest, ultimately to a confluence point with Swaim Creek. Mitigable, but is located outside of project study area. Wetland 2, is located along UT to Swaim Creek, but located outside of the property study area. SITE 7: [see Photo Sheet 20] - Area assessed due to blue line shown on topo, west and outside of project boundary. No evidence of jurisdictional azea w/i or adjacent to project boundary. � SITE �: [see Photo Sheet 21] - Area assessed due to blue line feature located to east. Eartliwork is being conducted for subdivision development. No evidence of jurisdictional features near property boundary. SITE 9: [see Photo Sheet 10] - Initiation of blue line feature located immediately to west of project boundary along south side of High Point Road. Feature determined to be Ephemeral (DWQ Stream Form score: 7.5). SITE 10: [see Photo Sheet 19] - Area assessed due to crenulation shown on topo map. Determined to be ephemeral feature ruruiing behind residences. Only small portion within property study area. Determined to be no jurisdictional features. SITE 11: [see Photo Sheets 13,14 & 18] - UT1 to 1!'Iary Reich Creek — consistent with blue line shown on topo map, and determined to be perennial and mitigable from its origination point located north of US 311 throughout its run � through the project area (to south of Hayes Road). Stream is piped �under US 311, re-emerges as open-channel stream for 33 feet on south side of US 311, and then is piped under Hayes Road. UT1 to Mary Reich continues flowing southwest through the project study area to a confluence point with UT2 to IVlary Reich Creek, at a point outside of the project study area. North side of Haves Road / south of US 311 - Drainage features that connects to the perennial stream section located between Hayes Road and US 311. - Eastern draina�e feature (UT1A to Mary 12eich Creek): connects to perennial section (UT1 to Mary Reich Creek) from the east; determined to be Intermittent (DWQ Stream Form score: 20.5 - DWQ Stream Form score of 24.5 on 11/8/OS at point higher upstream). Determination of no mitigation required. - Western draina�e feature: connects to perennial section from the west, transmits roadside drainage. Determined to be ephemeral drainage (2 DWQ scores of 16.25 — separate days). SITE 12: [see Photo Sheets 11 & 12] - UT2 to Mary Reich Creek — consistent with blue line shown on topo map, except that jurisdictional portion of stream originates on south side of Hayes Road at downstream end of culvert. Determined to be perennial and mitigable from the culvert on south side of Hayes Road and downgradient. UT2 to Mary Reich continues flowing south/southeast through the project study area to a confluence point with UT1 to Mary Reich Creek, at a point outside of the proj ect study area. North side of Haves Road / south of US 311: A pipe runs under US 311 from north to south that conveys stormwater from drains located along US 311 to a culvert that runs under Hayes Road. A ripraped drainage feature runs from the south side of US 311 eastbound on-ramp, down the gradient to the culvert that runs under Hayes Road, entering culvert area from the west. The culvert is perched and therefore contains pooled water on the north side of Hayes Road for a period after rain events. Drainage feature received DWQ score of 8.5+ [USACE Form score: 34]. - No jurisdictional features on north side of Hayes Road. 2 SITE 13: [see Photo �Sheets 4 through 9] - Area assessed due to blue line shown on topo map. - UT to Fiddlers Creek: from pipe outfall to �115 feet downgradient (north-northwest) . determined to be Intermittent (DWQ score: 23) [USACE Form score: 20]; Determination that it does not warrant mitigation. - Stream segment downgradient of previous section (from �115 feet downstream through the rest of the project study area) there is still some water, but bed and bank is lost: determined to be Ephemeral (DWQ score: 16.5). - Stream segment further downgradient (to the north of pathway, and outside of the project study area) determined to be Intermittent for �185 feet to point where it becomes perennial. Impacts to perennial segment would require mitigation, but is located outside of the project study area. Potential wetland, located downgradient of the �1151inear foot Intermittent segment, was assessed and determined not to be wetland — did not have Hydric soils. Wetland sheet completed. SITE 14: - Area assessed due to crenulation on topo map. Determined to be no jurisdictional features on north or south side of US 40. SITE 15: - Area assessed due to crenulation on topo map. Determined to be no jurisdictional features on north or south side of US 40. SITE 16: - Area assessed due to crenulation on topo map. Grassy area with a slight drainage feature that extends to > 450 feet to the west of Union Cross Road (to well outside project boundary). Feature is clearly ephemeral. B. Glenn High School at 1600 Union Cross Road in Kernersville. NCDOT representatives will be available at the Pre-Hearing Open House between the hours of 4:00 p.m. and 6:30 p.m. to answer questions and receive comments relative to the proposed project. Sixteen (16) sites were assessed, based on review of topographic maps, soil survey, and field conditions. Union Cross Road is located along a ridge line (see Topo map). One headwater sVeam and no weUands located within the project boundaries along Union Cross Road. One weUand was identfied within the project boundaries along the north side of I-40, and a few streams were identified in or near the project boundaries along I-40 and U.S. 311. NEU would like.to request a jurisdictional determination of the sVeam and wetland delineatlons. The Let date for this project has been accelerated to February 20, 2007, with the NEPA document scheduled to be completed in June 2006.
