No Exposure Certification: NCGNE1336

Dear Permit Holder:
The Division of Energy, Mineral and Land Resources has reviewed your submittal of the No
Exposure Certification for Exclusion from NPDES Stormwater Permitting form. Based on your submittal
and signed certification of no exposure at the above referenced facility as well as observations made by
Brandon Wise with the Winston-Salem Regional Office on March 27, 2019, the division is NOT granting
your conditional exclusion from permitting as provided for under 40 CFR 122.26(g), which is
incorporated by reference in North Carolina regulations.
Please note the following reasons for denial of the application:
- Used pallets in poor condition could be seen scattered around the site with a large amount
being stored on the eastern side of the site.
- Some storage could be seen under cover from stormwater however the cover was not
adequate as materials could still be seen overflowing from under cover.
- Drums with unknown materials could been seen under cover on the western side of the site,
however no secondary containment was observed by these drums.
Large trash container was kept on site with lid open and overflowing with debris.
A no exposure permit will not be issued under current conditions. According to the application
the site was covered under NCG050289, however this permit is expired as of May 2013. This facility
should apply for coverage under NCG050000 if this permit conditions match the industrial activity
performed on site. No Exposure can be applied for following a full monitoring cycle (One Year) under
the General stormwater permit if conditions are believed to have been corrected on site. Please note that
if the facility is not covered under a stormwater permit than violations and fines can be issued for a non -
permitted discharge from an industrial facility. If you have any questions or need further information,

Please note a notice of intent form will be sent along with this report. This notice of intent is for
the NCG05000 general permit that covers discharges from only certain types of industrial activity. If this
is not the correct general permit, please use the correct general permit application from the NCDEQ
stormwater website.
