This correspondence is in response to your letter dated January 16, 2007 requesting additional
information for the subject project.
In regard to Number l; Project Information:
• A detailed site plan is included with this package. We propose to construct two buildings
(3600 sq. ft and 2400 sq. ft.) near the sidewalk and parallel to NC 107. Parking will be
located to the south side of the buildings. This area totals approximately 0.55 acres of
impervious surface and stormwater treatment will be discussed in Number 3. We also plan to
construct another building (12000 sq. ft.) to the south side of Cope Creek. This area totals
approximately 0.71 acres of impervious surface and stormwater treatment will be discussed
in Number 3.
• The correct buffers are included in the site plan and survey plat. We plan on maintaining an
undisturbed 25-foot trout buffer zone on each side of Cope Creek (DWQ Class: C Tr).
• The recorded deed restriction for the trout buffer zone is attached. This restriction states that
no permanent impacts will occur within the 25-foot trout buffer zone along Cope Creek.
• A USGS Quad Map and Soil Survey map are attached. The Soil Survey of Jackson County
(June 1997) classifies the soil for the project area as UfB - Udorthents-Urban land complex,
0-5 percent slopes, rarely flooded. Udorthents consist of areas of loamy, earthy material
filled over soils on floodplains. The areas on floodplains were filled to reduce the risk of
flooding and to increase their value as construction sites. The soils on the south side of Cope
Creek are classified as EvE -Evard-Cowee complex, 30 to 50 percent slope, which are made
up of deep Evard soil and moderately deep Cowee soil. Both soils are well drained.

In regard to Number 2; Impact Justification:

We did consider retaining the small wetland area and using it to treat stormwater runoff;
however, it did not leave ample space for the proposed office buildings and parking area on
the site. We did reduce the size of these building to address setback requirements (10 feet
from property lines and sidewalk) by the Town of Sylva. In addition, we are removing one
sewer manhole out o~the proposed building and parking area and relocating (straightening)
the sewer line to tie into an existing manhole on the east side of the site (see attached plan).
The new sewer line will be relocated in the vicinity of the new fill line and outside of the 25-
foot trout buffer zone.
In regard to Number 3; Stormwater:
Stormwater collected from the 2 buildings and parking areas (0.55 acres) on the north side of
Cope Creek will be directed onto the floodplain by 2 downslope drains, which discharge into
2 preformed scour holes (see Detail Sheet).
Stormwater from the building and parking area (0.71 acres) on the south side of Cope Creek
will be directed onto the flood plain by 2 downslope drains, which discharge into 2
preformed scour holes. The stormwater exiting the scour hole will be allowed to disperse
across the floodplain and soak into the ground. No stormwater will be discharged directly
into Cope Creek.
No other amenities will be constructed on this 3.45-acre site due to the mountainous terrain
and access issues on the south end of the property.
We would like to place a temporary bridge across Cope Creek (near the old barn noted on the
survey plat) during site preparation. The bridge will be required in order to move earthen
material from the south side of the property to the north side as we bring the north lot up to the
correct elevation. No permits will be required for the temporary bridge since the structure will
be placed well above the ordinary high water elevation. The temporary bridge will be removed
following construction and the floodplain restored to pre-construction conditions.

This Restrictive Covenant is given this the ~ day of January, 2007 between
KOLE CLAPSADDLE and wife, KIM CLAPSADDLE, hereinafter referred to as
Grantor, to KOLE CLAPSADDLE and wife, KIM CLAPSADDLE, hereinafter referred
to as Grantee.
WITNESSETH:
WHEREAS, Grantors are the owners of that 3.47 acre tract of land described in
Deed Book 1626, Page 315-317, Jackson County Public Registry, and
WHEREAS, Cope Creek runs along the Southern portion of the lands described
above, the same being a designated trout creek.
WHEREAS, Grantors intend to make this tract subject to a restriction not to
construct any improvements within 25 feet of Cope Creek.
NOW THEREFORE, For and in consideration of the sum of $10.00, the receipt of
which is hereby acknowledged, Grantor does hereby restrict the above referenced tract to
prohibit all construction and land disturbing activity within 25 feet of Cope Creek, a
designated trout creek.
