JAY ZIMMERMAN DI; sclor Subject: NOTICE OF VIOLATION/NOTICE OF INTENT AgWaste Solutions — Jones County Runoff from Litter Event Certificate of.Registration No. MHC000061 Permit No. WQ0038185 Jones County NOV-2015-PC-0323 Dear Mr. Robinson: On October 2, 2015 staff of the NC Division of Water Resources, Water Quality Regional Operations Section in Washington made a site visit to Ag Waste Solutions Litter Stock Pile in Jones County. The site is located at 4319 Pleasant Hill Rd, Pink Hill NC 28572. Site conditions observed onsite include: a Animal waste was stockpiled and covered with straw. o Animal waste was stockpiled within 100 feet of a perennial stream, with leachate draining to surface waters (unnamed tributary to the Trent River). \ Lab results are attached. As a result of this site visit, you are hereby notified that, having a Certificate of Registration to carry out manure hauler operation activities pursuant to 15A NCAC 2T. 1403 (a)(2)(B) and 2T. 1403 (a)(2)(C), you have been found to be in violation of your Certificate of Registration that you are covered to operate under, as follows: Violation 1: Failure to cover an animal waste stockpile in accordance with 2T. 140 3 (a)(2)(B) and Requirement Number 4 of your Certificate of Registration. Required Corrective Action for Violation 1: Take all action necessary to abate any damages and to prevent reoccurrence of such an event. Provide a copy of the plan to cover the animal waste stockpile. Required Corrective Action for Violation 2: Take all action necessary to abate any damages and to prevent reoccurrence of such an event. Provide a map showing the 100 foot boundaries and placement of stockpile to eliminate violation. Violation 3: Failure to,prevent a discharge of waste that reaches surface water, wetlands, or a ditch that drains to surface water or wetlands in accordance with Requirement Number 2 of your Certificate of Registration and General Statute 143-215.1. Required Corrective action for Violation 3: Take all action necessary to abate any damages and to prevent reoccurrence of such an event again. As a result of the violation in this Notice, this office is considering a recommendation for a civil penalty assessment to the Director of the Division. if you wish to present an explanation for the violations cited, or if you believe there are other factors, which should be considered, please send such information to me in writing within ten (10) days following receipt of this letter. Your response will be reviewed, and, if an enforcement action is still deemed appropriate, it will be forwarded to the Director and included for consideration. Please include in your response all corrective actions already taken and a schedule for completion of any corrective actions not addressed. Failure to comply with conditions in a permit may result in a recommendation of enforcement action, to the Director of the Division of Water Resources who may issue a civil penalty assessment of not more than twenty-five thousand ($25,000) dollars against any "person" who violates or fails to act in accordance with the terms, conditions, or requirements of a permit under authority of G.S.143-215.6A. Your operation is deemed to be permitted by the Division of Water Quality (Division) to carry out manure hauler operation activities, provided that the following requirements are maintained: 1. the activities do no result in any violation of surface water and groundwater standards; 2. the activities do not result in a direct discharge to surface waters; 3. animal waste is applied at no greater than agronomic rates (15A NCAC 02T .0103); 4. animal waste is not stockpiled uncovered for greater than 15 days; 5. animal waste is not stockpiled within 100 feet of a perennial stream or perennial water body; 6.1 a setback of at least 25 feet is maintained from any perennial stream or perennial water body during land application; and 7. fields on which animal waste is applied has had a representative Standard Soil Fertility Analysis within the last three years from a laboratory certified by the Division pursuant to 15A NCAC 02H .0800. In addition to these requirements, each manure hauler operation must submit an annual report to the Division by March 1 of each year. The report covers the activities of the previous calendar year and must contain all applicable information required by 15A NCAC 02T .1404. Enclosed with this Certificate of Registration are copies of the reporting forms and a copy of 15A NCAC 02T .1400. Please carefully read this Certificate of Registration and the attached documentation so that you will be aware of all applicable record keeping and reporting requirements.
