The Loflin Dairy Phase II Buffer Mitigation Bank Parcel (Parcel) is being proposed under the terms and
conditions of the Randleman Umbrella Mitigation Banking Instrument (UMBI), which was made and
entered into by Wildlands Holdings V, LLC, the acting Bank Sponsor (Sponsor), and the North Carolina
Department of Environmental Quality (NCDEQ) Division of Water Resources (NCDWR). The Parcel shall
be planned and designed according to the UMBI and the Consolidated Buffer Mitigation Rule 15A NCAC
026.0295, which became effective on November 1, 2015.
The project includes the restoration of riparian areas along Bob Branch and several unnamed tributaries
(Al, 131, B2, and 133) in Randolph County, NC. The primary purpose of the Bank is to provide riparian
buffer mitigation credits to mitigate for unavoidable buffer impacts in the Randleman Lake Watershed,
Hydrologic Unit Code (HUC) 03030003 and the NCDWR Sub -basin 03-06-08 of the Cape Fear River Basin.
The Parcel's service area is depicted in Figure 1.
1.0 Project Location and Description
1.1 Introduction
This Parcel is being proposed to provide buffer mitigation through the creation of a riparian buffer
mitigation bank. The project involves the restoration of onsite riparian buffers that will help reduce non -
point source contaminant discharges to downstream waters, the Randleman Reservoir, and the Cape
Fear River Basin. There is an existing conservation easement on the first 50 feet from the top of bank of
several of the Parcel's project streams: Al, 131, B2, and B3 (Figure 2). This existing easement was
recorded on the Parcel in 2012 as part of a NC Division of Mitigation Services (NCDMS) Loflin Dairy
Buffer Mitigation Site (NCDWR #2012-0365). Phase II of the project, as proposed here, expands the
existing buffer restoration area an additional 50 feet on either side of Al, 131, B2, and B3 and adds a new
100 -foot buffer on either side of Bob Branch, for a total of 12.00 acres.
Of the 12.00 acres protected under the Phase II conservation easement, 8.09 acres are proposed for
riparian buffer restoration, 0.16 acres for riparian buffer enhancement, and 2.75 acres for riparian
buffer preservation, for a total of 360,676.80 square feet of riparian buffer credits. An additional 0.34
acres of forested riparian buffer will be protected under the conservation easement but are not eligible
for mitigation credit in compliance with 15A NCAC 02B .0295(0)(5).
1.2 Parcel Location, Site Constraints, and Access
The Parcel is located approximately two miles northwest of the City of Randleman in Randolph County,
NC (Figure 2). The site is located within the 14 -digit HUC 03030003010060 and the NCDWR Sub -basin 03-
06-08, which is in the Randleman Lake Watershed of the Cape Fear River Basin.
The Loflin Dairy Parcel can be accessed from Loflin Dairy Road, which is located approximately six miles
southeast of the intersection of Interstate 85 and Highway 311. The proposed project is surrounded by
fields that are used for agriculture use. There is a 60 -foot easement break on 131 and a 70 -foot easement
break on Bob Branch. There is also a 30 -foot access easement along Al that was recorded as part of Phase
I of the project, which will be released prior to recording the new conservation easement. The break in
the existing Phase I conservation easement will remain to allow for access to both the phases of the
project.

2.0 Project Area - Existing Conditions
2.1 Parcel Features
The project includes restoring the riparian areas along Bob Branch and four unnamed tributaries (Al, B1,
B2, and B3) that flow to the Randleman Reservoir (See Figure 3). Bob Branch is a direct tributary to the
Randleman Reservoir. The reservoir is a regional water supply and stream buffer protection rules are in
place throughout the watershed. As stated in Section 1.0, reaches Al and B1 -B3 were part of Phase I of
Loflin Dairy Buffer Mitigation Project. As such, 50 feet of the riparian buffer from those stream channels
have been restored and are protected under a conservation easement. Phase II expands beyond that for
an additional 50 feet of buffer restoration on each side of those reaches and includes a portion of Bob
Branch that was not included in Phase I and will create a 100 -foot buffer on either side of the stream to
the easement boundary. Photos showing current site conditions (as of February 2019) of the Parcel are
provided in the Appendix.
NCDWR performed an onsite visit of the Parcel to determine viability for buffer mitigation on October 2,
2018 (letter dated October 19, 2018) for the project. All five of the Parcel's stream features were
deemed viable by NCDWR to generate buffer mitigation credit. The classification and subjectivity calls
for the Parcel were approved as part of the issuance of the 401 -approval letter for the Phase I NCDMS
Loflin Dairy Buffer Mitigation Site in 2012. There have not been any changes to the land use in the
project area since the October 2018 DWR site visit.

There are areas on the Bob Branch that are already forested. These areas meet the requirements of the
Consolidated Buffer Mitigation Rule (15A NCAC 02B 0.0295(0)(5)) for buffer preservation by having a
buffer width that is at least 30 feet from the stream, by the area meeting the requirements of 15A NCAC
02R 0.0403 (c) (7), (8), and (11) with no known structures, infrastructure, hazardous substances, solid
water, or encumbrances within the mitigation boundary, and by credits only being requested on 25% of
the total area of buffer mitigation. Documentation supporting compliance with 02R 0.0403 is included in
Section 2.8.
2.2 Historical Land Use
The Loflin Dairy Site has historically been used for agricultural purposes and is surrounded by fields that
have been alternately used for cattle and crop production. The current property owner has confirmed
that the area surrounding Bob Branch and Al was used as an active dairy farm since 1947. Cattle were
removed from the property in 2017. The area surrounding B1— B3 have been agricultural fields since the
late 1920s. Historic aerial photos are included in Appendix B and date back to 1948.
During Phase I, a conservation easement was recorded to protect 9.8 acres surrounding streams Al and
B1— B3 in perpetuity. Within the easement area, the floodplain from top of bank to 50 feet adjacent to
each stream was planted with native woody vegetation in March 2012 as part of the NCDMS Phase I of

the Loflin Dairy Buffer Mitigation Project. Bob Branch was not included in Phase I; therefore, no easement
nor planting were implemented during Phase I of the Loflin Dairy Buffer Mitigation Project.
2.3 Geology and Soils
The Parcel is located in the Carolina Slate Belt of the Piedmont Physiographic Province. The Piedmont
Province is characterized by gently rolling, well rounded hills with long low ridges, with elevations
ranging from 300 to 1,500 feet above sea level. The Carolina Slate belt consists of heated and deformed
volcanic and sedimentary rocks (North Carolina Geological Survey, 2009).
The predominant floodplain soils on site are described in Table 2. Figure 5 shows an image of the
Natural Resource Conservation Service 2006 Soil Survey of Randolph County.

2.4 Existing Vegetative Communities
Existing vegetation within the parcel is primarily comprised of active row crop fields and open pastures
dominated by various graminoid species, with narrow streamside thickets and adjacent forested areas.
The riparian zone surrounding reach Bob Branch and Al have largely been maintained through mowing.
Typical herbaceous vegetation within these areas includes Canada goldenrod (Solidago canadensis), soft
stem rush (Juncus effuses), sawtooth blackberry (Rubus argutus), and various grasses (Festuca spp.).
Streamside thickets are comprised of a few mature tree species including black walnut (Juglans nigra),
red maple (Acer rubrum), American sycamore (Platanus occidentalis), and sweetgum (Liquidambar
styraciflua). These streamside thickets exhibit an abundance of shrub species including sawtooth
blackberry, Chinese privet (Ligustrum sinese), and Japanese honeysuckle (Lonicera japonica).
The areas beyond the 50 -foot buffer established in Phase I surrounding reaches B1, B2, and B3 include
maintained herbaceous areas adjacent to active row crop fields and dense streamside thickets. Typical
herbaceous vegetation within these areas includes Canada goldenrod, ragweed (Ambrosia
artemisiifolia), Nepalese browntop (Microstegium vimineum), and various grasses. Limited mature
canopy trees exist, and shrub species are dominated by sawtooth blackberry and Chinese privet
interspersed with Japanese honeysuckle.
2.5 Threatened and Endangered Species
The US Fish and Wildlife Service (USFWS) and the NC Natural Heritage Program (NHP) databases were
searched for federally listed threatened and endangered plant and animal species in Randolph County,

NC. Two federally listed species identified as threatened or endangered are currently listed in Randolph
County (Table 3).

Except for along Bob Branch, the project does not include any work in the stream or within 50 feet of
the stream; therefore, it will have "no effect" on the federally listed Cape Fear Shiner (Notropis
mekistocholas) species. Along Bob Branch, no suitable habitat for the Cape Fear shiner exists within the
project area. On-site habitat for the Schweinitz's sunflower (Helianthus schweinitzii) includes former
cattle pastures, agricultural cropland, early successional forest, and streamside thickets. However, the
area lacks the proper light and soil regimes for the Schweinitz's sunflower; therefore, the project will
have "no effect" on the Schweinitz's sunflower. The USFWS was contacted during Phase I of the project
and had no concerns or comments related to threatened and endangered species on the Parcel.
2.6 Cultural Resources
The parcel is not located near any sites listed on the National Register with the State Historic
Preservation Office (SHPO). SHPO was contacted during Phase I of the project on July 19, 2011 and had
no concerns or comments on the project site. Correspondence from SHPO is included in the Appendix.
2.7 FEMA Floodplain Compliance
The Site is not located in a FEMA floodplain. No grading activities are proposed in the floodplain, so a
floodplain development permit will not be required. No hydraulic modeling is proposed for this project.
2.8 Other Environmental Conditions
An EDR Radius Map Report with Geocheck was ordered for the Parcel in 2011 through Environmental Data
Resources, Inc. during Phase I of the project. Neither the target property nor the adjacent properties were
listed in any of the Federal, State, or Tribal environmental databases searched by EDR. There were no
known or potentially hazardous waste sites identified within or immediately adjacent to the project area.
The Executive Summary of the EDR report is included in the Appendix.
3.0 Proposed Riparian Restoration & Enhancement Plan
Developing the Parcel for mitigation will require converting existing agriculture land use practices
adjacent to streams into riparian forest. The riparian areas will be planted with appropriate native tree
species along the project corridors. Vegetation management and herbicide applications may be needed
in the restoration areas to control establishment of invasive species that could out compete the planted
native species. More detailed descriptions of the proposed restoration activity follow in Sections 3.1 and
3.2.

3.1 Parcel Preparation
The current land use adjacent to the streams within 51-100' from top of bank has been maintained as
cleared agricultural field except for a few small forested areas that will be preserved along Bob Branch
and Reach B1. Areas slated for buffer restoration and enhancement will require little site preparation
because the land has been maintained as a cleared agricultural field. Site preparation will include select
herbicide treatments and/or limited mechanical clearing to remove undesirable underbrush or invasive
species. Where needed, invasive species will be removed by hand and/or spot treated by a licensed
pesticide applicator.
3.2 Riparian Area Restoration Activities
The revegetation plan for the entire buffer restoration area will include permanent seeding, planting
bare root trees and controlling invasive species growth. The specific species composition to be planted
was selected based on the community type, observation of occurrence of species in riparian buffers
adjacent to the Parcel, and best professional judgement on species establishment and anticipated site
conditions in the early years following project implementation. Species chosen for the planting plan are
listed in Table 4 below.

Trees will be planted at a density sufficient to meet the performance standards outlined in the Rule 15A
NCAC 02B .0295 of 260 trees per acre at the end of five years. No one tree species will be greater than
50% of the established stems. An appropriate seed mix will also be applied to provide temporary and
permanent ground cover for soil stabilization and reduction of sediment loss during rain events in areas
without existing herbaceous cover. Planting is scheduled for winter 2019/2020.
3.3 Riparian Area Enhancement Activities
The revegetation plan for the buffer enhancement areas under NCAC O2B .0295(n) will include planting
supplemental bare root trees and controlling invasive species growth. The tree species to be planted are
listed in Table 4.
3.4 Riparian Area Preservation Activities
There will be no parcel preparation work done in the buffer preservation areas, as allowed under 15A
NCAC 02B .0295(0). The preservation area will be protected in perpetuity under a conservation
easement.

Site preparation and planting on the restoration and enhancement areas is scheduled to begin in
December 2019.
4.0 Monitoring and Maintenance Plan
4.1 Monitoring Protocol
Permanent vegetation monitoring plots will be installed and evaluated within the buffer restoration
areas to measure the survival of the planted trees. The plots will be randomly placed throughout the
planted riparian areas. A total of 6 plots will be established within the riparian buffer restoration and
enhancement credit generation areas (Figure 7). The size of individual quadrants will be 100 square
meters for woody tree species.
Vegetation assessments will be conducted and follow the Carolina Vegetation Survey (CVS) Level 2
Protocol for Recording Vegetation (2008). A reference photo will be taken from the southwestern corner
of each of the 6 plots. Photos will be taken from all photo points each monitoring year and provided in
the annual reports. All planted stems will be marked with flagging tape and recorded.
Planting is scheduled for winter 2019/2020. The first annual monitoring activities will commence at the
end of the first growing season, at least five months after planting has been completed and no earlier
than the fall season. Species composition, height, and survival rates will be evaluated on an annual basis
by plot. The total number of volunteer woody stems will also be documented and reported. The
measures of vegetative success for the Parcel will be the survival of at least 4 native hardwood tree
species, where no one species is greater than 50% of the established stems, and an established density
of at least 260 planted trees per acre at the end of Year five. Appropriate and desirable native volunteer
species may be included to meet the performance standards with NCDWR approval.
The Sponsor shall submit the annual monitoring report to NCDWR by December 31St of each year for five
consecutive years and will follow the terms and conditions of the UMBI.
4.2 Parcel Maintenance
If the Parcel or a specific component of the Parcel fails to achieve the success criteria outlined in Section
4.1, adaptive measures will be developed and/or appropriate remedial actions will be implemented. Site
maintenance will be performed to correct any identified problems on the Parcel that have a high
likelihood of affecting project success. Such items include, but are not limited to, fire, flooding, drought,
or insects that cause excess tree mortality. Any actions implemented will be designed to achieve the
success criteria and will include a work schedule and updated monitoring criteria. Any parcel
maintenance performed will be included in the monitoring report for that year. A rigorous herbicide
schedule may need to be implemented in the first few years of tree establishment in the restoration
areas to prevent establishment of invasive species that may out -compete the planted native vegetation.
The only herbicides used on the Parcel will be aquatic approved herbicides that will be applied in
accordance with North Carolina Department of Agriculture rules and regulations.
The easement boundary will be checked annually as part of monitoring activities. Easement boundary
conditions as well as any maintenance performed will be reported in the annual monitoring reports to
NCDWR. If mowing is deemed necessary by the Sponsor during the monitoring period, the Sponsor must
receive approval from NCDWR prior to conducting any mowing activities within Zone 1 and Zone 2 of
the Randleman Lake buffers to ensure that no buffer violations have occurred.

4.3 Easement Boundaries and Fencing
Easement boundaries will be identified in the field to ensure clear distinction between the Parcel and
adjacent properties. Boundaries may be identified by fence, marker, post, tree -blazing, or other means as
allowed by site conditions and/or conservation easement. Boundary markers that have been disturbed,
damaged, or destroyed will be repaired and/or replaced on an as needed basis. Contact information for
the conservation easement holder will be included on easement markers.
5.0 Financial Assurance and Long -Term Management
5.1 Financial Assurances
Following approval of the Loflin Diary Bank Parcel Development Package, the Sponsor shall provide a
Performance Bond from a surety that is rated no less than an "A-" as rated by A.M. Best. The
Performance Bond amount shall be 100% of the estimated cost for implementation of the project as
described in the Bank Parcel Development Package (BPDP, but not less than $150,000.00. In lieu of
posting the performance bond, the Sponsor may elect to construct the project prior to the first credit
release. In that case no performance bond will be necessary.
After completion of the restoration/construction, a separate Performance/Maintenance Bond will be
secured for 100% of the estimated cost to implement the monitoring and maintenance plan but not less
than $100,000.00. The Performance/Maintenance Bond shall apply at the inception of the monitoring
period for a term of one year and be extended annually for a minimum of five years. Upon NCDWR
approval, this may be lowered each year based on the adjusted cost to complete the monitoring.
Performance bonds for monitoring shall be renewed at least annually to cover the next years monitoring
period, with confirmation of renewal provided to NCDWR with each annual monitoring report when
applicable. NCDWR reserves the right to alter the credit release schedule if monitoring reports are
submitted without proof of bond renewals when applicable.
5.2 Long-term Management
The Parcel will remain in private ownership, protected in its entirety by an approved NCDWR long term
stewardship, and will be managed under the terms detailed in an approved NCDWR conservation
easement. The long-term manager will be responsible for periodic inspection of the Parcel to ensure
that the restrictions documented in the recorded easement are upheld.
6.0 Mitigation Potential
Approximately 12.00 acres will be protected with a permanent conservation easement. Out of the 12.00
acres, a total of 8.09 acres are proposed for riparian buffer restoration, 0.16 acres for riparian buffer
enhancement, and 2.75 acres for riparian buffer preservation, for a total of 360,676.80 riparian buffer
credits. An additional 0.34 acres of forested riparian buffer will be protected under the conservation
easement but are not eligible for mitigation credit in compliance with 15A NCAC 02B .0295(0)(5).
Mitigation activities per drainage feature are outlined in Table 5. These acreages were calculated prior
to applying any reductions in riparian buffer credits for areas between 101 feet and 200 feet from top of
bank, per 15A NCAC 02B.0295(n) or the 2:1 and 10:1 credit ratios on the enhancement and preservation

On July 30, 2018, Katie Merritt, with the Division of Water Resources (DWR), received a request
from you on behalf of Wildlands Engineering, Inc (WEI) for a site visit near the above -referenced
site in the Randleman Lake Watershed of the Cape Fear River Basin. The site visit was to determine
the potential for riparian buffer mitigation within a proposed Easement Boundary, which is more
accurately shown in the attached map labeled "Figure 1 Site Map" and initialed by Ms. Merritt on
October 19, 2018. Part of this site is adjacent to an existing DMS full -delivery buffer mitigation site
known as "Loflin Dairy Buffer Mitigation Site" (DWR# 2012-0365) where fifty -foot riparian buffers
were restored. On October 2, 2018, Ms. Merritt performed a site assessment of the subject site.
Ms. Merritt's evaluation of the features onsite and their associated mitigation determination for the
riparian areas are provided in the table below. This evaluation was made from Top of Bank (TOB)
and landward 200' from each feature for buffer mitigation pursuant to 15A NCAC 02B .0295
(effective November 1, 2015).

NCAC 02B .0295, a mitigation plan shall be submitted to DWR for written approval prior to
conducting any mitigation activities in riparian areas and/or surface waters for buffer mitigation
credit.
All vegetative plantings, performance criteria and other mitigation requirements for riparian
restoration, enhancement and preservation must follow the requirements in 15A NCAC 02B .0295 to
be eligible for riparian buffer mitigation credits.
This viability assessment will expire on October 19, 2020 or upon the submittal of an As -Built
Report to the DWR, whichever comes first. This letter should be provided in all stream, wetland or
buffer mitigation plans for this Site.
