Chris Callaway -Assistant Vice President and Director of Design and Real Estate Wal-Mart Stores East, LP 2001 S.E. 10th Street Bentonville, AR 72716 Subject Property: Wal-Mart Supercenter No. 4459-00 UT to Stony Creek [030302,28-68, C, NSW] Nash County DWQ # 06-0646, Ver. 2 Dear Mr. Callaway: RE: Status of stream on property for propose Wal-Mart, Nashville, NC On February 9, 2007, Larry Eaton and I conducted a site visit to the stream feature found on the property of the proposed Wal-Mart Supercenter in Nashville, NC located at Eastern AVenue. Based on our site visit, we have determined that the stream is perennial from its origin in the wetland area located at the south of the property. The data that we collected for this channel are summarized below in Appendix One. Since this stream is perennial, DWQ will have to require compensatory stream mitigation at a 1:1 ratio for impacts to this channel. However as noted in Mr. Horan's letter, the Division of Water Quality has determined that the stream channel is intermittent from "flag SO-3, BB-1" and this call can be relied upon for five years, Therefore, the Division will only require compensatory stream mitigation for the length of the stream from flag SO-3, BB-1 downstream to Eastern Avenue in the lower end of the large wetland to the south of the site (near flags 129/130 as shown on the map entitled "Wetlands Survey" prepared for the Nashville East Group and sealed by James Strickland, surveyor on October 26, 2005). In your submittal of the mitigation plan, please account for this stream length. If you propose to use the NC Ecosystem Enhancement Program (EEP) to meet this stream mitigation requirement, please provide written assurance from EEP that they are willing to assume this mitigation. If not, please provide a stream mitigation plan that meets DWQ's stream mitigation guidelines as outlined on our website. Until we receive this additional information regarding stream mitigation, this project will remain on hold as incomplete. If you have additional questions, please call me at 919-733- 9646.
