that clarifies some of the confusion on the site. do you have a map that shows where
the SO-3, BB-1 point is? the map provided in your letter shows it on the upper part
of the site but it is on a USGS 1:24,000 scale so it is hard to tell. please
advise. thankx

The time that I went out there the first time for S & EC the stream had no water
in it at all nor could I find enough benthic organisms To me during my first
visit it was intermittent almost perennial. Mike Stocks called me on a Sunday
and wanted me to take a look at the stream to see if I could change my call to a
linear wetland since thats what the Corp was going to call. The second time that
I went out there If I could have I would have rated the stream perennial. I
told Mike Stocks that I would not change my call to a linear wetland. He did not
allow enough room for stormwater on his project, therefore would have to spend
some money out of his companys pocket to buy additional land. I told him still
that I would not change my call. I did tell him if I could have would have called
it perennial that Sunday when I met him out there. He said that he would try to
play his political cards and try to have it reversed. Since then I have not heard
from him since. I would be more than happy to meet anyone on-site to locate my
point and explain my call.

I modified the letter that I sent yesterday. After carefully reading Mike's
Feb 06 letter, we are stuck with his call from site "SO-3, BB-1" upstream since
your letter refers to that point and has a five year "guarantee". However I
can find no map that shows that point so Mike if you have such a map, please
send it on. We can still require mitigation from that point downstream since
Mike's letter only refers to a determination at that point. Again please get
any comments to me by this Friday noonish. thankx
