As a result of this incident, you are hereby notified that, having been permitted to have a non -discharge permit for the subject animal waste disposal system pursuant to 15A NCAC Section .1300, you have been found to be in violation of your Certified Animal Waste Management Plan and the Swine Waste System General Permit No. AWG100000 that you are covered to operate under, as follows: Deficiency 1: Failure to maintain waste levels in your lagoon/storage ponds in accordance with the facility's Certified Animal Waste Management Plan in accordance with Condition V. 2, of Swine Waste System General Permit No. AWG 100000 On December 9, 2009 a lagoon/storage pond level was documented at 18.5 inches of freeboard at the primary lagoon. A level of 19 inches is the maximum level allowed by your permit and Certified Animal Waste Management Plan. Take all necessary additional steps to insure lagoon levels remain in compliance with Section 2 of your permit. You are required to take any necessary action to correct the above violations on or before January 11, 2010 and to provide a written response to this Notice within 30 days of receipt of this letter indicating that freeboard is at a compliant level. Please include in your response all corrective actions already taken and a schedule for completion of any corrective actions not addressed. Aquifer Protection staff from the Washington Regional Office observed ponding or standing water on your sprayfield while conducting a routine flight on Thursday, September 7, 2006. Marlene Salyer of the Aquifer Protection Section at the Washington Regional Office conducted a site investigation at 09:30 AM on September 8, 2006, during which ponded wastewater was observed. Specific violations are as follows: • In accordance with the Animal Waste Operation Permit Condition II, No. 4 and the CAWMP for the subject facility the land application activities are to be conducted in a manner that does not result in ponding of wastewater. In accordance with the NPDES Permit Number Condition II, No. 1 and No.2: the fields and vegetative cover shall be properly maintained. On Friday the 0 of September, it was observed that the Fescue pasture had been mowed by bush hog and the grass had been left lying on the pasture in thick mats, which was impeding growth of remaining grass. To prevent damage to the fescue crop and to remove the nitrogen from the field the mowed grass should be removed from the field. We did pump our lagoon on Sept 7, 2006. We had recently had a tropical storm that dropped 12 inches of rain putting our lagoon level at 19-20 inches. We are currently contracted with Murphy Farms and their requirement of lagoon levels is 24. Prior to the storm, we were in compliance with Murphy Farms. We failed to report our lagoon level in fear of having our pigs removed from the farm, or any violations with DWQ. Hindsight is that we should have waited until the land was dry but impatience of getting the lagoon level back in compliance stood in the way. We were also found with a violation of cutting our pasture and allowing it to stay on the ground without removing. There again, the tropical storm came before we could remove the grass and then it was too wet to remove. Never before have we had any violations with DWQ. Our paper work is very accurate and we always try and do what is right. Farmers have always heard the horror stories of the violations before and removal of pigs, or the astronomical monetary fees that are placed upon them so that they are unable to financially make a living. After our visit from DWQ that day, we did find that Marlene was there to help us in our situation rather than harm us unlike others in the office. Next time we will pick up the phone and call her. A copy of the inspection report is attached for your review. In general, this inspection included verifying that: (1) the farm has a Certified Animal Waste Management Plan (CAWMP) and the General Permit; (2) the farm is complying with requirements of the State Rules 15 NCAC 2H.0217, Senate Bill 1217, the Certified Animal Waste Management Plan and the General Permit; (3) the farm operation's waste management system is being operated properly under the direction of a Certified Operator, (4) the required records are being kept; and that (5) there are no signs of seepage, erosion, and/or runoff. The following deficiencies were observed during the inspection. i Your Certified Animal Waste Management Plan records did not include a soil analysis for 2000. In Section III. Monitoring and Reporting Requirements, item number 3 of the General Permit it is a requirement that a soil analysis be collected annually on each application field receiving animal waste. Further, Section 1I. Operation and Maintenance Requirements, item number 3 requires that time be applied, as needed, to maintain soil pH in the optimum range for crop production. This information is received from your annual soil analysis. It is very important as the owner and the Operator in Charge that you resolve these aforementioned deficiencies and any other problems that may arise, as soon as possible.
