I ani writing in response to your letter dated March 29, 2019 and received by the City of
Marion on April 1, 2019, requesting, within 10 business days of the receipt of the letter, an
explanation of a violation occurring at the Corpening Creek WWTP the week of January
26.
The violation in question involved the weekly average for TSS being exceeded for the week
of January 26. In response to this notice of violation, the Corpening Creek WWTP received
a high flow of wastewater in a short period of time, due to a heavy downpour of rain taking
place in the late evening and early morning hours of January 23-24. As shown in the
attached information, two of our pump stations and the WWTP recorded well over an inch
of rain in a few hours. Despite the City's diligent efforts over the past years to reduce I &
I in our wastewater collection system, with, severai hundred documented sources
eliminated, we still have I & I as does every wastewater system. 2018 was the wettest year
in recorded history in Marion, with approximately 105 inches of rain. Creeks and streams
remained at very high levels into January, almost certainly resulting in situations where
surface waters entered wastewater lines during period of heavy rain,.leading to much higher
than normal wastewater flows.
The heavy rainfall on January 23-24 hydraulically upset the settling process at the WWTP.
In response, City WWTP staff immediately adjusted our aeration and flow to reduce the
impact of the heavy flow and brought everything back under. control within.a short time
period. - As a result, TSS levels were out of compliance for one day, which caused the
weekly violation. I have attached a copy of our DMR to show that all other parameters
were compliant: As noted above, the weather in Marion has been unusual for the past year,
with unprecedented rainfall that often seems to come in very short downpours.

I have attached the data to show how the rain events are spread out through our system,
showing the three major parts of our wastewater system that are digitally recorded. The
information shows that the heaviest rainfall was in a short period from 9:00 p.m. on January
23 through 12:00 a.m. on January 24.
The City would respectfully request that a fine not be issued for the violation in question,
since it was due to heavy rain, with an exaggerated effect due to the record rainfalls and
very high creek and stream levels experienced in 2018 and into early 2019 and since City
staff responded immediately and took actions to limit the impact of the violation.
