Sullins Dee Freeman Governor Director Secretary March 25,201'1 Michael Shelton,Facilities Mechanical Engineer NC Wildlife Resources Commission 1720 Mail Service Center Raleigh,NC 27699 SUBJECT: Pisgah Wildlife Education Center Options for Handling Excessive Rainfall at the Wastewater Treatment Plant Permit No.WQ0012948 Dear Mr. Shelton, his letter is to follow-up on our on-site meeting at the Pisgah Wildlife Education Center on March 16,2011 and subsequent phone conversation to address the issue of excessive rainfall and its effect on the wastewater treatment system. We discussed the following options to reduce/handle the excessive amount of rainwater entering the system: 1. Covering the sand filter with a structure that would deflect rainwater from the filter. 2. Covering the small subsurface wetland(non-planted). 3. Updating the operational software for the system. 4. Raising the backflow piping of the wetlands to increase the total amount of rainwater that the system can hold. 5. Removing some of the gravel in the wetland cell to increase capacity as it appears that the system currently has more than originally designed. All of the options listed above would be considered maintenance issues and would not require permit modifications. However,if you choose Option#4,you must ensure that the cell will not be compromised in any way and can accommodate the required freeboard. If Option#5 is chosen, the gravel should be dried prior to spreading on site property and care must be taken to prevent tearing the liner in the cell. In addition, the gravel should not be spread where the public will have contact. Hopefully these options will be helpful in alleviating the problems associated with the system as it is currently operating. If you have any questions, please feel free to contact me at(828)296-4685. The purpose of this and any subsequent site visit is to periodically monitor groundwater quality in the Tanwood Subdivision, which occupies the former Francis Orchard. Legacy pesticides associated with the former apple orchard footprint have been identified in the shallow soils and some water supply wells. To date, no water supply well within the Tanwood Subdivision has exceeded state groundwater standards (2L) for various legacy pesticides. The sample taken from your water supply well was analyzed for total coliform bacteria, fecal coliform bacteria, arsenic, lead, nitrate, organochlorine pesticides, nitrogen-based pesticides, phosphorus-based pesticides and acid herbicides. Laboratory analysis indicates no detections for total coliform bacteria, fecal coliform bacteria, arsenic, lead, organochlorine pesticides, nitrogen-based pesticides, phosphorus-based pesticides and acid herbicides. However, nitrate was detected at a concentration of 2 mg/I. Potential sources of nitrate can include septic systems, animal waste, commercial fertilizer, and decaying organic matter. North Carolina has established the maximum contaminate level for human consumption of nitrate at 10 mg/I. The level of nitrate in your water supply well is below the state's maximum contaminate level. Laboratory analysis indicates no detections for fecal coliform bacteria, arsenic, lead, organochlorine pesticides, nitrogen-based pesticides, phosphorus-based pesticides and acid herbicides. However, there have been detectable concentrations for nitrate and total coliform bacteria. A brief explanation of each analyte present is given below: • Nitrate was detected at a concentration of 2.9 mg/l. Potential sources of nitrate can include septic systems, animal waste, commercial fertilizer, and decaying organic matter. North Carolina has established the maximum contaminate level for human consumption of nitrate at 10 mg/l. The level of nitrate in your water supply well is below the state's maximum contaminate level. • Total coliform bacteria was detected at a concentration of 1200 CFU/100 ml (Coliform Forming Unit). The presence of total coliform bacteria can indicate potential well integrity issues which allow surface waters to quickly enter the borehole. North Carolina has established the maximum contaminate level for human consumption of total coliform bacteria at 1 CFU/100 mi. The level of total coliform bacteria in your water supply well is above the state's maximum contaminate level. The chlorination process will eliminate total coliform bacteria and any other pathogens that may be present. Your water supply well should be resampled for total coliform bacteria once the chlorination process is completed. It is advisable that you retest for fecal and total coliform bacteria annually. The Haywood County Health Department has the capabilities of testing for bacteria. I have taken the liberty of including fact sheets on total coliform bacteria and the chlorination process. Medford Farm—Facility#44-58 Haywood County Dear Mr. Medford: On December 21, 2010, 1 conducted a routine Compliance Inspection of the animal waste handling system for the Frank D. Medford Farm. The maintenance and operation of the dairy appeared to be very good. One area of concern noted during the inspection was with regard to cows having access to the creek. This causes potential for adverse impacts to the creek. It is recommended that cows be fenced from the creek and a watering source added to the pasture. Also, feeding stations are too close to the creek, presenting the potential for animal waste to be discharged to surface waters. Recommend moving feeding stations up and away from creek You can contact Haywood County Soil and Water for technical assistance in this matter. I appreciate your assistance during the inspection. If you have any questions regarding this inspection or need assistance of any kind, please do not hesitate to contact me at(828)296- 4685. As has been noted during past inspections, the creeks around your farm look bad.Cows have free access and they are causing a lot of stream bank erosion. Also, feeding stations are too close to the creek. Animal waste is piling up at the feeding stations and creating conditions where waste can get into surface waters. This review has shown the subject facility to be in violation of permit WQ0004797. The violation that occurred is summarized below: Permit Condition II. 6., requires that the spray irrigation facilities be effectively maintained and operated as a non-discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. On January 4, 2011, approximately 2500 gallons of process wastewater spilled onto the ground, and approximately 500 gallons discharged to an unnamed tributary to Mud Creek. The spill was believed to have been the result of leaking butterfly valves from the irrigation lines which subsequently filled an underground pipe running from the lagoon to the pump station. The pipe then leaked at a broken fitting. You are required to provide a written response to this Notice by February 14,2011. Please include in your response, a schedule for completion of any corrective actions referenced in the 5-Day Bypass Report as well as your method of determining the volume of the spill. This review has shown that Monitoring Wells #2R, 4, 5, 6, and 8 contained fecal and/or total coliform bacteria. The 2L Groundwater Standard for total coliform is 1/100 ml of sample. All of the referenced wells contained total coliform bacteria above this level. Often, we find that surface water intrusion into the wells can result in this type of contamination. We would like for you to assess the wells to determine if they were properly constructed. The Well Construction Record(GW-1 Form) indicates that the wells were grouted; however we would like to have this confirmed. If the wells have been properly constructed,we would like to see further investigation into the cause of the coliform contamination. If you have any questions, please contact me at(828)296-4685. Dear Mr. Matheny: On November 1, 2010, 1 collected a water sample from your water supply well located on Honeybee Way within Barber Orchard. The water sample was analyzed for arsenic, lead, cooper, chromium, herbicides and pesticides. Relict pesticides currently found in soil and groundwater within Barber Orchard would be detected if present using these methods. These types of pesticides include many compounds that have been documented to be present in groundwater such as BHC-Gamma (lindane) and endrin. The water sample was collected from the kitchen sink faucet. The lab results are attached and I've highlighted the detected compounds on the sheets in blue. A summary of the detections) are as follows: Compound Detected Level EPA Drinking Water (parts per Standard (parts per billion) err' billion) MCL Cooper 19 1,300 *MCL is maximum contaminant level allowed in public systems. One of the EPA approved analytical methods (EPA method 608) involves use of a device called a gas chromatograph that essentially volatilizes the sample's compounds and the volatized electrons are then captured and measured in intensity. The electron measuring device essentially returns 'peaks' which are then matched with 'peaks' of known pesticides. Seven unidentified peaks were found in your well sample. The lab contacted me directly to determine the setting of your well and to determine exactly what we were attempting to 'look for' which would've assisted them in identifying the peaks. However, in the end, these peaks remained unidentifiable. Based on these results, a health risk assessment is not warranted. Should you have questions or wish to speak in greater detail about the limited results, please do not hesitate to call me at (828) 296.4680 or via email at landon.davidson(ancdenr.dov. Sullins Dee Freeman Governor Director Secretary Aquifer Protection Section January 12, 2011 Susan Albee 621 White Oak Lane Tryon, NC 28782 Dear Ms. Albee, On three different dates (9/7/2010, 10/25/2010, & 11/17/2010), personnel from the Asheville Regional Office's Aquifer Protection Section (APS) evaluated you water supply well located at 621 White Oak Lane in Polk County. An investigation was initiated over your concerns of an unknown white precipitate or settable solid present in your water supply well and indoor plumbing. The goal of the investigation was to indentify the White precipitate, evaluate the effectiveness of your whole-house treatment and make recommendations on .jmproving the quality of your groundwater supply. Multiple water quality samples were taken at the well head and the kitchen faucet (Table 1). Laboratory analysis indicates no detections for arsenic, cadmium, chromium, lead, mercury, nickel, selenium and silver. However, there are detections for aluminum, barium, copper, iron, magnesium, manganese, sodium, and zinc. A brief explanation of each analyte present is given below: • Aluminum was detected at concentrations ranging from 1.3—2.2 mg/l. Aluminum is a natural occurring metal commonly associated with aluminum silicates otherwise known as clays. North Carolina has not established a groundwater standard for aluminum. It is believed that the bedrock surrounding the open borehole is unstable and releasing the clays as material sloughs off into the well borehole. It is important to note that samples taken at the kitchen faucet indicates very little aluminum removal by your current treatment system. • Barium was detected at a concentration of 0.02 mg/I. Barium is a naturally occurring metal in the region's bedrock and soils. North Carolina has established the maximum contaminate level for human consumption of barium at 0.70 mg/l. The level of barium in your water supply well is below the state's maximum contaminate level. • Copper was detected at concentrations ranging from 0.006 — 0.008 mg/I. Copper is a naturally occurring metal in the region's bedrock and soils. North Carolina has established the maximum contaminate level for human consumption of copper at 1 mg/l. The level of copper in your water supply well is below the state's maximum contaminate level. It is important to note the copper concentrations are higher at your kitchen faucet (0.048— 0.070 mg/1). Groundwater was determined to be acidic (5.5— AQUIFER PROTECTION SECTION—Asheville Regional Office(ARO) 2090 U.S.70 Highway,Swannanoa,NC 28778-8211 Phone:828-296-45001 FAX:828-299-7043 Customer Service:1-877-623-6748 Nor thCarolina Internet:www.ncwaterauality.ora Naturaliff An Equal Opportunity 1 Affirmative Action Employer 5.8) which may be interacting with the indoor plumping (copper pipes) and/or treatment system to release copper. Regardless, copper concentrations at your kitchen faucet are also below state groundwater standards. • Iron was detected at concentrations ranging from 0.56—0.63 mg/I. Iron is a naturally occurring metal in the region's bedrock and soils. North Carolina has established a maximum contaminate level for human consumption of iron at 0.3 mg/I. The level of iron in your water supply well is above the state's maximum contaminate level. Please be aware that the presence of iron in groundwater is common and does not constitute a health risk. It is important to note that samples taken at the kitchen faucet indicate very little iron (0.48—0.76 mg/1) removal by your current treatment system. • Magnesium was detected at a concentration of 0.79 mg/l. Magnesium is a naturally occurring metal in the region's bedrock and soils. North Carolina has not established a groundwater standard for magnesium. • Manganese was detected at a concentration of 0.02 mg/I. Manganese is a naturally occurring metal in the region's bedrock and soils. North Carolina has established a maximum contaminate level for human consumption of manganese at 0.05 mg/l. The level of manganese in your water supply well is below the state's maximum contaminate level. Please be aware that the presence of manganese in groundwater is common and does not constitute a health risk. • Sodium was detected at a concentration of 8 mg/l. Sodium is a naturally occurring metal in the region's bedrock and soils. North Carolina has not established a groundwater standard for sodium. The U.S. Environmental Protection Agency and the North Carolina Division of Public Health recommends sodium concentrations less than 20 mg/I for drinking water (based on 500 mg/day restricted sodium diet). The concentration of sodium in your water supply well is below the public health recommendation. • Zinc was detected at a concentrations ranging from 0.011 — 0.013 mg/l. Zinc is a naturally occurring4 metal in the region's bedrock and soils. North Carolina has established a maximum contaminate level for human consumption of zinc at 1 mg/I. The level of zinc in your water supply well is below the state's maximum contaminate level. It is important to note that zinc concentrations are much higher at your kitchen faucet (2.5 — 3.1 mg/1). Groundwater at the well head was determined to be acidic (5.5 — 5.8) which may be interacting with the treatment media to release zinc. The level of zinc at your kitchen faucet is above the state's maximum contaminate level. On November 17, 2010, APS staff attempted to use a well camera to inspect the integrity of the well casing and bedrock borehole. Initially, the water supply well was pumped or purged for approximately one hour. Water levels dropped from 81 feet below land surface (BLS) to 140 feet BLS. The water level was holding steady at 140 feet BLS when copious amounts of coarse sediment began discharging from the well head faucet followed by a loss of pressure at the well pump. It was concluded that a portion of the bedrock had collapsed and filled the borehole up to the level of the pump (-- 360 feet BLS). Pittman Drilling was called on site to raise the well pump approximately 40 feet. It is our opinion that the collapse of the borehole is an indication that the underlying bedrock is unstable and may continue to collapse over time. We have also concluded that your water supply well has an adequate recharge rate and that any loss of in-house pressure is not related to groundwater levels or pump performance. In closing, I would like to summarize our findings to date: • The white precipitate present in your water supply well is most likely related to the release of clay-size particles as sections of weak bedrock slough off into the open borehole. In order to slow or stop the degradation of the borehole, it is recommended that casing extend the entire length of the well followed by the addition of coarse material in the surrounding annulus space to help support the bedrock. • It was determined that your water supply well has adequate recharge and any loss of in-house pressure is not related to groundwater levels or pump performance. • Your current treatment system is inefficient at removing metals such as aluminum, iron, copper and zinc. More importantly the copper and zinc concentrations are much higher at the kitchen faucet which may reflect some interaction between acidic groundwater and in-house plumbing and/or treatment system. It is advisable that a water treatment specialist be consulted to improve or replace the current treatment and thus reduce the levels of zinc at your in-house faucets. I have attached several fact sheets on groundwater quality and water treatment systems. Please contact state toxicologist Dr. Ken Rudo if you have questions concerning the health risks of copper and zinc in your drinking water. Dr. Rudo can be reached at (919) 707-5911 or at ken.rudo@ncdenr.gov. I am also available if you have any additional questions or need further assistance. This rule states that any casing not grouted in accordance with 15A NCAC 02C .0107(f) shall be removed or grouted in accordance with 15A NCAC 02C .0107(f l prior to the abandonment of the well. The variance request is for the abandonment of one (1) water supply well at 1250 Sand Hill Road, in Enka, Buncombe County, North Carolina. Based upon the location of your well, which is inside the perimeter of a building at the above referenced property, and the information provided by your well contractor, it is my finding that the factors specified are sufficient to satisfy the conditions for approval of a variance as defined in 15A NCAC 2C.0118. Please note the attached permit conditions regarding the abandonment of the well. A copy of this permit, which includes the variance, should be attached to the required Well Abandonment Record (GW-30). The granting of this permit and variance is for the abandonment of one well located inside of the building only, and in no way relieves the owner or agent from other requirements of the North Carolina Well Construction Standards, or any other applicable law, rule or regulation that may be regulated by other agencies. Parris NC Division of Waste Management Inactive Hazardous Sites Branch 610 East Center Avenue Mooresville, NC 28115 Subject: Groundwater Complaint Referral Former Burlington Industries Facility—Rutherford County Dear Mr. Parris, The Asheville Regional Office's (ARO) Aquifer Protection Section (APS) has been working with the Rutherford County Commissioners to closeout a portion of a wastewater treatment system located at a former xtile plant in Rutherford County, North Carolina. The 122-acre Burlington Industries facility operated from 6 to 1999 and was subsequently purchased by Rutherford County for expansion of an adjacent industrial lyurk. Rutherford County Commissioners contacted the APS in March 2009 to begin closure on the following wastewater treatment components (see attached map): process water filter treatment lagoon, three concrete clarifiers, sludge drying bed and waste filtering bed. The Division of Water Quality formerly permitted the wastewater treatment system through an NPDES permit (NC0006025) and a residuals land application permit (WQ0002007). During the closure proceedings, tetrachloroethene (PCE) was detected in the groundwater directly downgradient of the wastewater treatment system. It is important to note that all of the treatment components currently under review were eliminated in 2003 without following the closure guidelines for treatment or storage ponds and lagoons. Regardless, the County was required to sample the soils directly beneath the process water filter treatment lagoon, sludge drying bed and waste filtering bed. APS required all soil samples to be analyzed for 8 RCRA metals, volatile organic compounds and total petroleum hydrocarbons (gasoline/diesel). All volatile organic compounds and total petroleum hydrocarbons detected in the soils were below Inactive Hazardous Sites Branch (IHSB) soil- groundwater remediation goals and Underground Storage Tanks (UST) action levels. Arsenic and chromium concentrations were detected at 87 mg/kg and 41 mg/kg respectively, which are above IHSB soil-groundwater remediation goals. APS required a temporary monitoring well (TW1) to be constructed immediately downgradient of the waste water treatment system and a one-time sample of the groundwater for 8 RCRA metals and VOC's. Arsenic and chromium were below laboratory detection limits but PCE was detected at a concentration of 39—46 ug/l, which is above 2L groundwater standards. A Notice of Violation was issued to Rutherford County on September 10, 2009. Mid-Atlantic Associates Inc. began a comprehensive site assessment and well receptor survey the following month. The investigation demonstrated that the releasL is not associated with the wastewater treatment components under review. In August 2010, APS info, Rutherford County that no further action would be required in the closure of wastewater treatment system r,, the PCE contamination would be referred to IHSB. The Burlington Industries facility is located at 1181 Old Caroleen Road in Forest City, North Carolina. Generations of your family have farmed and lived along the Cane. I understand your pride and passion in protecting such a rich heritage. The Burnsville wastewater treatment plant has undergone a complete upgrade and appears to be working well, lathe river is recovering, and citizens are taking ownership of their watershed recognizing the economic and aesthetic benefits that clean, healthy rivers bring to residents of mountain communities. A coalition of stakeholders, industry, local government,non-profits,resource agencies, and citizens is forming to address water quality concerns in the Toe and Cane Rivers in Yancey,Mitchell and Avery Counties. The first stakeholder meeting will take place this winter and I hope you will attend as your participation would be a great benefit to the group. Meeting details to follow. Sullins Dee Freeman Governor Director Secretary Aquifer Protection Section November 24, 2010 Thomas F. Fischel 8274 Cullowhee Mountain Road Cullowhee, NC 28723 Dear Mr. Fischel, On September 13, 2010, personnel from the Asheville Regional Ofce's Aquifer Protection Section collected a sample from your spring house located at 8274 Cullowhee Mountain Road in Jackson County. The site visit was initiated by your concerns that an adjacent commercial vegetable field and associated fertilizer/pesticide usage may be impacting shallow groundwater in the vicinity of your spring. Site topography appears to support this potential but there were no signs of recent agricultural activity at the time of our site visit. Our sampling strategy was to identify natural contaminants (metals and bacteria), nutrients, legacy pesticides and current-use pesticides. A detailed list includes the following analytes: arsenic, cadmium, hromium, copper, iron, lead, manganese, nickel, selenium, sodium, zinc, nitrate, nitrite, semi-volatile organic mpounds, chlorinated pesticides, nitrogen based pesticides, phosphorus based pesticides, acid herbicides, tal coliform bacteria and fecal coliform bacteria. Laboratory analysis indicates no detections for arsenic, cadmium, chromium, copper, iron, lead, nickel, nitrite, selenium, zinc, semi-volatile organic compounds, pesticides and fecal coliform bacteria in your water supply well at this time. However, analysis did indicate the presence of manganese, nitrate, sodium and total coliform bacteria. A brief explanation of each analyte present is given below: • Manganese was detected at a concentration of 0.042 mg/I. Manganese is a naturally occurring element that is abundant in local rocks and soils. North Carolina has established the maximum contaminate level for human consumption of manganese at 0.05 mg/l. The level of manganese in your water supply well is below the maximum contaminate level. • Nitrate was detected at a concentration of 3.30 mg/l. Potential sources of nitrate can include septic systems, animal waste, commercial fertilizer, and decaying organic matter. North Carolina has established the maximum contaminate level for human consumption of nitrate at 10 mg/I. The level of nitrate at your spring is below the maximum contaminate level. • Sodium was detected at a concentration of 11 mg/I. Sodium is a naturally occurring element that is abundant in local rocks and soils. Sodium does not have a maximum contaminate level. The U.S. Environmental Protection Agency and the North Carolina Division of Public Health recommend sodium concentrations less than 20 mg/I for drinking water (based on 500 mg/day restricted sodium diet). The concentration of sodium in your water supply well is below the public health recommendation. Total coliform bacteria are commonly found in the environment (e.g., soil or vegetation) and are generally harmless. However, they may indicate the presence of other disease-causing organisms (pathogens) such as fecal coliform bacteria, which was not present at your spring. Total coliform bacteria are more common at spring sites because recharge or filtration through soil is considerably less for springs as compared to a normal water supply well. North Carolina has established the maximum contaminate level for total coliform bacteria at 1 CFU/100 mi. The level of total coliform bacteria at your spring is above the maximum contaminate level. It is recommended that you contact a reputable water treatment specialist to address the presence of total coliform bacteria in your drinking water. Possible treatments may include microfiltration, reverse osmosis, ultrafiltration, chemical oxidation and disinfection (chlorine injection) or ultraviolet sterilization. You have indicated that the adjacent agricultural field will be in production during the 2011 growing season. I am planning to resample your spring prior to the growing season (April) and midway during the growing season (July). Sullins Dee Freeman Governor Director Secretary Aquifer Protection Section November 16, 2010 Carl Roess 380 Fowler Lane Brevard, NC 28712 RE: Review of Ground Water Data Taken on September 7, 2010 Mr. Roess, On September 7, 2010, personnel from the Asheville Regional Office's Aquifer Protection Section collected a sample from your water supply well located at 380 Fowler Lane in Transylvania County. The purpose of the visit was to monitor arsenic concentrations at your well head and to evaluate the effectiveness of a newly installed drinking water filter. Previous sampling events have detected elevated levels of arsenic and zinc in your drinking water. Arsenic is naturally occurring in local aquifers and is present in your water supply well at concentrations nging from 12— 15 ug/I (parts per billion). The latest arsenic-in-groundwater concentration is 18 ug/l, which is above North Carolina's maximum contaminant concentration of 10 ug/I. Please note that the increase in arsenic levels may be attributed to seasonal variability rather than rising concentrations. The effectiveness of your KDF water filter to remove arsenic was also evaluated. The current analytical results show arsenic is undetectable (< 2 ug/1) at the kitchen faucet. However, zinc concentrations are increasing from the well head (13 ug/1) to the kitchen faucet (90 ug/1). North Carolina's maximum contaminate level for zinc is 1,000 ug/I. The most likely source for the zinc is the KDF water filter, which consists of granulated copper and zinc-based alloys. Your new drinking water filter appears to be reducing arsenic concentrations to below detection limits. If it is agreeable the Aquifer Protection Section will continue to monitor arsenic levels at your well head on an annual basis. As for the immediate future, it is advisable that you continue monitor the arsenic and zinc concentrations at your kitchen faucet. Water quality analysis can be arranged through the Transylvania County Health Department. Please feel free to call me if you have any further questions or concerns. Dear Mr. Meadows: The Aquifer Protection Section of the Division of Water Quality (DWQ) is responsible for the Cgulation of well construction activities within the State of North Carolina. On October 12, 2009, the Asheville Regional Office (ARO) of DWQ inspected a water supply well located on the property of Joel and Diane Edwards, 79 Long Branch Road, Marshall, N.C. The field inspection verified data submitted to the Solid Waste Section indicating that the subject well was located within 500 ft of a closed, municipal landfill owned by Madison County. The well identification tag indicated that the well was drilled November 30, 2006. The landfill waste cell closest to the subject well stopped receiving waste and was subsequently closed as of December 21, 1995. Although the identification plate on the well indicates a driller registration number of 922, you stated in a conversation with me on October 16, 2009 that in fact, you drilled the subject well. You are also the registered agent for Clearwater Well Drilling, Inc. and Clear Water Well & Pump Corporation. Therefore the following violation exists: VIOLATION: The well was installed at distance less than 500 feet from the landfill boundary, as required by Rule 15A NCAC 2C.0107(a)(2)0). Based on a site survey, the well is located approximately 300 ft from the nearest waste cell boundary. Because this well is contaminated, you are not required to chlorinate the well prior to abandonment. REQUIRED CORRECTIVE ACTION for Violation: Please abandon the well as required by 15A NCAC 2C.0113(b) and submit a well abandonment record (GW- 30). Please take the corrective actions for the above violations as necessary to bring said well into compliance. Please notify this office and the well owner at least 48 hours in advance before you plan to or abandon the well. You must have written approval from the property owner and the owners must be connected to an alternate water source REIgr to your abandonment activities. Corrective actions must be taken and reported to the Asheville Regional Office, 2090 US Highway 70, Swannanoa, NC 28778, within 25 days, unless otherwise noted in the above corrective actions, from receipt of this Notice to avoid recommendation of civil penalties for continuing violations. Whisnant Asheville Plant Manager Progress Energy Carolinas, Inc. 200 CP&L Drive Arden, NC 28704 Re: Carolina Power& Light Company d/b/a Progress Energy Carolinas, Inc. (PEC) Asheville Electric Steam Plant Response to Compliance Boundary Groundwater Monitoring Well's As-Built Information Dear Mr. Whisnant: The North Carolina Division of Water Quality's (DWQ) Asheville Regional Office (ARO) acknowledges receiving your letter of September 30, 2010. In your letter, you confirm the completion of the Asheville Electric Steam Plant monitoring well network and provide drilling logs and GW1 forms as supporting documentation. After careful review of the information provided, the ARO finds the majority of the well locations and their corresponding depths adequate for the purposes of compliance monitoring. However, the construction specification of wells located at nested well site 4 fail to offer satisfactory monitoring points for compliance monitoring. The purpose of the bedrock monitoring well is to intercept fractures or joints within competent bedrock that may be acting as conduits for groundwater between the coal ash pond and the French Broad River. Additionally, a properly constructed bedrock monitoring well should verify an upward vertical gradient in this hydrologic setting (discharge area). According to the drilling log for CB-46, partially weathered rock or the transition zone extends roughly 17 — 31 feet below land surface followed by competent bedrock. It appears that CB-46 only extends 8 feet into competent bedrock and may be partially screened across the lower transition zone. Please note 15A NCAC 2C .0108(e) states that a well shall not hydraulically connect separate aquifers or those portions of a single aquifer where contamination occurs in separate and definable layers. Monitoring well CB-4 appears to be developed within the upper portion of the transition zone rather than fully screened across the entire section. The lack of water across much of the screened interval indicates that monitoring well CB-4 is too shallow. All monitoring wells must be Nm& a DivWm a'Warr -Ash m-U Rermw ofnm 2tM 0 U 5.H way 7u SVnm we,AFC 2 M8 Phe aM 296F Mo AgW*r Ptale 3fm S x*m FAX {828)2W7W Suvim r-MTTl-W34748 2 I Progress Energy CB Monitoring constructed in such a manner as to never allow water levels to drop below their screened interval. The probable use of push-probe auger technology for installation may have inadvertently resulted in less depth penetration for this geologic setting. You may be required to replace this well if water levels remain at or below the bottom of the screened interval. Based on these findings, a new bedrock monitoring well (CB-4B) is required. The new well will have a casing seated five or more feet into competent bedrock and have a minimum open borehole depth of 50 feet into competent bedrock as well as an adequate supply of water sufficient to obtain a representative groundwater sample year around. According to 15 NCAC 2C .0108 (p), all new monitoring wells should be properly developed such that the level of turbidity or settleable solids does not preclude accurate chemical analyses of any fluid sample collected. The Division appreciates your prompt attention in making the necessary changes to your groundwater monitoring program. Any questions or concerns should be directed to Brett Laverty in the Asheville Regional Office. Mr. Laverty can be reached at (828) 296-4500 or brett.lavertvAncdenr.gov. Sincerely, I G.
