Director Division of Water Quality December 22, 2006 DWQ Project # 04-0026, Ver. 2 Wake County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Robert Polanco 8804 Albright Road Raleigh, NC 27612 Subject Property: Cedar Ridge Subdivision Harris Creek [030402, 27-26, C, NSW] REQUEST FOR MORE INFORMATION Dear Mr. Polanco: On November December 7, 2006, the Division of Water Quality (DWQ) received your application dated December 6, 2006 to impact 901inear feet of perennial stream, and 5,044 square feet of Zone 1 protected Neuse River basin riparian buffers, and 2,708 square feet of Zone 2 protected Neuse River basin riparian buffers to construct the proposed residential subdivision. On December 14, 2006, the DWQ received additional information from you, however, the DWQ has determined that your application remains incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your: application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following t ~.. information so that we may continue to review your project. Additional Information Requested: Please contact the DWQ to schedule intermittent/perennial stream determinations at the site. Please complete Section XIV -Cumulative Impacts (required by DWQ) of your Pre-Construction Notification (PCN) application. Please clearly indicate Zone 1 and Zone 2 buffer impacts on the site plan with shading or hatching. 4. Please provide a signed and sealed subsurface geotechnical report for your proposed bottomless culvert. Please provide cross section details showing the provisions for aquatic life passage. 6. Please locate and clearly label any planned sewer lines on the site plan. Please provide building envelopes on the plan sheet. Please submit CAD files showing stream length impacts and culverts at all stream crossings. The stream length appears to be longer than the culvert on the site plan. 10. The 160 linear feet of perennial stream impacts are not temporary. Compensatory mitigation will be required for the 160 feet of perennial stream impact and for the 1001inear feet of perennial stream impact. Therefore, 260 linear feet of stream mitigation will be required for this project. Please submit a compensatory mitigation plan. The plan must conform to the requirements in 15 A NCAC 2H .500 and must be appropriate to the type of impacts proposed. Please contact the DWQ within three weeks of the date of this letter to verify that you have received this letter and that you remain interested in continuing to pursue permitting of your project and will be providing the DWQ the requested information at a later date. Please contact me in writing and Mike Horan of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
