Property Description The subject property (“Property”) consists of one parcel totaling 35.35 acres. The parcel is located on private land. The Property is identified on the Lee County Geographic Information System (“GIS”) website as Parcel ID No. 9661-10- 5468-00. The Property consists of wooded land and is currently under construction. The Property is located west of Harvey Faulk Road, south of Sanford, Lee County, North Carolina, approximately 0.6 miles south of the intersection of State Highway NC-87 and Harvey Faulk Road. Surrounding properties are residential and wooded land to the north. The north and east sides of the Property are bound by an unnamed commercial building. The east side of the Property is bound by Harvey Faulk Road. The south side of the Property is bound by residential properties, wooded land, agricultural fields, and a cell tower. The west side of the Property is bound by wooded land. The interior of the Property consists of wooded land from planted pine trees. No wetlands or streams are located within the Property limits. Coordinates: 35.4276, -79.1295 Property Acres: 35.35 acres approx. EnviroTrac Ltd. completed all desktop and field studies on April 6, 2018 for the proposed project on the Property located in Lee County, sited on private land. This study included a review of the State Clearinghouse comments received to date, attached in Appendix C. Based on our observations, no wetlands or streams were observed within the Property. There are no impacts to wetlands, streams, or isolated wetlands and no USACE (Section 404 of CWA) or NCDEQ (Section 401 of CWA) permits are required. The North Carolina Wildlife Resources Commission has recommendations, but not requirements for surface waters at the Property. Based on information gathered from our field reconnaissance and information available from various State and Federal agencies, including the State Clearinghouse Comments as shown in Appendix C, the development of the solar plant on the Property is not likely to adversely affect or impact endangered, threatened, or species of concern. Based on a review of the Property for Historic and Cultural Resources, no documented sites are within one mile of the Property boundary, and no documented resources will be impacted by the development of the solar plant on the Property. SCOPE OF INVESTIGATION The project site is located within one parcel (PIN 9661-10-5468-00, the “Property”) in Lee County, approximately 27 acres out of the approximate 35 acres of the parcel (Figure 1 in Appendix A). The Property consists of wooded land. The field reconnaissance for the wetlands, endangered species, and historic/cultural resources survey was conducted on March 15, 2018. Property access was provided by Harvey Faulk Road to the east of the Property and from Robert E. Lee Drive along the northern border of the Property. The Property boundaries were not marked at the time of field studies; however, the field study was performed within the entirety of the Property as shown in Exhibit A. Additionally, the scope of work included the review of the State Clearinghouse Comments received to date, attached in Appendix C, and the concerns are discussed below where applicable. Surrounding properties are residential and wooded land to the north. The north and east sides of the Property are bound by an unnamed commercial building. The east side of the Property is bound by Harvey Faulk Road. The south side of the Property is bound by residential properties, wooded land, agricultural fields, and a cell tower. The west side of the Property is bound by wooded land. The interior of the Property consists of wooded land from planted pine trees. Figure 2 in Appendix A includes aerial imagery from Lee County in 2016 showing relatively recent Property conditions. The United States Geological Survey (“USGS”) Topographic map, the USDA Soils data, the USFWS NWI data, and the FEMA flood hazard data was reviewed.  USGS Topographic Map (Figure 1 Appendix A): o Elevations within the Property range from approximately 370 feet above mean sea level (“MSL”) to the east to approximately 350 feet MSL to the west. o A pond and unnamed tributary to Gasters Creek are depicted to the southwest of the Property.  Wetlands Map (Figure 3 Appendix A): Includes the USFWS NWI data, which depicts the general location of wetlands. According to the NWI data, there are no wetlands, streams, or pond within the Property. The general location of the closest wetland outside of the Property is a freshwater pond southwest of the Property. The wetlands are discussed in Section 1.3.b)  USDA SSURGO Soils Map (Figure 4 Appendix A): Depicts the general soils on the Property. Details regarding the soils are provided in Section 1.3.b).  Flood Hazard Map (Figure 5 Appendix A): No flood hazard zones are present on the Property, according to the data from the FIRM panel (3710966100J) showing the FEMA flood hazard zones.  Geology Map (Figure 6 Appendix A): According to the 1985 Geologic Map of North Carolina, bedrock in the vicinity of the Property is mapped as a DocuSign Envelope ID: 30C8C546-111C-465D-B8AA-6162CA2EC084DocuSign Envelope ID: F3DC1E6A-DFA6-4EDC-8203-F92ACFDA2DB5 11.990121.00 Page 5 May 18, 2018 © 2018 EnviroTrac Revised March 19, 2019 Cretaceous geologic unit, the Middendorf Formation, which consists of sand, sandstone, and mudstone. 1.2 WATERS OF THE UNITED STATES Wetlands, streams, ponds, lakes, and open waters considered to be jurisdictional “Waters of the United States” are regulated under Section 404 and Section 401 of the Clean Water Act (“CWA”). Section 404 of the Clean Water Act is administered by the U.S. Army Corps of Engineers (“USACE”). Section 401 is administered by the North Carolina Department of Environmental Quality Division of Water Resources. These programs regulate the discharge of dredged or fill material into “Waters of the United States,” and ensure State Water Quality Standards are maintained. Permits are required prior to impacting any jurisdictional Waters of the United States. The type of permit depends on the type, location, and amount of impact. T1.8 indicates if a permit is required. The following analysis regarding wetlands and streams implements prescribed methodologies for compliance under Section 404 and Section 401 of the CWA from the USACE and North Carolina Division of Water Resources. The findings are included in Section 1.3.b). Coastal Area Management Act (“CAMA”) is a legislation passed by the North Carolina General Assembly in 1974, with the purpose to protect unique natural resources of the North Carolina coastal areas. There are currently 20 counties in North Carolina subject to the CAMA rules. CAMA regulations are applied to Areas of Environmental Concern (“AEC”). A property is within an AEC if it is:  In or on navigable waters;  On marsh or coastal wetlands;  Within 75 feet of the mean high-water line along an estuarine shoreline;  Near the ocean beach;  Near an inlet;  Within 30 feet of the north high-water level of areas designated as inland fishing waters by the North Carolina Marine Fisheries Commission;  Within 575 feet of the mean high-water line along Outstanding Resource Waters shoreline. T1.12 indicates if a CAMA permit is required. 1.3 WETLANDS AND STREAM SURVEY 1.3.a) METHODOLOGY The methodology used to identify areas suspected of having conditions to support wetlands included walking the Property to observe existing vegetation, soil characteristics, and hydrology. Wetlands are defined by the USACE and the United States Environmental Protection Agency as “those areas that are inundated or saturated by surface or groundwater at a frequency and duration sufficient to support, and under normal circumstances, do support a prevalence of vegetation typically adapted for life in saturated soil conditions.” For an area to be classified as wetlands, hydrophytic vegetation, hydric soils, and wetlands hydrology indicators must be present. Features such as ditches, swales, and gullies that are not tributaries and do not have a significant nexus to traditional navigable waters are not considered jurisdictional waters. The methodology used to determine the presence or absence of wetlands at the Property was in accordance with those described in the 1987 Corps of Engineers Wetland Delineation Manual. Streams were identified in accordance with the North Carolina Department of Environmental Quality (“NCDEQ”) Division of Water Resource’s Methodology for Identification of Intermittent and Perennial Streams and Their Origins. Figure 3 in Appendix A provides a graphic representation of the NWI data from USFWS. Figure 2 in Appendix A provides a graphic summary of the findings. 1.3.b) FINDINGS – WETLANDS Soils mapped by the US Department of Agriculture (“USDA”) at the Property include Dothan loamy sand and Cecil fine sandy loam. The Dothan Series is included in the list of Hydric Soils of North Carolina. Hydric soil, wetlands hydrology, and hydrophytic vegetation were not observed at the Property. Figure 4 in Appendix A provides the SSURGO Soils map included in the ERIS Report for the Property. The SSURGO Soils map graphically shows the most detailed county level soils data from USDA. No wetlands or isolated wetlands were observed within the Property (T1.1, T1.2). The NWI data also shows that there are no wetlands within the Property (Figure 3 Appendix A). The proposed solar plant will not impact wetlands or isolated wetlands (T1.6); therefore, no USACE or NCDEQ permits regulated under CWA Section 404 and Section 401 are required (T1.8). 1.3.c) FINDINGS – STREAMS No streams were observed on the Property (T1.3, T1.4). The proposed solar plant will not impact streams (T1.7); therefore, no USACE or NCDEQ permits under CWA Section 404 and Section 401 are required (T1.8). A pond and a tributary to Gasters Creek are located outside and to the west of the Property. 1.4 ENDANGERED SPECIES SURVEY Species of plants and animals that are in danger of extinction are protected under the Endangered Species Act of 1973 (“ESA”). The ESA is administrated by the USFWS and the Commerce Department’s National Marine Fisheries Service (“NMFS”). The USFWS has the primary responsibility for terrestrial and freshwater organisms, and the NMFS mainly has the responsibility for marine wildlife. Under the ESA, the federally listed species can be listed as threatened or endangered. “Endangered” means a specie is in danger of extinction throughout all or a significant portion of its range. “Threatened” means a specie is likely to become endangered within the foreseeable future. Bald and golden eagles are protected under the Bald and Golden Eagle Protection Act (“BGEPA”) and under the jurisdiction of the USFWS. It is prohibited to “take” bald or golden eagles, including their parts (which includes feathers), nests of eggs. The BGEPA defines “take” as: “pursue, shoot, shoot at, poison, wound, kill, capture, trap, collect, molest, or disturb”. A permit is required for “taking” a bald or golden eagle. USFWS has developed a county list of federally listed species by utilizing the North Carolina Natural Heritage Program’s data. The Information for Planning and Consultation (“IPaC”) tool is a service provided by the USFWS. IPaC is used to generate a list of species and their critical habitat managed by the USFWS Ecological Services Program. The primary information used to generate this list is the known or expected range of each species, and additional areas of interest are also considered. Because species can move, and the site conditions can change, the species on the list are not guaranteed to be found on or near the project area. 1.4.a) METHODOLOGY The purpose of the endangered species survey was to identify any habitats and presence of individual endangered species within the Property. As part of the study, EnviroTrac reviewed the State Clearinghouse Comments received to date. The focus of the endangered species survey was related to investigation of those species identified by the North Carolina Natural Heritage Program. Table 2 lists the species identified by the Natural Heritage Program within the Sanford and Broadway USGS Quadrangles. Prior to the field reconnaissance, detailed descriptions of each protected species or communities listed within the Property were obtained from publicly available sources and reviewed. Subsequently, the Property was traversed by foot to observe the existing conditions and types of habitat within the Property which could support protected species. Preferred conditions were not anticipated due to the historical disturbance from agricultural practices, and vehicle storage area. 1.4.b) FINDINGS There are 66 federally listed species identified by the USFWS within North Carolina. Descriptions of the species listed in Table 2 is provided in Appendix D. Research was conducted into the potential and preferred habitat and documented populations of individual species listed in Table 2. The following is our findings:  Potential and/or preferred habitat was not observed on the Property. No bald eagles or golden eagles were observed during the field reconnaissance. No bald eagle nests or golden eagle nests were observed within 660 feet of the site fenced area. Based on our field reconnaissance and information reviewed, the development of the solar plant will not adversely affect bald or golden eagles, and is not likely to adversely affect or impact any of the threatened, endangered, and species of concern identified by the NC Natural Heritage Program, listed in Table 2. The IPaC tool was used to generate an official species list (the “List”), dated 3/6/2019. The List stated that there are no critical habitats at the Property. The following species are not included in Table 2 but are listed in the List: red-cockaded woodpecker, cape fear shiner, and harperella. None of the species on the List were observed during our field reconnaissance. Based upon the information reviewed and the field reconnaissance, the development of the solar plant on the Property is not likely to adversely affect or impact the species on the List. Descriptions of the species on the List is provided below: Red-cockaded woodpecker (Picoides borealis) Status: Endangered Description: The Red-cockaded Woodpecker (“RCW”) is a small bird measuring about seven inches in length. Identifiable by its white cheek patch and black and white barred back, the males have a few red feathers, or "cockade". These red feathers usually remain hidden underneath black feathers between the black crown and white cheek patch unless the male is disturbed or excited. Female RCWs lack the red cockade. Juvenile males have a red 'patch' in the center of their black crown. This patch disappears during the fall of their first year at which time their 'red-cockades' appear. Habitat: Red-cockaded Woodpecker habitat includes forests with trees old enough for roosting, generally at least 30-120 years old, or greater than 10 inches diameter at breast height, depending on species of pine. The most prominent adaptation of RCWs is their use of living pines for cavity excavation. For nesting and roosting habitat, red- cockaded woodpeckers prefer open stands of pine containing trees greater than 30 years old. RCWs need live, large older pines to excavate their cavities. Longleaf pines (Pinus palustrus) are preferred, but other species of southern pine are also acceptable. Dense stands with a thick hardwood under story are avoided. Foraging habitat is provided in pine and pine hardwood stands 30 years old or older with foraging preference for pine trees 10 inches or larger in diameter. An open under story with “meadow-like” characteristic is preferred by the red-cockaded woodpecker. In good, moderately-stocked, pine habitat, sufficient foraging substrate can be provided on 75 to 125 acres. Prescribed burning is the most efficient and ecologically beneficial method to accomplish hardwood mid-story control. There is no preferred habitat for the red- cockaded on the Property. Based upon the information reviewed and field reconnaissance, the construction and operation of the solar plant is not likely to adversely affect or impact the red- cockaded woodpecker. Cape fear shiner (Notropis mekistocholas) Status: Endangered Description: The Cape Fear shiner is a small (about 2 inches long), yellowish minnow with black bands along the sides of its body. The shiner’s fins are yellow and somewhat pointed. It has a black upper lip, and the lower lip bears a thin black bar along its margin. Habitat: The Cape Fear shiner is generally associated with gravel, cobble, and boulder substrates, and has been observed in slow pools, riffles, and slow runs, often with water willow. These areas occasionally support water willow, which may be used as cover or protection from predators (e.g. flathead catfish, bass and crappie). The Cape Fear shiner can be found swimming in schools of other minnow species but is never the most abundant species. During the spawning season, May through July, adult shiners move to slower flowing pools to lay eggs on the rocky substrate. Juveniles are often found in slack water, among large rock outcrops of the midstream, and in flooded side channels and pools. Cape Fear shiners are sexually mature after their first year, and are known to live up to nine years in captivity. Conclusion: The cape fear shiner was not observed was not observed during our field reconnaissance. There is no suitable habitat for the Cape Fear shiner on the Property.. Based upon the information reviewed and field reconnaissance, the construction and operation of the solar plant is not likely to adversely affect or impact the cape fear shiner. Its flowers are similar in appearance to those of the common roadside plant, Queen Anne's lace. They are small, white, and delicate and are arranged in clusters called umbels. This plant flowers in May and June. Both harperella and Queen Anne's lace are members of the carrot family, where our cultivated carrot comes from. Habitat: Harperella grows in wet soil near a body of water and can survive periodic, moderate flooding. In West Virginia harperella grows in rocky or gravelly beds along three clear, swiftly-flowing streams, namely, Sleepy Creek and the Cacapon and Potomac rivers in Morgan County. When these plants are knocked over or uprooted by high water, they can grow new roots from nodes in their stems. Outside of the state harperella also grows in shallow, intermittently-flooded coastal plain ponds. In addition to West Virginia, it is known from Alabama, Georgia, North Carolina, South Carolina and Maryland. Conclusion: The Harperella was not observed was not observed during our field reconnaissance. There is no suitable habitat for the harperella on the Property. Based upon the information reviewed and field reconnaissance, the construction and operation of the solar plant is not likely to adversely affect or impact the harperella. 1.5 HISTORIC/CULTURAL RESOURCES SURVEY 1.5.a) METHODOLOGY The purpose of the historic/cultural resources survey was to identify existing structures or the presence of other facilities of historical or cultural value within the Property. According to the National Register of Historic Places, 13 historic resources are registered with the State in the vicinity of Sanford existing within a 10-mile radius (Table 3). Registered historic resources in the vicinity of Sanford are summarized in Table 3 below. No documented archeological sites were identified within the vicinity of the Property. This species possesses 42-52 lateral line scales. Breeding males have red fins. Occurs in flowing, sand-bottomed and gravel-bottomed pools and runs of headwaters, creeks, and small rivers Coppery Emerald (Somatochlora georgiana) The Coppery Emerald (Somatochlora georgiana) is a large insect of the order Odonata, sub-order Anisoptera (the dragonflies), and family Corduliidae (the emeralds). Emeralds of the genus Somatochlora are generally large, dark dragonflies with at least some iridescent green coloration, brilliant green eyes in the mature adults (brown in young individuals (, and moderate pubescence (hariness), especially ont he thorax (section behind the head). The Coppery Emerald is distinctive among the Somatochlora in completely lacking the usual metallic coloration of the face, thorax and abdomen (section behind the thorax), and in the lack of green eyes, even in mature adults. The face and back of the head are pale brown in coloration, lighter on the face than on the back of the head. The large eyesm which meet at a seam on the top of th head, are chestnut-colored. The thorax is dull brown with two yellowish white stripes on each side of the thorax, which may become obscure with age. The slender, cylindrical abdomen is brownish yellow, darkening towards the tip to a reddish brown. In Massahusetts, the Coppery Emerald has been found breeding in a small, sluggish, stream through a White Cedar (Chamaecyparis thyoides) swamp. However, it more often has been encountered away from breeding sites in open habitats, such as forest clearings and dirt roads, feeding in swarms with other Somatochlora and darners of the genus Aeshna. Bog Spicebush (Lindera subcoriacea) Bog spicebush is a rare, recently described, multi- stemmed, deciduous shrub to 4 meters tall. The bark is brownish-gray with numerous short, whitish lenticels. The relatively slender leaves are broader towards the rounded tip, bluish-green above, and very pale green and short hairy beneath. The leaves are somewhat leathery in texture (subcoriaceous) and appear after flowering. Tiny yellow-green flowers (males on one plant and females on another) are produced in clusters of 3 to 4 at the ends of distinct paired stalks originating from last year’s bud scars. Bog spicebush inhabits permanently moist to wet, shrub- dominated seepage wetlands, open, quaking bogs in pinelands, shrub thickets of seepages, usually near the heads of streams where peatmoss is abundant and along the banks of small braided streams. In the Deep South, it is usually not found outside of the wettest portions of rare sphagnous bog habitats. It is found on very acid soils that are high in organic matter and permanently saturated.
