Director Division of Water Quality February 19, 2007 DWQ Project # 07-0001 Wake County Page 1 of 2 CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Ross Lampe 235 Market Street Smithfield, NC 27577 Lot 31 in the Carriage Hills Subdivision, Raleigh, NC UT to Crabtree Creek [030402, 27-33-(10), C, NSW, 303d] REQUEST FOR MORE INFORMATION Dear Mr. Lampe: On December 28 2006, the Division of Water Quality (DWQ) 401 Oversight/Express Permitting Unit received your minor variance application dated December 28, 2006, regarding your request for a Minor Variance from the Neuse Buffer Rules (15A NCAC 2B .0233) for the subject property. The DWQ is required to prepare a "preliminary finding" /"finding of fact" as to whether the variance request meets the requirements of 15A NCAC 02B .0233(9)(a). The DWQ may attach conditions to a variance approval that support the purpose, spirit and intent of the riparian buffer protection program. Conditions usually include stormwater management and buffer mitigation. Additional information will be required before we can proceed with the review of your variance request. Therefore, unless additional information is provided as described below, we will have to move toward denial of your request per 15A NCAC 2B .0233 and will place this project on hold as incomplete until we receive this additional information. Additional Information Requested: Please show topographic lines on the plans for the grassed swale and level spreader. This information will show that appropriate slopes are in place for the level spreaders to function appropriately. 2. The designs are based on the assumption that no flow is entering the lot from surrounding areas, such as the adjacent cul-de-sac and lot 30. Please show where the drainage from these areas is being directed. 3. Please check your C value for the designs. It appears that when the footprint of the driveway is considered, the portion of the lot being treated by the proposed grassed swale and level spreader will be significantly greater than 30 percent impervious. 4. Please provide a photograph of the buffer area adjacent to the proposed level spreader so that DWQ staff may see and evaluate the ground cover. Earthen level spreaders have proven to fail consistently in the field. Because of this documented failure, DWQ cannot permit these devices for diffuse flow. Please provide applicable worksheets to reflect your level spreader change. Please respond in writing within three weeks of the date of this letter by sending a copy of this information to me and to Mike Horan of the DWQ Raleigh Regional Office. If we do not hear from you in writing within three weeks, we will assume that you no longer want to pursue your variance request and we will consider the request as withdrawn.
