As I mentioned to you earlier, I have been in touch with the U.S. Army Corps of Engineers. Please see
their e-mail below. They have determined that the pond at this property is not under USACE
jurisdiction.

I reviewed the GIS forjurisdictional features as you requested. The property does not contain waters or
wetlands that are under the jurisdiction of the USACE. Please note that the NC DWQ may regulate
isolated waters or buffers that may be present. I suggest you coordinate with State and local
governments to confirm your proposed fill will be allowed.
