Subject: Rocky River Gravity Sewer
Dear Mr. Justice:
The Division of Water Quality (DWQ) received your application fora 401 Water Quality Certification for the
subject project on January 29, 2007. Mr. Alan Johnson of this office has reviewed the application, and based
on his review, the following information/comments are needed:
The submitted application does not adequately address cumulative impact analysis (15A NCAC 2H
.0506(b)(4) and (c)(4)). It appears that construction of the new sewer line may result in additional development
within several parcels. Development of these parcels may impact additional streams/wetlands, and may cause
violations of downstream water quality standards. The cumulative impacts for this project must be adequately
addressed.
One way to address this matter is to request that the Town of Mooresville require on-site stormwater
management measures (such as level spreaders, wet ponds, bioretention ponds, or constructed wetlands) for
those parcels when they are developed to meet state requirements. The Division is also open to other
approaches that would protect downstream water quality from cumulative impacts.
Pursuant to 15A NCAC 2H .0507(h) this project will be put on hold until such time as the requested
information has been received. In addition, this office is requesting that the Army Corps of Engineers withhold
processing the 404 permit until the requested information is provided.
A written response should be submitted to this Office by April 15, 2007 addressing the above noted issue.
Failure to provide the requested information by the aforementioned date may result in the application being
