Is the existing bulkhead failing or is there another reason for the new bulkhead? I didn't see an explanation in the cover
letter -just that the developers decided they want to install a new bulkhead. Also, I need to know the cubic yardage of
the proposed fill to be placed water ward of the existing bulkhead. Another question that comes to mind, is what about
all of the existing docks along this property? Will they be removed? I didn't see any discussion about that either. Seems
like with the redevelopment they would be thinking about the docking facility as well.

Please find correspondence enclosed dated received by DCM on 1/31/19 from Mrs. Ginger Turner with The
Cullipher Group, requesting a permit modification. Express State Permit No. 123-18 was issued on
11/16/2018 for upland re -development, at 403 Old Causeway Road, Carteret County. The permit expires
on 12/31/2021.
The applicant is requesting to redesign the previously permitted upland re -development and to add a new
bulkhead and 6' wide boardwalk at 403 Old Causeway Road.
A processing fee of $100 was received on 1/31/2019, #2296.

Please accept the enclosed package for consideration of a minor modification to LAMA Major
12318. Included is an updated drawingset reflecting �
ting the revisions requested. Upon review of the sit
plan by the Town of Atlantic Beach, it was broughte
to our attention that the proposed building
separations did not meet the ordinance requirement
and resulted in q of fifteen feet. The site plan had to be revised
losing a building along Bogue Sound. This reduced the number of units to eighteen
(nine buildings) and a density of 7.89 units
per acre.
The four buildings along the canal are now proposed can be met to avoid losi p posed four feet narrower so that the separation
ng another building. The porches on the fronts of all
buildings now extend the
full width. Pervious pavement driveways are still proposed for buildings 1-7 and treat the fron

Authorizing development in. Carteret County at Bogue Sound, 403 Old Causeway Road, Atlantic Beach, as
requested in the permittee's attached application dated 10/04/18, including workplan drawings (7), all dated
10/09/18.
This permit, issued on November 16, 2018 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these
terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Upland Re -Development
1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing
activities associated with the re -development of the above referenced property, including the
homesites, driveways, and other associated infrastructure, all as expressly and specifically set forth in
the attached permit application and workplan drawings. Any other work or development proposed in
an Area of Environmental Concern (AEC), including but not limited to the Coastal and Estuarine
Shoreline AECs and located within the applicant's property, shall require a review and authorization
from the Division of Coastal Management prior to work commencing.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2021
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

2) This permit does not authorize any new impervious surfaces within 30 feet of the normal high water
line.
Stormwater Mannement
3) In order to protect water quality, runoff from the construction must not visibly increase the amount of
suspended sediments in adjacent waters.
4) The Division of Energy, Mineral and Land Resources (DEMLR) approval of this project under
stormwater management rules of the Environmental Management Commission is covered by way of
Stormwater Permit No. SW8 181001, which was issued on 10/23/18. Any violation of the permit
approved by the DEMLR will be considered a violation of this CAMA permit.
Sedimentation and Erosion Control
NOTE: An Erosion and Sedimentation Control Plan maybe required for this project. If required, this
plan must be filed at least thirty (3 0) days prior to the beginning of any land disturbing activity.
Submit this plan to the Department of Environmental Quality, Land Quality Section, 127
Cardinal Drive Extension, Wilmington, NC 28405.
5) Aground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes.
General
6) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
7) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
8) This permit does not authorize the excavation or filling of any vegetated wetlands or open water areas.
9) No development activities authorized under this permit shall take place until documentation of the
completion of the purchase of the property by the permittee is provided to DCM.
10) Should the permittee's Offer to Purchase contract be terminated or should the purchase of the property
by the permittee otherwise not take place, this permit shall be revoked unless this permit is legally
transferred in accordance with Title 15A NCAC 07J .0406.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.

SAW -2018-02052.
NOTE: The N.C. Division of Water Resources determined the proposed project did not involve open
water development or non -coastal wetlands therefore did not require General Water Quality
Certification and assigned the project DWR Project No. 2018-1475.
NOTE: Any change or changes in the plans for development, construction, or land use activities will
require a re-evaluation and modification of this permit. Contact a representative of the Division at
(252) 808-2808 prior to the commencement of any such activity for this determination. The
permittee is further advised that many non -water dependent activities are not authorized within 30
feet of the normal high water line.
