The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetland, streams and/or buffers on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and 2B .0233(8) and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project.- Additional Information Requested: 1. Wayne County Planning - You stated within your letter that "the (Wayne County) planning board approved the plan subject to Heron Drive being extended to cross the ditch IF SAID CROSSING WOULD BE APPROVED BY THE N. C.D.E.N.R. " You went on to request that "Heron Drive not be extended due to the projected cost of construction and more importantly due to the negative environmental impact caused by crossing the ditch at a point that has a 20 feet depth. " It is not clear to the DWQ at this time why the surface water and protected buffers will need to be impacted. A letter from Wayne County Planning clearly stating the need for the extension of Heron Drive will be helpful in our review. If the reason is for safety purposes because the proposed development will add 44 residential lots with a single entrance and exit road (Heron Drive), then Wayne County A %* N. C. Please attach Wayne County's letter to your PCN application if you decide to pursue this project. 2. PCN Application - Please note that if you choose to pursue your request for written authorization to use a General Water Quality Certification to pipe the stream and Authorization Certificate to impact the protected riparian buffers, then you will need to complete a Pre-Construction Notification (PCN) form and submit the original and six copies (including any required application fees) to this office for our review. You may obtain a copy of the PCN form from our website at http://h2o.enr.state.nc.us/newetlands/pcn.html or we can mail you a copy. 3. Written Authorization- Please note that written authorization from the DWQ Wetlands/401 Unit is not required if the impacts are kept below 40 linear feet of stream and buffer (measured parallel to the stream). If the impacts exceed 40 feet, then you must submit the required PCN as stated in Item No. 2 above. Please respond within three weeks of the date of this letter by sending this information to me in writing and Tom Steffens of the DWQ Washington Regional Office. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Per request, I am submitting the preliminary plan of Heron Creek and Addition to Woodcroft Subdivision Section-9. The plan depicts no crossing at the ditch having a 50-feet riparian buffer from the bank on each side of the ditch. This plan was presented to the Wayne County Planning Board on May 11, 2004. The map labeled as Map One was presented to the Planning Board for approval. The Planning Board delayed approval contingent upon a street connection being installed between Heron Creek and Woodcroft subdivisions. Map Two shows a riparian buffer crossing with an extension Heron Drive to Johnson Branch Road. This is the route preferred by the Planning Board. The surveyor shows a crossing with a right of way of sixty feet. It is our understanding this would require a written authorization from the Division. However, the crossing may be reduced to forty feet. This would meet the minimum requirements for the Department of Transportation, be exempt from the requirements of the Neuse Buffer Rule and be satisfactory to the Wayne County Planning Board. I am including a map of the area showing the existing street network and the proposed streets. The existing streets are part of Woodcroft and Heron Creek Subdivisions. Both subdivisions are along the north side of Wayne Memorial Drive in Wayne County and contain a total of 285 lots. The proposed additions to Woodcroft and Heron Creek subdivisions would add another 88 lots. The existing street plan includes a network of interconnecting streets in each subdivision, but does not have a connection between the two subdivisions. All vehicular and pedestrian traffic must enter onto Wayne Memorial Drive to go from one neighborhood to the other. The Wayne County Planning Board previously required the developer of Woodcroft subdivision to leave a stub out to property now being developed as Heron Creek. The Planning Board is requiring the developer of Heron Creed to build the street connection between the two subdivisions. The only stipulation for the type of street is that it be built to NC Department of Transportation standards. The street will not be a collector street. Therefore the minimum right of way width for a local residential street is forty feet. It is our understanding of the Neuse Buffer rules that a riparian buffer crossing of forty linear feet or less of stream is exempt from the rules. A right of way greater than forty feet up to 150 feet is allowable provide written authorization is received from the Division. If you need additional information please let me know.
