Dear Mr. McIntyre,
The Division of Water Resources (DWR) received a draft Bank Parcel Development Package (BPDP)
for the Hollowell Mitigation Site (Site) in 2019, for review and approval under the terms and conditions
of the Water & Land Solutions, LLC (WLS) Hollowell Mitigation Banking Instrument for Riparian
Buffer Mitigation and Nutrient Offsets (MBI) received on February 11, 2019. The MBI is made and
entered into by WLS acting as the Bank Sponsor, and the DWR. Katie Merritt, with DWR, reviewed
the BPDP and MBI documents and provided comments and recommendations. DWR received a
revised BPDP and MBI that addressed all comments and recommendations provided by Ms. Merritt.

The closing date for the public notice was April 2, 2019. DWR received no comments regarding the
subject BPDP or MBI documents. These documents are approved. A hard copy of the final draft of
the BPDP is now required for our files as soon as possible.
According to the credit release schedule outlined in your MBI, the following items are required prior
to receiving your first credit release of twenty percent (20%):
• Conservation easement approved by DWR
• Financial Assurance documents if applicable
