Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion, so long as the property is clearly defined. For administrative and distribution purposes, the USACE requires information to be submitted on sheets no larger than 1 1 by 17-inch format; however, DWQ may accept paperwork of any size. DWQ prefers full-size construction drawings rather than a sequential sheet version of the full-size plans. If full-size plans are reduced to a small scale such that the final version is illegible, the applicant will be informed that the project has been placed on hold until decipherable maps are provided. 1. Some filling of 404 wetlands will be required in order to implement the proposed plan for the construction of roads (NW 14) and buildings (NW 18). General earth moving equipment such as dozers, excavators, dump trucks and compactors will be used to construct the development. 11. Explain the purpose of the proposed work: The purpose of the proposed work is to construct roads and building pads associated with the development of the p roposed townhouse development. IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The project density is required to make this project economically feasible given the topographical constraints. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial - streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when Page 9 of 9 necessary to ensure that adverse effects to the aquatic. environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.ne.us/ncwetlands/strmgide.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at (919) 733-5208 to determine availability and to request written approval of mitigation prior to submittal of a PCN. The blue line stream with buffers have been shown on the map as delineated by the Division of Water Quality personnel. I have also attached the compliance sheet from DWQ. There are no impacts or land disturbance within the buffers. B. There are no buffer impacts other than the surface discharge of stormwater as shown on the site plan. C. The proposed building locations are shown on the site plan. D. The protected buffers are shown on the site plan. E. The proposed sewer mains are shown on the site plan. F. The proposed stormwater management elements are shown on the site plan. G. I have attached a drawing indicating the concept to be used for the stormwater treatment. As suggested, we have tried to reconfigure lots 13-17 and find that it is not possible without complete elimination of these units as designed. Due to the geographic location and land cost, elimination of that many units would make this project not cost effective. We have however; eliminated two units to reduce the impact on wetland area #1. The total units have been reduced from 43 to 41. In addition, it is the Owners desire upon receiving approval of this request to provide a conservation easement over the remaining wetlands on the site. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will'-require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H.0506 and will place this project on hold as incomplete until we receive this additional information. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. PROJECT NARRATIVE The Pearl Golf Links And Planned Secure Resort Living Community Brunswick County, NC INTRODUCTION The existing Pearl Golf Links contains two 18-hole courses located on the south side of Calabash Road in southeastern Brunswick County, North Carolina. (Figures 1 and 2). The Pearl site containing 881.82 acres is currently owned by DeCarol Williamson Enterprises. DeCarol Williamson Enterprises desires to build out the Pearl site as was originally planned when the course was constructed in 1987. This expansion will include a hotel, dining areas, tennis clubs, a bed and breakfast and 273 buildings containing 4,095 condominium units. The proposed development areas are undeveloped and either wooded or cleared and mowed at this time. The project area is located within the Lumber River Basin. EXISTING CONDITIONS The Pearl Golf Links is located at the eastern end of Brunswick County. Take highway 17 South from Wilmington. At Grissettown, turn left onto NC Highway 904 heading south. Turn right onto Old Georgetown Road heading west. The Pearl is located approximately three miles on the left. The site drains into the Calabash River, which ultimately drains into the Atlantic Ocean via the Little River Inlet. The project area is composed of 881.826 acres. Of this 75.7 acres is located below mean high water and 806.1 acres is situated above mean high water. The site is bordered by the Calabash River on the south. In the vicinity of the project, the Calabash River is classified by the N.C. Division of Water Quality as a Class SA Tidal Salt water, with a best use of aquatic life propagation, commercial shellfish harvesting, and primary recreation activities, such as swimming. All SA waters are also considered to have a supplemental classification of High Quality Waters (HQW). High Quality Waters and SA waters are afforded increased protection by State erosion and sedimentation control rules and by State stormwater control rules. The site is not listed as an Outstanding Resource Water (ORW) as defined by the North Carolina Division of Coastal Management (DCM)._This area of the Calabash River is listed as a Primary Nursery Area as defined by DCM. According to the Brunswick County Generalized Soil Survey, soils on the site are shown as Leon, Murville and Mandarin soil series on the northern section of the property. Kureb, Blanton and Pactolus soils are shown in upland areas on the middle and southern sections of the property. Hydric soils shown on the site are Leon and Murville. Surrounding land use currently consists of residential properties to the east and west. Residential uses are also observed to the south across the Calabash River. Land to the north across Georgetown Road is currently undeveloped at this time. The two existing 18-hole golf courses and the existing clubhouse were constructed in 1987. The remainder of the subject property has been undeveloped since that time. No wetland fill permits have been requested on the property in the past. A site delineation of 404 wetlands and Waters of the U.S. were performed in 2002 and has been approved by the COE. The site contains a total of 37.06 acres of 404 wetlands. Stormwater runoff from the site is captured in existing lakes and ponds across the site. These pond levels are controlled by golf course maintenance and irrigation water for the site is obtained from these bodies of water. PROJECT DESIGN AND OBJECTIVES The purpose of the proposed work will be to transform the undeveloped areas around the golf course into a residential neighborhood and expand the golfing amenities to serve a growing Brunswick County permanent and seasonal population. The project will include a hotel, dining areas, tennis clubs, a bed and breakfast, 273 buildings containing 4,095 condominium units, and associated roadways and parking areas. The enclosed site plan contains all future development proposed for the property. Construction of the proposed development will be phased and this phasing will be based upon market need. The proposed site plan has been presented to obtain all necessary permitting for future needs of the development. Proposed development has met NC DENR stormwater criteria and impervious area for the site will be under the 25% maximum. POTENTIAL ENVIRONMENTAL IMPACTS Great care was taken in the planning stages of this development to minimize wetland impacts and to create a low density and low impervious cover ratio for the project. After the initial plans were created, LMG consulted with the project engineer and reduced the project wetland impacts by 1/3 acre. This process involved moving roadways and parking lots to minimize the-wetland impacts. Through careful site design, proposed impacts are 0.9118 acre of 404 wetlands and 0.7984 acre of Waters of the U.S. Please see the attached figures and Tables 1 and 2 for details. 2 THE PROPOSED WETLANDS MITIGATION To mitigate for the 404 wetlands and Waters of the U.S. impacts, the applicant proposes to create wetlands and ponds throughout the site. A total of 12.85 acres of ponds will be created within the golf course to offset impacts to 0.7984 acre of Waters of the U.S (Table 3). This is a 39:1 ratio and far exceeds regulatory mitigation ratio guidelines. A drained hydric soil area currently classified as uplands is being examined for the possibility of restoring hydrology and vegetative components to approximately 2.5 acres and will be planted with native, herbaceous wetland vegetation. Wetland mitigation will occur at a 2:1 creation to impact ratio.
