We are requesting written concurrence from the United States Army Corps of Engineers (COE) and the North Carolina Division of Water Quality (DWQ) that the activities proposed below may precede utilizing Nationwide Permit 39. We are requesting to place culverts, headwalls, and dissipaters in 100 linear feet of intermittent stream for the purpose of building Cobblestone Way. 13 (formerly 15) low-density homesites are also proposed for this subdivision. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Please provide documentation indicating how you determined the stream proposed for impact to be intermittent. This determination must be made by the DWQ. 2. Please clearly show all proposed dissipaters on the site plan. 3. Please clearly indicate all buffer impacts on the site plan. 4. Please contact the DWQ within three weeks of the date of this letter to verify that you have received this letter and that you remain interested in continuing to pursue permitting of your project and will be providing the DWQ the requested information at a later date. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. We are requesting for NC Division of Water Quality (NCDWQ) written approval under Section 401, Clean Water Act, 33 USC 1344. This will assist in compliance with Water Quality Certification (WQC) 3404 and it's accompanying Nationwide Permit (NWP) 14. We have addressed your included written comments in the following paragraphs. 1. Please provide documentation indicating how you determined the stream proposed for impact to be intermittent. This determination must be made by DWQ. For planning purposes, the UT to Little River will be considered a perennial stream. 2. Please clearly show all proposed dissipaters on the site plan.
