We wrote to you on June 26, 2004 discussing concerns that we have regarding the design of the project and stating that it would be placed on hold for three weeks giving you time to address DWQ's concerns. As of today, DWQ has not received a response to this request. Therefore, your file is hereby considered withdrawn and will not be reviewed until DWQ's earlier concerns are addressed. Once you have collected sufficient information to have a complete application (please see our June 26, 2004 letter for the missing information), you will need to reapply for DWQ approval. This includes submitting a complete application package with the appropriate fee. Please be aware that you have no authorization under Section 401 of the Clear Water Act for this activity and any work done within waters of the state would be a violation of North Carolina General Statutes and Administrative Code. In Olde Point Subdivision DWQ Project # 04-0928 Pender County Dear Mr. and Mrs. Verardi: This Office has reviewed your Pre Construction Notification application and is placing your project on hold until we receive the following additional information: 1. Please clearly explain why the proposed driveway cannot be placed on the western side of Lot 159 (location of high ground, see attached drawing), with a shorter driveway to the high ground portion on the back of the lot; 2. Please send a copy of the signed wetland jurisdictional determination for the property (this may have been done under the Subdivision name, but we need a valid map); 3. Please show the roads and house foot print to scale (road scales out to be approx 6 feet wide); 4. Please explain the 50' setback at the rear of the property. The house footprint could be pushed back to avoid additional impacts to wetlands; 5. Please include a profile view of the pipes and pipe sizes that will be required by DWQ to be placed in the proposed driveway through wetlands to keep the wetlands connected; 6. Please include a profile and cross sectional view of the road crossing (all wetland impacts for the road crossing must include the necessary side slopes to prevent any additional wetland impacts); 7. Please include a copy of the restrictive covenants or deed restrictions that will protect the remaining wetlands on the property from additional impacts.
