Preston Howard Jr., P.E., Director December 4, 1996 Mr. Mark Keyzer Rt. 2 Box 133 Pantego, NC 27860 Subject: Notice of Recommendation of Enforcement Mark Keyzer Farms Facility No. 07-53 Beaufort County Dear Mr. Keyzer: wpcu This letter is to notify you that the Washington Regional Office of the Division of Water Quality is considering sending a recommendation for enforcement action to the Director of the Division of Water Quality. The recommendation concerns the violation of North Carolina General Statute 143-215.1(a)(1) for discharging animal waste in waters of the State without a permit. The Mark Keyzer Dairy Farm is located on SR 1616 in Beaufort County. An Inspection of the farm was conducted by Carl Dunn of the Washington Regional Office on December 3, 1996. Animal waste was observed discharging from a concrete waste collection pit via a manmade ditch into a farm drainage ditch. The farm drainage ditch discharges to the Broad Creek Canal which is classified as C Sw NSW waters of the State. The discharge from the concrete waste pit should be stopped immediately by permanently filling all or part of the manmade ditch such that waste may no longer Bow into the farm drainage ditch. If you have an explanation for this violation that you wish to present, please respond in writing to the Washington Regional Office within ten (10) days after receipt of this Notice. This letter is in response to the Notice of Recommendation of Enforcement I received from your office concerning my dairy operation (facility no. 07-53). On December 4, after my discussion with Carl Dunn, I immediately filled in the ditch behind the waste storage structure. I also purchased and installed a chopper/agitator to break the hardened materials at the top of my slurry pit, and I transferred the excess waste into the storage tank. These temporary measures should eliminate any future .discharges. Over 18 months ago, I requested cost sharing and technical assistance from the Beaufort Soil and Water Conservation District so I could certify my operation. Just prior to Mr. Dunn's inspection, Rodney Woolard and Claude Long with the Natural Resources Conservation Service, and Fat Hooper with the Division of Soil and Water Conservation did an initial evaluation of my farm, I plan to work with these folks to make things right by following recommendations to correct any waste problems on the site. Evtn if I receive cost sharing, I will personally have to make a considerable investment to continue operating which will put a financial hardship on me. An additional fine from your office would only jeopardize this dairy which has been in my family for 200 years.
