Barnhill Topping 1 Permit No. AWS710029 Pender County Response to Violation 1: Immediately following discovery of the runoff at the J.K. Barnhill Topping 1 farm dirt was added to the ditch in order to stop the flow of wastewater from the spray Field to the tributary. In an effort to eliminate any possible recurrcncc of this issue we have been working to properly aerate the land to avoid ponding and runoff during irrigation as well as more thoroughly maintaining the grassed areas. We have also been in contact with the Soil and Water Conservation Division proposing the construction of Slam Ditches which will allow the ditch to be closed off if ever a discharge occurs. We propose to have these in place by the end of December 2017. Response to Violation 2: In reference to this violation, aeration of the application field will assist in deterring any future ponding or discharge. Going forward, we will also be shortening our land application rates in order to give the wastewater adequate time to be absorbed by the land. Barnhill Topping 1 Permit No. AWS710029 Ponder County Dear Mr. Barnhill: On September 28,2017, staff from the Wilmington Regional Office (WIRO) of the Division of Water Resources (DWR) visited and inspected the permitted waste management system of the J. K. Barnhill Topping 1 in response to a complaint. We appreciate Mr. Barnhill being present and assisting us with the inspection. You are hereby notified that, having been permitted to have a non -discharge permit for the subject animal waste management system pursuant to 15A NCAC 2T .1304, you have been found to be in violation of your Certified Animal Waste Management Plan (CAWMP) and the Swine Waste System General Permit No. AWG100000 as follows: Violation l: Failure in prohibiting a discharge to surface waters of the State in accordance with Condition L..I of the Swine Waste System General Permit No. AWG 100000. Any discharge of waste that reaches surface waters or wetlands is prohibited except otherwise provided in this General Permit and associated statutory and ?, regulatory provisions. Waste shall not reach surface waters or wetlands by runoff, drift, manmade conveyance, direct application, and direct discharge or through ditches, terraces, or grassed waterways not otherwise classified as state waters. During inspection, the land application field had animal waste ponded and it was determined to be the source of the discharge into the tributary of Big Branch. Required Corrective Action for Violations: Please provide to our office, a description of the corrective action(s) you will take or have taken to resolve this issue. You may wish to contact your County Soil & Water Conservation District Office, County Extension office, a qualified technical specialist, and/or a professional engineer for any assistance they may be able to provide you in order to prevent violations from occurring. Be advised that this office is considering recommending assessment of civil penalties to the Director of the Division of Water Quality for the above noted violations. These violations may result in civil penalties of up to $25,000 per violation in accordance with North Carolina General Statute 143- 215.6A(a)(2). You may also be assessed for reasonable costs of the investigation in accordance with North Carolina General Statute 143-215.3(a)(9). Your response will be forwarded to the Director along with the enforcement package for his consideration. Be advised that the Division of Water Quality may take further action in this matter including injunctive relief and permit revocation. If you wish to provide additional information regarding the noted violation, request technical assistance, or discuss overall compliance please respond in writing within ten (10) business days after receipt of this Notice. A review of your response will be considered and you will then be notified of any civil penalties that may be assessed regarding the violations. If no response is received -in this Office within the 10- day period, a civil penalty assessment may be prepared. Please include in your response all corrective actions already taken and a schedule for completion of any corrective actions not addressed. The discharge occurred on September 27, 2017 around 3prn. The. untreated wastewater entered a drainage ditch that flows to Big .Branch Stream in the Cape Fear River Basin. Upon notification immediate action was taken to contain the runoff. In an effort to eliminate any possibility of future discharges, no irrigation will occur until the land has been properly assessed and reformed. As you may be aware, the farm's waste application records were maintained in the farm office building. Early in the morning Mr. Barnhill's employee discovered and notified Mr. Barnhill that someone had broken into the building by forcing the door open, and had taken some of the farm tools. A further investigation by Mr. Barnhill revealed that the composition book in which Mr. Barnhill made his handwritten notes of the waste application dates, times, and pulls/fields, which he then regularly kept on the desk, was also missing. Mr. Barnhill's practice was to periodically provide a copy of the handwritten notations to Mr. William Burke, who used the provided data to calculate the final waste application records produce waste application records in the required form. Those calculated printed pages of waste application records were also maintained in the composition book that was taken. Mr. Barnhill has asked Mr. Burke to provide him with copies of all of his waste application records, and will maintain a copies of those records, along with his handwritten notations, both in his farm office and his home to assure their immediate availability in the future. Mr. Barnhill has advised me that he is at a loss as to why someone who wanted to steal tools, would also take the book containing the waste application records, other than the fact that the composition book was always kept in a conspicuous place on the desk. Violation 2: 1 Failure to notify the appropriate Division Regional Office as soon as possible, but in no case more than twenty-four (24) hours following first knowledge of the failure of the waste treatment and disposal system that renders the facility incapable of adequately receiving, treating, or storing the waste and/or sludge, required in accordance with Condition III. 13 of the Swine ,Waste System General Permit No. AWG 100000. I am in the process of obtaining those records and will send them within a few days to add to this response. Had we known that the level was reportable, we would have reported it to you, as well as to Smithfield, which we are required to do for both you and Smithfield.. As to the ponding observed by your representative on March 3, 2016, attached is a copy of our spray records on March 1, 2016. As you can see, we sprayed the field in question for a very short period of time, and had no ponding then. Also attached is a copy of our rainfall recordings, showing 4/1 Oth of an inch on March 1, which occurred after we sprayed, and again 1 and 1/10 of an inch of rainfall on March 3, 2016, which occurred before your inspection. The ponding was the result of the rainfall, not spraying waste, because no spraying had occurred in that field since March 1, 2016. Also, I would like to point out that although the pond you observed in that field at that location was there, there was no other ponding in the area of the field that had been sprayed, which indicates that the ponding was the result of excessive rainfall, not waste spraying. I would also like to point out that since you indicated someone had notified you that my traveler had stopped, I had someone in the immediate area of the spraying at all times, and it did not stop. K. Barnhill Topping 1 Farm and the permitted waste management system. We wish to thank Mr. Barnhill for being present and assisting us during the inspection. As a result of this inspection, you are hereby notified that, having been permitted to have a non -discharge permit for the subject animal waste management system pursuant to 15A NCAC 2T .1304, you have been found to be in violation of your Certified Animal Waste Management Plan (CAWMP) and the Swine Waste System General Permit No. AWG 100000 as follows: Violation 1: Failure in maintaining land application rates that shall not result in excessive ponding or runoff during any given application event in accordance with Condition I1. 5 of the Swine Waste System General Permit No. AWG 100000. On March 3, 2016, staff from DWR received a referral from Martin Mclawhorn with the North Carolina Department of Agriculture and Consumer Services. DWR staff inspected the land application field and observed animal waste ponding on the field. Violation 2: Failure to notify the appropriate Division Regional Office as soon as possible, but in no case more than twenty-four (24) hours following first knowledge of the failure of the waste treatment and disposal system that renders the facility incapable of adequately receiving, treating, or storing the waste and/or sludge, required in accordance with Condition Ill. I3 of the Swine Waste System General Permit No. AWG 100000. Personnel at the DWR office did not receive any notification from Permittee. It was also noted during the inspection that your General Permit was not readily available, this is a deficiency of Part I Performance Standards, Section 5 of the General Permit, which requires a copy of the General Permit, Certificate of Coverage, certification forms, lessee and landowner agreements, and the CAWMP to be readily available at the farm (stored at places such as the farm residence, office, outbuildings, etc.) where animal waste management activities are being conducted for the life of this permit. These documents shall be kept in good condition and records shall be maintained in an orderly fashion. Also, debris in your lagoons was observed during the inspection, this is a deficiency of Part II Operation and Maintenance Requirements, Section 12, which requiresthat lagoons/storage ponds be kept free of foreign debris including, but not limited to, tires, bottles, light bulbs, gloves, syringes or any other solid waste. Your CAWMP should be revised so that it matches your irrigation design completed on April 19, 1999. A new aerial map of your farm should be attached to farm records, your district office can also be of assistance with supplying this for you. These are components of your CAWMP and deficiencies of Part I Performance Standards, Section 2 which requires that the CAWMP be consistent with all applicable statutes, rules, and standards in effect at the time of siting, design and certification of the facility. It was also observed that spayfield, Pulls 7-14 need better drainage. I recommend adding drainage tile, or forming a waterway for better water diversion in the areas of the fields that hold water. Contact your local Soil and Water District office for assistance. Please submit a Plan of action to the Wilmington Regional Office of the Division of Water Quality which addresses the noted deficiencies. The Plan of Action should include a list of any and all modifications that have been and will be implemented to prevent future deficiencies along with a timetable for completion of the modifications. The proposed written plan of action must be received by this office within fifteen (15) days of the receipt of this notice. Upon approval and implementation of the plan, you must notify this office when the corrective actions are complete. Contact your Service Company, county Soil & Water district office, or county extension office for any assistance they may be able to provide. If the deficiencies are not corrected, the Division of Water Quality may issue a Notice of Violation and pursue additional actions including civil penalties, injunctive relief, or permit revocation.
