The information you provided us indicated that your operation's animal population does not exceed the number set forth by 15A NCAC 2H .0217, and therefore does not require registration for a certified animal waste management plan. Under 15A NCAC 2H .0217, your facility is deemed permitted if waste is properly managed and does not reach the surface waters of the state. Any system determined to have an adverse impact on water quality may be required to obtain a waste management plan or an individual permit. You are reminded that a discharge of wastes to the surface waters of the state will subject you to a civil penalty up to $25,000 per day. Should you decide to increase the number of animals housed at your facility beyond the threshold limits listed below, you will be required to receive approval from the Division of Water Quality prior to stocking animals to that level. Concerns on this plan include an annual excess of 370 pounds of PAN, the fact one of the lagoons had sludge up to the surface and only 60 days temporary storage. This plan was certified in August of 1996 and a copy was provided to the District November 1996. The District asked for lagoon volume documentation and pointed out the excess Nitrogen (N). Lenfestey responded with a reduction to 550 sows and a volume of 252,751 cubic feet for the two lagoons. On September 30, 1997, Lenfestey revised the plan to 585 sows and 90 days storage. This time he used the 0.67 CF/lb AALW without including the remaining revisions in the standard i.e., excess washwater, extra 25 year storm, etc. According to Onslow County SWCD calculations he does not have even the required treatment volume. This facility will not be considered certified until this plan is corrected and resubmitted to the Onslow County SWCD. In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers. Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to be kept on the appropriate recordkeeping forms (i.e. IRR1, IRR2, DRY1, DRY2, DRYS, SLUR1, SLUR2, SLD1, and SLD2) and maintained in the facility records for review. The Division of Water Quality (DWQ) compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an appropriate enforcement action. Your application form and inspection reports indicate that there are currently two lagoons at this facility. Please provide lagoon capacity documentation (design, as -built calculations, etc.) for the other lagoon at your facility. The lagoon information was sent for the one with a capacity of 252,751 cubic feet. Be sure to include any site evaluations, wetland determinations, or hazard classifications that may be applicable. 2. Your Waste Utilization Plan (WUP) was missing irrigation parameters. Irrigation events are to be listed in the WUP as the maximum application allowable for that soil type from the time the pumps are turned on until the time they are shut off. It is currently recommended that total application amounts not exceed one inch in any application event for any soil type. Please have your Technical Specialist add irrigation. parameters to your WUP. 3. An Operation and Maintenance Plan and an Emergency Action Plan were missing from your WUP. 4. The NRCS Required Specifications were missing from your WUP. 5. Best Management Practices (BMPs) that are to be implemented at this facility should be identified (check the appropriate BMPs) on the Insect Control Checklist and on the Odor Control Checklist. Also, please identify the appropriate mortality management method on the Mortality Management Checklist. 6. The WUP was not signed and dated by the facility owner or the technical specialist. 7. There is an acreage discrepancy between the WUP and the maps provided. Field 1 is listed as 8 acres in the WUP but is only shown as 7.54 acres on the map provided. Field 2 is shown as 4 acres in the WUP but appears to be 3.68 acres on the map. Please address these differences when providing additional information. Please note that all WUP revisions must be signed and dated by both the owner and the technical specialist. In recent correspondence with the permitting/ certification department of your division, we became aware that the 0200 certification of this farm, prepared by John Lenfestey, PE, was being questioned. The questions center around the apparent lack of volume in one or more of the lagoons on this farm. We, along with MRCS, have done volume checks of the lagoons in question, and found that there were errors made in Mr. Lenfestey's calculations, with actual volume being about 30% of his estimate. The lack of volume in these lagoons can lead to an increase rate of sludge accumulation. My experiences have shown that the analysis of the liquid in an undersized lagoon is about the same as a properly sized lagoon, and the analysis of this lagoon bears this out. In the Fall of 1998, Mr. Manning cleaned the sludge out of two of the lagoon structures on his farm using the pump and haul method. This required a substantial capital investment, but freed much of the storage available up for digestion. In addition, Mr. Manning recently began treating his lagoons with a product from Stewart Water Solutions that will increase the biological activity and reduce the rate of sludge buildup. We have done some limited testing of this product and believe it to be effective. The long range plan for this farm is to close it completely in five years. For this reason, I am requesting a meeting with you to discuss the possibility of entering into an agreement allowing this farm to operate, using this product, until it closes. I feel that this can be done without any problems. Please respond in writing with a date that fits in your schedule for a meeting at the farm to discuss this option. It was observed that your lagoons did not have sufficient freeboard. Further inspection revealed that the Certified Animal Waste Management Plan does not meet the requirements specified under 15A NCAC 2H .0217 and the USDA- NRCS Practice Standard for Waste Utilization Criteria, Code 633, (12), (15) and Waste Treatment Lagoon, Code 359. As I discussed with you during the inspection. The Waste Utilization Plan which this facility has been operating under does not meet the above mentioned requirements. A review of the nutrient balance for this facility indicates that the facility as designed produces more nitrogen than can be utilized by the present cropping plan. In addition, the secondary lagoon appears to have an inordinate build up of sludge severely limiting the treatment and storage volume of the structure. The Certified Animal Waste Management Plan must be revised. I would suggest utilizing all of the available acreage in your waste application rotation to meet the requirements. The excess sludge will need to be removed from the lagoon to regain the required capacity. USDA-NRCS guidelines require a minimum of one foot and seven inches of freeboard. Several factors are important in implementing your waste utilization plan in order to maximize the fertilizer value of the waste and to ensure that it is applied in an environmentally safe manner. Always apply waste based on the needs of the crop to be grown and the nutrient content of the waste. Do not apply more nitrogen than the crop can utilize. Soil types are important as they have different infiltration rates, leaching potentials, cation exchange capacities and available water holding capacities, Normally waste shall not be applied to land eroding at greater than 5 tons per acre per year. Do not apply waste on saturated soils, when it is raining, or when the surface is frozen. Either of these conditions may result in runoff to surface waters which is not ailowed under DEM regulations. Wind conditions, should also be considered to avoid drift and downwind odor problems. To maximize the value of nutrients for crop production and to reduce the potential for pollution, the waste should be applied to a growing crop or applied to bare ground not more than 30 days prior to planting. Injecting the waste or disking will conserve nutrients and reduce odor problems. The estimated acres needed to apply the animal waste is based on typical nutrient content for this type of facility. Narrative of operation: Cedar Grove Sow Farm Page 4 WASTE UTILIZATION PLAN REQUIRED SPECIFICATIONS Animal waste shall not reach surface waters of the State by runoff, drift, manmade conveyances, direct application, or direct discharge during operation or land application. Any discharge of waste which reaches surface water is prohibited. Illegal discharges are subject to the assessment of civil penalties of $10,000 per day by the Division of Environmental Management for every day the discharge continues. 2. The Field Office must have documentation in the design folder that the producer either owns or has long term access to adequate land on which to properly apply the waste. If the producer does not own adequate land to properly dispose of waste, he shall provide NRCS with a copy of the written agreement (sample enclosed) with a landowner who is within a reasonable proximity, allowing him/her the use of the land for waste application for the life expectancy of the production facility. It is the responsibility of the owner of the facility to secure ann update of the Waste Utilization Plan when there is a change in the operation, increase in the number of animals, method of utilization, or available land. 3. Animal waste shall be applied to meet but not exceed, the Nitrogen needs for realistic crop yields based on the soil type, available moisture, historical data, climatic conditions and level of management, unless there are regulations that restrict the rate of application for other nutrients. 4. Animal waste may be applied to land that has a Resource Management System (RMS) or an Alternative Conservation System (ACS). If an ACS is used the soil loss shall be no greater than 10 tons per acre per year and appropriate filter strips will be used where runoff leaves the field. These filter strips will be in addition to "Buffers" required by DEM. [See FOTG Standard 393 - Filter Strips and Standard 390 (Interim) - Riparian Forest Buffers.] 5. Odors can be reduced by injecting the waste or disking after waste application. Waste should not be applied when the wind is blowing. 6. When animal waste is to be applied on acres subject to flooding, it will be soil incorporated on conventionally tilled cropland. When applied to conservation tilled crops or grassland, the waste may be broadcast provided the application does not occur during a season prone to flooding. (See "Weather and Climate in North Carolina" in the Technical Reference - Environment file for guidance.) 7. Liquid waste shall be applied at rates not to exceed the soil infiltration rate such that runoff does not occur offsite or to surface waters and in a method which does not cause drift from the site during application. Animal waste shall not be applied to saturated soils, during rainfall events, or when the surface is frozen. 9. Animal waste shall be applied on actively growing crops in such a manner that no more than 20 to 25 percent of the leaf area is covered. 10. Waste nutrients shall not be applied in fall or winter for spring planted crops on soils with a high potential for leaching. Waste nutrient loading rates on these soils should be held to a minimum and a suitable winter cover crop planted to take up released nutrients. Waste shall not be applied more than 30 days prior to planting of the crop on bare soil. 11. Animal waste shall not be applied closer than 25 feet to surface water. This distance may be reduced for waters that are not perennial provided adequate vegetative filter strips are present. (See Standard 393 - Filter Strips) 12. Animal waste shall not be applied closer than 100 feet to wells. 13. Animal waste shall not applied closer than 200 feet of dwellings other than those owned by the landowner. 14. Waste shall be applied in a manner not to reach other property and public right-of- ways. 15. Animal waste shall not discharged into surface waters, drainageways or wetlands by a discharge or by over -spraying. Animal waste may be applied to prior converted wetlands provided they have been approved as a land application site by a "technical specialist". Animal waste should not be applied on grassed waterways that discharge directly into water courses, and only then at agronomic rates provided the application causes no runoff or drift from the site. 16. Doffiestic and' industrial waste from washdown facilities, showers, toilets, sinks, etc., shall not be discharged into the animal waste management system. 17. Lagoons and other uncovered waste containment structures must contain a maximum operating level to provide adequate storage for a 25-year, 24-hour storm event in addition to the one (1) foot mandatory freeboard. 18. A protective cover of appropriate vegetation will be established on all disturbed areas (Ingoon embankments, berms, pipe runs, etc.). If needed, special vegetation shall be Cedar Grove Sow Farm . Vegetation such as trees, shrubs, and other woody species, etc. are limited to areas where considered appropriate, Lagoon areas should be kept mowed and accessible. The waste from your animal facility must be land applied at a specified rate to prevent pollution of surface a6dlor groundwater. The plant nutrients in the animal waste should be used to reduce the amount of commercial fertilizer required for the crops in the fields where the waste is to be applied. This waste utilization plan uses nitrogen as the limiting nutrient. Waste should be analyzed before each application cycle. Annual soil tests are strongly encouraged so that all plant nutrients can be balanced for realistic yields of the crop to be grown. Several factors are important in implementing your waste utilization plan in order to maximize the fertilizer value of the waste and to ensure that it is applied in an environmentally safe manner. Always apply waste based on the needs of the crop to be grown and the nutrient content of the waste, Do not apply more nitrogen than the crop can utilize. Soil types are important as they have different infiltration rates, leaching potentials, cation exchange capacities and available water Bolding capacities. Normally waste shall not be applied to land eroding at greater than 5 tons per acre per year. Do not apply waste on saturated soils, when it is raining, or when the surface is frozen. Either of these conditions may result in runoff to surface waters which is not allowed under DEM regulations. Wind conditions should also be considered to avoid drift and downwind odor problems. To maximize the value of nutrients for crap production and to reduce the potential for pollution, the waste should be applied to a growing crop or applied to bare ground not more than 30 days prior to planting. Injecting the waste or disking will conserve nutrients arid reduce odor problems. The estimated acres needed to apply the animal waste is based on typical nutrient content 7 for this type of facility. Acreage requirements should be based on the waste analysis report from your waste management facility. Attached you will find information on the proper sampling techniques, preparation and transfer of waste samples to the lab for analysis. Cedar Grove Sow Farm Page 4 WASTE UTILIZATION PLAN REQUIRED SPECIFICATIONS Animal waste shall not reach surface waters of the State by runoff, drift, manmade conveyances, direct application, or direct discharge during operation or land application. Any discharge of waste which reaches surface water is prohibited. Illegal discharges are subject to the assessment of civil penalties of $10,000 per day by the Division of Environmental Management for every day the discharge continues. 2. The Field Office must have documentation in the design folder that the producer either owns or has long term access to adequate land on which to properly apply the waste. If the producer does not own adequate land to properly dispose of waste, he Shall provide NRCS with a copy of the written agreement (sample enclosed) with a landowner who is within a reasonable proximity, allowing him/her the use of the land for waste application for the lire expectancy of the production facility. It is the responsibility of the owner of the facility to secure ann update of the Waste Utilization Plan when there is a change iri tyre operation, increase in the number of animals, method of utilization, or available land. 3. Animal waste shall be applied to meet but not exceed, the Nitrogen needs for realistic crop yields based on the soil type, available moisture, historical data, climatic conditions and level of management, unless there are regulations that restrict the rate of application for other nutrients. 4. Animal waste may be applied to land that has a Resource Management System (RMS) or an Alternative Conservation System (ACS). If an ACS is used the soil loss shall be no greater than 10 tons per acre per year and appropriate filter strips will be used where runoff leaves the field. These filter strips will be in addition to "Buffers" required by DEM. [See FOTG Standard 393 - Filter Strips and Standard 390 (Interim) -- Riparian Forest Buffers.] 5. Odors can be reduced by injecting the waste or disking after waste application. Waste should not be applied when the wind is blowing. 6. When animal waste is to be applied on acres subject to flooding, it will be soil incorporated on conventionally tilled cropland. When applied to conservation tilled crops or grassland, the waste may be broadcast provided the application does not occur during a season prone to flooding. (See "Weather and Climate in North Carolina" in the Technical Reference- Environment file for guidance.) 7. Liquid waste shall be applied at rates riot to exceed the soil infiltration rate such that runoff does not occur offsite or to surface waters and in a method which does not cause drift from the site during application. No porrding should occur in order to control conditions conducive to odor or flies and provide uniformity of application. Cedar Grove Sow Farm . Page 5 WASTE UTILIZATION PLAN 8, Animal waste shall not be applied to saturated soils, during rainfall events, or when the surface is frozen. 9. Animal waste shall be applied on actively growing crops in such a manner that no more than 20 to 25 percent of the leaf area is.covered. 10, Waste nutrients shall not be applied in fall or winter for spring planted crops on soils with a high potential for leaching. Waste nutrient loading rates on these soils should be held to a minimum and a suitable winter cover crop planted to take up released nutrients. Waste shall not be applied more than 30 days prior to planting of the crop on bare soil. 'I 1. Animal waste shall not be applied closer than 25 feet to surface water. This distance cony be reduced for waters that are not perennial provided adequate vegetative filter strips are present. (See Standard 393 - Filter Strips) 12. Animal waste shall not be applied closer than 100 feet to wells. 13, Animal waste shall not applied closer than 200 feet of dwellings other than those owned by the landowner. 14, Waste shall be applied in a manner not to reach other property and public right-of- ways. 15. Animal waste shall not discharged into surface waters, drainageways or wetlands by a discharge or by aver -spraying. Animal waste may be applied to prior converted wetlands provided they have been approved as a land application site by a "technical specialist". Animal waste should not be applied on grassed waterways that discharge directly into water courses, and only then at agronomic rates provided the application causes no runoff or drift from the site. 16, Domestic and industrial waste from washdown facilities, showers, toilets, sinks, etc., shall not be discharged into the animal waste management system. 17. Lagoons and other uncovered waste containment structures must contain a maximum operating level to provide adequate storage for a 25-year, 24-hour storm event in addition to the one (1) foot mandatory freeboard. 18. A protective cover of appropriate vegetation will be established on all disturbed areas (lagoon embankments, berms, pipe runs, etc.). If needed, special vegetation shall be provided for these areas and shall be fenced, as necessary, to protect the vegetation. Vegetation such as trees, shrubs, and other woody species, etc. are limited to areas where considered appropriate. Lagoon areas should be kept mowed and accessible. Cedar Grove Sow Farm Page 6 WASTE UTILIZATION PLAN Lagoon berms and structures should be inspected regularly for evidence of erosion, leakage or discharge. 19. If animal production at the facility is to be suspended or terminated, the Owner is responsible for obtaining and implementing P "closure plan' which will eliminate the possibility of an illegal discharge, pollution and erosion. 20. Waste handling structures, piping, pumps, reels, etc., should be inspected on a regular basis to prevent breakdowns, leaks, and spills. A regular maintenance checklist should be kept on site. I (we) know that any expansion to the existing design capacity of the waste treatment and storage system or construction of new facilities will require a new certification to be submitted to the Division of Environmental (DEM) before file new animals are stocked. I (we) also understand that there must be no discharge of animal waste from this system to surface waters of the State from a storm event less severe than the 2.5-year, 24-lour storm. I (we) understand that I (we) must own or have access to equipment, primarily irrigation equipment, to land apply the animal waste described in this waste utilization plan. This equipment must be available at the appropriate pumping time such that no discharge occurs from the lagoon in a 25-year 24-hour storm event. Mr. Manning is now operating Cedar Grove Sow Farm at a maximum capacity of 600 head, farrow to wean. This change is reflected in the Animal Waste Management Plan Certification and the Waste Utilization Plan, I would like to address the items in your letter at this time. Item 1 - The storage volume available in the existing lagoons is 252,751 cubic feet with a total required volume of 243,851 cubic feet. item 2 - The soil classification on Page 2 of the WUP has been change to FoA. Item 3 - After reducing the number of animals at this farm, there is a surplus of 40 lbs. of N per year. I do not consider this to be a significant amount and I do not recommend making any additional changes at this time. Cedar Grove Sow Farm April 4, 1997 Page Two This number is based on information provided by the NRCS on the amount of plant available N produced per year per animal. The actual amount being applied by Mx. Manning may differ from these published numbers. I do not have a waste water analysis for this particular farm. Item 4 - The soil type and application rate on Page 4 of the WUP has been corrected. I have mailed a copy of these changes to Mr. Manning and I am waiting on his response before finalizing the Animal Waste Management Plan Certification and the Waste Utilization Plan. I feel that Mr. Manning has done an excellent job of waste management at this farm and he should be commended for his efforts. The revised Animal Waste Management Plan Certification and the Waste Utilization Plan will be submitted to your office as soon as Mr. Manning returns the signed forms to me. The owner of each animal waste management system must submit a designation form to the Technical Assistance and Certification Group which designates an Operator in Charge and is countersigned by the certified operator. The enclosed form must be submitted by January 1, 1997 for all facilities in operation as of that date. Failure to designate a certified operator for your animal waste management system is a violation of I SA NCAC 2H .0224 and may result in the assessment of a civil penalty. If you have questions concerning operator training or examinations for certification, please contact your local North Carolina Cooperative Extension Service agent or our office. Examinations have been offered on an on -going basis in many counties throughout the state for the past several months and will continue to be offered through December 31, 1996. On December 10, 1992 the Environmental Management Commission adopted a water quality. rule which governs animal waste management systems. The goal of the rule is for animal operations to be managed such that animal waste is not discharged to surface waters of the state. The rule allows animal waste systems to be "deemed permitted" if certain minimum criteria are met (I5A NCAC 2H .0217). By submitting this registration you have met one of the criteria for being deemed permitted. We would like to remind you that existing feedlots which meet the size thresholds listed in the rule, and any new or expanded feedlots constructed between February 1, 1993 and December 31, 1993 must submit a signed ccrtfflcatigA form (copy enclosed) to DEM by December 31, 1997. New or expanded feedlots constructed after December 31, 1993 must obtain signed certification before animals are stocked_ on the farm. Certification of an approved animal waste management plan can be obtained after the Soil and Water Conservation Commission adopts rules later this year.
