This plan provides an estimate of the number of acres of cropland needed to u the nutrients being produced. The plan requires consideration of the realistic yields of the crops to be grown, their nutrient requirements, and proper timing of applications to maximize nutrient uptake. This table provides an estimate of the amount of nitrogen required by the crop being grown and an estimate of the nitrogen amount being supplied by manure or other by -produce commercial fertilizer and residual from previous crops. An estimate of the quantity of solid and liquid waste that will be applied on each field in order to supply the indicated quant of nitrogen from each source is also included. A balance of the total manure produced and the total manure applied is included in the table to ensure that the plan adequately provide for the utilization of the manure generated by the operation. These estimates arebased on average nitrogen conwnafions fof each SOl1 M the number of animals in the facility and the plant available nitrogen application rates shown in the second column. Lagoon sludge contains nutrients and organic matter remaining after treatment and application of the effluent. At clean out, this material must be Utilized for clap production and applied at agronomic rates. In most cases, the priority nutrient is nitrogen but other nutrients including phosphorous, copper and zinc can also be limiting. Since nutrient levels are generally very high, application of sludge must be carefully applied. Sites must first be evaluated for their suitability for sludge application- Ideally, effluent spray fields should not be used for sludge application. If this is not possible, care should be taken not to load effluent application fields with high amounts of copper and zinc so that additional effluent cannot be applied. On sates vulnerable to surface water moving to streams and lakes, phosphorous is a concern. Soils containing very high phosphorous levels may also be a concern. These documents shall be kept in good condition and records shall be maintained in an orderly fashion" For both Watchoverya Farms #1 and Watchoverya Farms #2: 1) There is no animal waste analysis conducted within 60 days of several application events which occurred in July, August, and September 2001 on the 2001 soybean crop at the Watchoverya Farms #2, and there is no animal waste analysis conducted within 60 days of several application events which occurred in July and August 2001 on the 2001 soybean crop at the Watchoverya Farms #1. These are violations of Part III.. Monitoring and Reporting Requirements, Section 4 of the General Permit which says in part "An analysis of the animal waste shall be conducted as close to the time of application as practical and at least within 60 days (before or after) of the date of application." 2) Part III Section 3 of the General Permit says "A representative Standard Soil Fertility Analysis, including pH, copper, and zinc, shall be conducted annually on each application field receiving animal waste. The results of these tests shall be maintained on file by the Permittee for a minimum of three years and shall be made available to the DWQ upon request." For both facilities, Mr. Mathis was unable to verify from the information provided during the inspection that a Standard Soil Fertility Analysis was performed during 2001. This NOV is based upon the following facts: A permit for this animal waste management system is required in accordance with NCAC 2H .0217 and G.S. 143-215.L In accordance with G.S. 143-215.10C, Mervin Thigpen was notified by certified mail, which was received on June 25, 1998, of the requirement to apply for coverage under an Animal Waste General Permit within sixty (60) days of receipt of the notification (August 24, 1998). No application has been received from Mervin Thigpen as of October 5, 1998. In accordance with Chapter 626 of the 1995 Session Laws (Regular Session 1996), Section 19(c)(2), any owner or operator who fails to submit an application by the date specified by the Department SHALL NOT OPERATE the animal waste system- after the specified date. Any discharge of waste, which reaches surface water, is prohibited by state law. Illegal discharges are subject to assessment of civil penalties of $10,000 per day by the Division of Water Quality for each day the discharge continues. 2. If the producer does not own adequate land to properly dispose'of.waste, he/she shall provide a copy of an agreement with a landowner that is within. a reasonable proximity, allowing the producer the use of the land for waste application. It is the responsibility of the owner of the facility to secure an update of the Waste Utilization Plan when there is a change in the operation, increase in the number of animals, method of utilization, or available land. 3. Animal waste shall be applied to meet, but not exceed, the nitrogen needs for realistic crop yields based on soil type, available moisture, historical date, climatic conditions, and level of management, unless there are regulations that restrict the rate of application for other nutrients_ 4. Animal waste shall be applied to land eroding less than 5 tons per acre per year. Waste may be applied to land that is eroding at 5 or more tons, butless than 10 tons per acre per year providing grass filter stril-►s are installed where runoff leaves the field.
