You have requested a schedule for making payment toward the $4.456,35 civil penalty
assessed by the Director of the Division of Water Quality on September 8, 1997. The Department
is agreeable to entering into an agreement with you through which regular payments will be made
beginning April 1, 1999 and continuing through October 1, 2002. You agree that beginning
October 1, 1999 and continuing to July 1, 202, to pay three hundred dollars each month and by
October 1, 2002 to pay the remaining balance two hundred fifty six dollars and thirty five
cents($256.35). You should make the payments by checks made payable to the Department of
Environment and Natural Resources and mail them so they are received by the due date listed on
the attached schedule.
Failure to make the monthly payments in accord with this schedule of payment will cause
the entire unpaid balance of the civil penalty to be due and payable and subject to collection
through a civil action in the superior court.

CIVIL PENALTY ASSESSMENT PAYMENT SCHEDULE

On September 8, 1997, the Director, Division of Water Quality (DWQ), assessed a civil penalty
assessment in the amount of $4,456,35, including $456.35 in investigative costs, against the Major Murray
for discharging animal waste into the waters of the State. After the Director considered Mr. Murrays
remission request, the Division received a request from Major Murray for a payment schedule.
In order to resolve this matter, DWQ and Major Murray agree to enter into a payment schedule to
settle the above -described civil penalty for the violations contained in the assessment document. Major
Murray agrees to pay the civil assessment of $4,456.35 as per the terms below as full settlement of Case
No. DD 96-030 and understands that any default in payment or failure to submit payment by the day of the
month in which payment is due will result in the immediate referral of this case to the Attorney General's
Office for collection through the courts. Major Murray also acknowledges that DWQ reserves the right to
take enforcement action against the Major Murray for future violations within its authority should they
occur.

Dear Mr. Tedder:
I am writing to request remission of the civil penalty assessed against me in the attached letter from DEHNR
dated September 10, 1997. I make this request pursuant to paragraph 2.(G) and 2.(C) of the attached letter.
I believe the amount of the fine is unreasonable for two reasons:
1. The violation was abated as soon as I became aware of the discharge. I was not at the farm when the
discharge began but became aware of the problem when I returned to the farm after lunch at my home. The
discharge was stopped that same afternoon (July 19, 1996). I hired a backhoe operator to immediately
contain the waste stream leaving the barn, dig a small hole where we collected the spilled wastewater, and
rented a pump to pump the wastewater back into the lagoon. All of these actions were taken on the
afternoon of July 19'b. The break in the bush pipe was capped and sealed so that no further discharge would
occur, this also was done on July 19t'.
As soon as I could locate contractors I made permanent changes to the piping system so as to prevent any
reoccurrence of the discharge incident. I replaced the broken pipes and built a permanent clean out point so
that in the future any obstruction in my flush Iine cannot result in a reoccurrence of this accident. The cost of
repairs and improvements were approximately $650.00. All of these repairs were completed by August 9,
1996 and I have had no further problems with my discharge lines.
2. The discharge that occurred at my farm on July 19, 1996 was an accident caused by an obstruction in my
discharge pipe. This was not a case of chronic discharge or negligence on my part. As stated above I have
spent the money necessary to insure that such an incident cannot reoccur in the same fashion as the one on
July 19, 1996.
For what it's worth, I am retired and my only income is approximately $600.00 in pension and the income from
my two 620 head finishing barns. I don't have $4,400.00 to pay this penalty with. I trust that you will give
serious and careful consideration to my request.

2. Submit a written request for remission or mitigation including a
detailed justification for such request:
A request for remission or mitigation is limited to consideration of the
reasonableness of the amount of the penalty and is not the proper procedure
for contesting the accuracy of any of the statements contained in the
assessment letter. Because a remission request forecloses the option of an

I. FINDINGS OF FACT:
A. Major Murray operates a swine operation located along NCSR 1940, in D.uplin
County, North Carolina
B . Major Murray was deemed permitted on February 1, 1993, in accordance with 15A
NCAC 2H .0217 (c).
C. On July 19, 1996, DWQ staff observed a discharge of wastewater from Major Murray
Farm's wastewater collection system entering an unnamed tributary and flowing into
Rockfish Creek which are considered Class "C-Swamp" Waters of the State andare
within the Cape Fear River Basin.
D. Major Murray had no valid permit for the above described activity.
E. The costs to the State of the enforcement procedures in this matter totaled $456.35.
Based upon the above Findings of Fact, I make the following:
II. CONCLUSIONS OF LAW:
A. Major Murray is a "person" within the meaning of G.S.143-215.6A and G.S. 143-
212(4).
B . A permit for this animal waste management system is required in accordance with 15A
NCAC 2H .0217 and G.S. 143-215.1.
C. The unnamed tributary to Rockfish Creek constitutes waters of the State within the
meaning of G.S. 143-215.1(a)(1) and G.S. 143-212(6)..
D. The above -cited discharge is a violation of the nondischarge permit.
E. Major Murray may be assessed civil penalties in this matter pursuant to G.S. 143-
215.6A(a)(2), which provides that a civil penalty of not more than ten thousand
dollars ($10,000.00) per violation may be assessed against a person for failing to act
in accordance with the terms, conditions or requirement of a permit required by G.S.
143-215.1.
F. The State's enforcement costs in this matter may be assessed against Major Murray
pursuant to G.S. 143-215.3(a)(9) and G.S. 143B-282.1(b)(8).
G. The Director, Division of Water Quality, pursuant to delegation provided for by G.S.
143-215.6A(h), has the authority to assess civil penalties in this matter.
Based upon the above Findings of Fact and Conclusions of Law, I make the following:
III. DECISION:
Accordingly, Major Murray,is hereby assessed a.civil penalty of:

(7) The prior record of the violator in complying or failing to comply with programs over
which the Environmental Management Commission has regulatory authority; and
(8) The cost to the State of the enforcement procedures.

THIS MATTER came before the Committee on Civil Penalty Remissions of the
Environmental Management Commission, pursuant to N.C.G.S. §143-215.6A and §143B-282.1,
on March 12, 1998, upon recommendation of the Director of the Division of Water Quality for
entry of a final decision on the assessment of civil penalties and investigation costs against -Major
Murray in the amount of $4;456.35.
Major Murray requested remission and submitted a signed Waiver of Right to an
Administrative Hearing and Stipulation of Facts as required by statute. In addition to the
Waiver of Right and Stipulation form, Major Murray submitted a written explanation of the
cause of "the waste discharge to Rockfish Creek and his efforts to make repairs and
improvements. Before the Committee on Civil Penalty Remissions, Major Murray sought relief
from the civil penalty based upon his financial status and alleged inability to pay any penalty due
to recent hospitalization and inability to work on his farm. Major Murray did not present
evidence or documentation to support his request for relief from the civil penalty to the Director
as required by the remission statute and Commission's Internal Operating Procedures.

Upon duly made motion and vote, the Committee on civil penalty Remissions found and
determined Major Murray should be given the opportunity to present evidence and
documentation in support of his request for relief to the Director of the Division of Water Quality
for consideration prior to coming before the Committee.
THEREFORE, IT IS ORDERED that the Request for Remission of Civil Penalties by
Major Murray is referred to the Director, Division of Water Quality for consideration of any
evidence and documentation Major Murray may present to support the request for remission of
civil penalties.
Upon the Director's consideration of evidence and documents submitted and his decision
on the request for remission, this matter, if not compromised or settled, shall be scheduled before
the Committee on Civil Penalty Remissions, with proper notice to Major Murray, for final
agency decision.

Water Quality assessed a civil penalty of $4,456.35
($4,000.00 civil penalty and $456.35 investigative

the State. The civil penalty assessment represents
40 percent of the maximum allowed by G.S. 143-

I. FINDINGS OF FACT:
A. Major Murray operates a swine operation located along NCSR 1940, in Duplin
County, North Carolina
B . Major Murray was deemed permitted on February 1, 1993, in accordance with 15A
NCAC 2H .0217 (c).
C. On July 19, 1996, DWQ staff observed a discharge of wastewater from Major Murray

Farm's wastewater collection system entering an unnamed tributary and flowing into
Rockfish Creek which are considered Class "C-Swamp" Waters of the State and are
within the Cape Fear River Basin.
D. Major Murray had no valid permit for the above described activity.
E. The costs to the State of the enforcement procedures in this matter totaled $456.35.
Based upon the above Findings of Fact, I make the following:
II. CONCLUSIONS OF LAW:
A. Major Murray is a "person" within the meaning of G.S.143-215.6A and G.S. 143-
212(4).
- B . A permit for this animal waste management system is required in accordance with 15A
NCAC 2H .0217 aud'G.S. 143-215.1.
C . The unnamed tributary to Rockfish Creek constitutes waters of the State within the
meaning of G.S. 143-215.1(a)(1) and G.S. 143-212(6)..
D. The above -cited discharge is a violation of the nondischarge permit.

I am writing to request remission of the civil penalty assessed against me in the attached letter from DEIM
dated September 10, 1997. I make this request pursuant to paragraph 2.(G) and 2.(C) of the attached letter.
I believe the amount of the fine is unreasonable for two reasons:
The violation was abated as soon as I became aware of the discharge. I was not at the farm when the
discharge began but became aware of the problem when I returned to the farm after lunch at my home. The
discharge was stopped that same afternoon (July 19, 1996). 1 hired a backhoe operator to immediately
contain the waste stream leaving the barn, dig a small hole where we collected the spilled wastewater, and
rented a pump to pump the wastewater back into the lagoon. All of these actions were taken on the
afternoon of July 19`s. The break in the flush pipe was capped and sealed so that no further discharge would
occur, this also was done on July 19`s.
As soon as I could locate contractors I made permanent changes to the piping system so as to prevent any
reoccurrence of the discharge incident. I replaced the broken pipes and built a permanent clean out point so
that in the future any obstruction in my flush line cannot result in a reoccurrence of this accident. The cost of
repairs and improvements were approximately $650.00. All of these repairs were completed by August 9,
I996 and I have had no further problems with my discharge lines.
2. The discharge that occurred at my farm on July 19, 1996 was an accident caused by an obstruction in my
discharge pipe. This was not a case of chronic discharge or negligence on my part. As stated above I have
spent the money necessary to insure that such an incident cannot reoccur in the same fashion as the one on
July 19, 1996.
For what it's worth, I am retired and my only income is approximately $600.00 in pension and the income from
my two 620 head finishing barns. I don't have $4,400.00 to pay this penalty with. I trust that you will give
serious and careful consideration to my request.

detailed justification for such request:
A request for remission or mitigation is limited to consideration of the
reasonableness of the amount of the penalty and is not the proper procedure
for contesting the accuracy of any of the statements contained in the
assessment letter. Because a remission request forecloses the option of an
administrative hearing, such a request must be accompanied by a waiver of
your right to an administrative hearing and a stipulation that there are no
factual or legal issues in dispute. You must execute and return to this office
the attached waiver and stipulation form and a detailed statement which you
believe establishes whether -
(a) one or more of the civil penalty assessment factors in G.S. 143B-
282.1(b) were wrongfully applied to the detriment of the petitioner;

F. The State's enforcement costs in this matter may be assessed against Major Murray
pursuant to G.S. 143-215.3(a)(9) and G.S. 143B-282.1(b)(8).
G. The Director, Division of Water Quality, pursuant to delegation provided for by G.S.
143-215.6A(h), has the authority to assess civil penalties in this matter.
Based upon the above Findings of Fact and Conclusions of Law, I make the following:

2. Submit a written request for remission or mitigation including a
detailed justification for such request:
A request for remission or mitigation is limited to consideration of the
reasonableness of the amount of the penalty and is not the proper procedure
for contesting the accuracy of any of the statements contained in the
assessment letter. Because a remission request forecloses the option of an
administrative hearing, such a request must be accompanied by a waiver of
your right to an administrative hearing and a stipulation that there are no
factual or legal issues in dispute. You must execute and return to this office
the attached waiver and stipulation form and a detailed statement which you
believe establishes whether:
(a) one or more of the civil penalty assessment factors in G.S. 143B-
282. 1 (b) were wrongfully applied to the detriment of the petitioner;

Acting pursuant to North Carolina General Statute (G.S.) 143-215.6A, I, A. Preston .
Howard, Jr., Director of the Division of Water Quality (DWQ), make the following:
I . FINDINGS OF FACT:
A. Major Murray operates a swine operation located along NCSR 1940, in Duplin
County, North Carolina
B. Major Murray was deemed permitted on February 1, 1993, in accordance. with 15A
NCAC 2H .0217 (c).
C. On July 19, 1996, DWQ staff observed a discharge of wastewater from Major Murray
Farm's wastewater collection system entering an unnamed tributary and flowing into
Rockfish Creek which are considered Class "C-Swamp" Waters of the State and are
within the Cape Fear River Basin.
D. Major Murray had no valid permit for the above described activity.
E. The costs to the State of the enforcement procedures in this matter totaled $456.35.
Based upon the above Findings of Fact, I make the following:
-II.. CONCLUSIONS OF LAW:
A. ` Major Murray is a "person"within the meaning of G.S.143-215.6A and G.S. 143- 1
212(4).
B . A permit for this animal waste management system is required in accordance with 15A
. . NCAC 2H .0217 and G.S.-143-215.1.
C. The unnamed tributary to Rockfish Creek constitutes waters of the State within the
meaning of G.S. 143-215.1(a)(1) and G.S. 143-212(6)..
D. The above -cited discharge is a violation of the nondischarge permit.
E. Major Murray may be assessed civil penalties in this matter pursuant to G.S. 143-
215.6A(a)(2), which provides that a civil penalty of not more than ten thousand
dollars ($10,000.00) per violation may be assessed against a person for failing to act
in accordance with the terms, conditions or requirement of a permit required by G.S.
143-215.1.
F. The State's enforcement costs in this matter may be assessed against Major Murray
pursuant to G.S. 143-215.3(a)(9) and G.S. 143B-282.I(b)(8).
G. The Director, Division of Water Quality, pursuant to delegation provided for by G.S.
143-215.6A(h), has the authority to assess civil penalties in this matter.
Based upon the above Findings of Fact and Conclusions of Law, I make the following:
III. DECISION:
Accordingly, Major Murray is hereby assessed a civil penalty of: ,

Attached please find the subject notice of violation which was prepared by Mr. David Holsinger of
the Wilmington Regional Office. The report concludes that Mr. Major Murray has not met the criteria for
being "deemed permitted" set forth under 15A NCAC 2H .0217 - Waste not Discharged to Surface Waters.
It is recommended that Mr. Murray obtain and implement an approved animal waste management
plan within 60 days of this notice. In addition, Mr. Murray should be required to submit the completed
waste plan and certification form to the--DWQ - Water Quality Section Operations Branch.
It is also recommended that should Mr. Murray fail to implement all corrective actions the Division
consider further proceedings which may include the facility losing it's deemed permitted status and being
required to obtain an individual non discharge permit for the facility.

You are hereby notified that Major Murray Farm, which has been deemed permitted to have a nondischarge
permit for an animal waste disposal system pursuant to 15A NCAC 2H .0217, has been found to be in violation
of its 2H .0217 Permit.
On July 19, 1996, DEM staff observed a discharge of wastewater by the Major -Murray Farm to an unnamed
tributary of Rockfish Creek. The collection system was allowed to overflow into and through a utility right
of way and stormwater diversion to an unnamed tributary of Rockfish Creek. A sample taken of the waste
overflow showed that > 1,100, 000 colonies per 100 ml of fecal coliform bacteria was being discharged from
the stormwater diversion to the unnamed tributary of Rockfish Creek.
The Division of Environmental Management will proceed to revoke Major Murray Farm's permit unless the
following conditions are completed:
1. Immediately eliminate the discharge of wastewater and/or list actions to correct the noted
violation.
2. Make any modifications needed to ensure there will be no future discharges.

To remain a deemed permitted facility, all corrective actions must be.made within fourteen (14) days. Failure to
do so may result in the facility losing it's deemed permitted status, requiring a certified waste management plan
and certification form for the facility to be submitted prior to the December 31, 1997 deadline, and being
required to obtain an individual non discharge permit for the facility.
Please be aware it is a violation of North Carolina General Statutes to discharge wastewater to the surface
waters of the State without a permit. The Division of Environmental Management has the authority to levy a
civil penalty of not more than $10,000 per day per violation. In addition, this assessment does not prevent the
Division of Water Quality from taking enforcement actions for this violation or any past or future violations.
When the required corrective actions -are complete, please notify this office in writing at the address below. If

1. The degree and extent of harm to the natural resources
of the State, to the public health, or to private
property resulting from the violation:
The discharge of animal waste displayed levels of fecal
coliform bacteria of a1,100,000 colonies per 100 ml.
This represents a level 5,500 times greater than the
assigned stream standard.
2. The duration and gravity of the violation:
The waste overflow had been occurring over an
undetermined duration. However, the land area directly
adjacent to the collection system was completely
saturated with wastewater for some 100 feet into the
utility right of way. Ponded wastewater was observed
in several areas and observed draining through the
stormwater diversion into the unnamed tributary to
Rockfish Creek. Mr. Murray had no acceptable cover crop
on his spray fields at the time.
3. The effect on ground or surface water quantity or
quality or on air quality:
The effects to groundwater and air were not documented.
Water quality was impacted as determined by water
quality analysis.
4. The cost -of rectifying the damage:
Proper cleaning and repair of the collection system is
estimated at approximately $100.00
5. The amount of money saved by noncompliance:
The amount of money saved by noncompliance is not
known. However, installation and maintenance of proper
pipe clean -outs would require some expense. Land is
available for irrigation. An acceptable cover crop was
not observed at the time.
6. Whether the violation was committed willfully or
intentionally:
There is some evidence of a man made conveyance
allowing the discharge of waste. The collection system
pipe was simply cut open and allowed to overflow. Mr.
Hairr (Carroll's Foods)indicated that the pipe had been
cut open to facilitate in cleaning a blockage at an
earlier date. No reason was given for not having
repaired the cut before the documented discharge. Due
to the estimated length if time of the discharge and
the size of the land area saturated, the discharge is
considered willful. In addition, Mr. Murray did not
have an acceptable cover crop.
7. The prior record of the violator in complying or
failing to comply with programs over which the
Environmental Management Commission has regulatory
authority: Mr. Murray received a warning from DWQ
through Mr. Dexter Edwards of Carroll's Foods
concerning improper application'of waste and the
consequences of a discharge on June 5, 1996.
8. The cost to the State of the enforcement procedures:
The State's enforcement costs totaled $456.35, as
follows:

(acting for Mr. Murray) was asked to cease the
discharge immediately and to properly repair the
collection system. Mr. Hairr was asked.and agreed to
pump the ponded waste back to the lagoon. Mr. Hairr
indicated that the pipe had been cut open to facilitate
in cleaning a blockage at an earlier date. No reason
was given for not having repaired the cut before the
documented discharge.

215.6A(a)(1), which provides that a civil penalty of not more than ten thousand
dollars ($10,000.00) per violation may be assessed against a person who violates any
classification, standard, limitation, or management practice established pursuant to
G.S. 143-215.1.OR 143-215.6A(a)(2) for failing to act in accordance with the
terms, conditions or requirement of a permit.
F. The State's enforcement costs in this matter may be assessed against Major Murray
pursuant to G.S. 143-215.3(a)(9) and G.S. 14313-282.1(b)(8).
G. The Director, Division of Water Quality, pursuant to delegation provided for by G.S.
143-215.6A(h), has the authority to assess civil penalties in this matter.
