We wish to thank Brent Mitchell, who was present and assisted us during the inspection. As a result of this inspection, you are hereby notified that, having been permitted to have a non -discharge permit for the subject animal waste management system pursuant to 15A NCAC 2T .1304, you have been found to be in violation of your Certified Animal Waste Management Plan (CAWMP) and the Swine Waste System General .Permit No. A WG 100000 as follows: Violation 1: Failure in operating and maintaining the collection, treatment and storage facilities, and the land application equipment at all times in accordance with Condition 1I. 1 of the Swine Waste System General Permit No. AWG100000. On June 1, 2107, DWR staff found waste overflowing from,the back of the hog house and ponding between hog house and the lagoon. Required Corrective Action for Violations: Please provide to our office, a description of the corrective action you will take to prevent this from occurring again. Violation 3: Failure to maintain waste -level gauges to properly mark the level of waste in each lagoon/storage pond in accordance with Condition III.2a. On October 5, 2015, DWR staff inspected the lagoon waste level at lagoon 2 and found the waste -level gauge indicating four (4) inches when the waste level was actually at zero (0) inches and on top of the lagoon dike wail. Rainfall since October 5, 2015, equals 13.2". We will continue to pump whenever possible. Current lagoon levels are as follows: Lagoon 1= 14", Lagoon 2 = 15" We have plans to install a Solid Set System as soon as possible. VIOLATION 2: On or about November 12, 2015, we cut swells and installed pipe to remove surface water. We will continue to drain as needed to prevent any surface water from entering lagoon. VIOLATION 3: On or about November 12, 2015, dirt was added to the low places on the lagoon dike. Thad Miller, engineer with Murphy -Brown, LLC, checked level of stick and adjusted according to lowest place on dike. I have been in the hog business for 22 years. I understand the severity and urgency of this matter, and do not intend to let these issues occur again. I have -no previous violations, a clean record and try to be the best neighbor possible. Rex Halso violated Condition II.11 of the General Permit AWG100000 for failing to maintain surrounding property and buildings to divert uncontaminated runoff from the waste lagoons/storage ponds. Rex Halso violated Condition III.2a of the General Permit AWG100000 for failure to maintain waste -level gauges to properly mark the level of waste in each lagoons/storage ponds. A Notice of Violation and Recommendation for Enforcement (Case NOV-2015-PC-0284) was issued on October 28, 2015 for above mentioned violations to the General Permit AWG100000. It is recommended that appropriate civil penalties be assessed in accordance with G.S. 143- 215.6A(a)(2). It is also recommended that all of the enforcement costs incurred in the investigation be recovered in the amount of $324.25 pursuant to G.S. 143-215.3(a)(9) and G.S. 143B-282.1(b)(8). None, Rex Halso & Son #2 31-505 STATE OF NORTH CAROLINA COUNTY OF DUPLIN IN THE MATTER OF REX HALSO FOR VIOLATIONS OF SWINE WASTE GENERAL PERMIT AWG 100000 PURSUANT TO NORTH CAROLINA GENERAL STATUE 143-215.1 NORTH CAROLINA DEPARTMENT OF ENVIRONMENTAL QUALITY File No. NOV-2015-PC-0284 FINDINGS AND DECISION AND ASSESSMENTS OF CIVIL PENALTIES Acting pursuant to delegation provided by the Secretary of the Department of Environment Quality and the Director of the Division of Water Resources (DWR), I, Jay Zimmerman, Director of the Division of Water Resources, make the following: I. FINDINGS OF FACT: A. Rex Halso owns and operates Rex Halso & Son #2, a swine animal operation located East of Beulaville, North Carolina, on the North and South side of Old 24 Road in Duplin County. B. Rex Halso was issued a Certificate of Coverage AWS310505 under Swine Waste Management System General Permit AWG100000 for Rex Halso & Son #2 on October 1, 2014, effective October 1, 2014, with an expiration date of September 30, 2019 for the operation of a swine waste collection, treatment, storage, and application system. C. During the October 5, 2015 DWR site visit, staff from the Wilmington Regional Office (WIRO) discovered lagoon freeboards not to be in compliance with the levels specified in the facility's Certified Animal Waste Management Plan (CAWMP). D. Condition V. 2 of the General Permit AWG100000 states in part that, "At a minimum, maximum waste level for lagoons/storage ponds must not exceed the level that provides adequate storage to contain the 25-year, 24-hour storm event plus an additional one (1) foot of structural freeboard." E. On October 5, 2015, DWR staff inspected diversion ways around lagoon two (2) and found surface water running into the lagoon adding unnecessary liquid volume. F. Condition II. 11 of the Swine Waste System General Permit No. AWG100000 states in part that, "All uncontaminated runoff from the surrounding property and buildings shall be diverted away from the waste lagoons/storage ponds to prevent unnecessary addition to the liquid volume in the structures." G. On October 5, 2015 DWR staff inspected the lagoon waste level at lagoon 2 and found the waste -level gauge indicating four (4) inches when the waste level was actually at zero (0) inches and on top of the lagoon dike wall. H. Condition III. 2a of the Swine Waste System General Permit No. AWG100000 states in part that, "Highly visible waste -level gauges shall be maintained to mark the level of waste in each lagoon/storage pond." 1. The costs to the State of the enforcement procedures in this matter totaled $324.25. Based upon the above Findings of Fact, I make the following: II. CONCLUSIONS OF LAW: A. Rex Halso is a "person" within the meaning of G.S. 143-215.6A pursuant to G.S. 143-212(4). B. A permit for an animal waste management system is required by G.S. 143-215.1. C. The above -cited failure in maintaining a waste level not to exceed the maximum level specified in the facilities CAWMP violated Condition V. 2. Of the Swine Waste System General Permit No. AWG100000. D. The above -cited failure in maintaining surrounding property and buildings to divert away uncontaminated runoff from lagoons/storage ponds at all times violated Condition II. 11 of the Swine Waste System General Permit No. AWG100006. E. The above -cited failure to maintain waste -level gauges to properly mark the level of waste in each lagoons/storage ponds violated Condition III. 2a of the Swine Waste System General Permit No. AWG100000. F. On October 5, 2015, DWR staff inspected divertion ways around lagoon 2 and found surface water running into the lagoon adding unnecessary liquid volume. Violation 3: Failure to maintain waste -level gauges to properly mark the level of waste in each lagoon/storage pond in accordance with Condition III, 2a. On October 5, 2015, DWR staff inspected the lagoon waste level at lagoon 2 and found the waste -level gauge indicating four (4) inches when the waste level was actually at zero (0) inches and on top of the lagoon dike wall. Required Corrective Action for Violations: Please provide to our office, a description of the corrective action you will take to prevent this from occurring again. You are required to provide a written response to this Notice by November 30, 2015. Please include in your response all corrective actions already taken and a schedule for completion of any corrective actions not addressed.
