The plant nutrients in the animal waste should be used to reduce the amount of commercial fertilizer required for the crops in the fields where the waste is to be applied. This waste utilization plan uses nitrogen as the limiting nutrient. Waste should be analyzed before each application cycle. Annual soil tests are strongly encouraged so that all plant nutrients can be balanced for realistic yields of the crop to be grown. Several factors are important in implementing your waste utilization plan in order to maximize the fertilizer value of the waste and to ensure that it is applied in an environmentally safe manner: 1. Always apply waste based on the needs of the crop to be grown and the nutrient content of the waste. Do not apply more nitrogen than the crop can utilize. 2. Soil types are important as they have different infiltration rates, leaching potentials, cation exchange capacities, and available water holding capacities. 3. Normally waste shall be applied to land eroding at less than 5 tons per acre per year. Waste may be applied to land eroding at 5 or more tons per acre annually, but less than 10 tons per acre per year providing that adequate filter strips are established. 4. Do not apply waste on saturated soils, when it is_raining, or when the surface is frozen. Either of these conditions may result in runoff to surface waters which is not allowed under DWQ regulations. 5. Wind conditions should also be considered to avoid drift and downwind odor problems. 6. To maximize the value of the nutrients for crop production and to reduce the potential for pollution, the waste should be applied to a growing crop or applied not more than 30 days prior to planting a crop or forages breaking dormancy. Injecting the waste or disking will conserve nutrients and reduce odor problems. 1 of 8 This plan is based on the waste application method shown above. If you choose to change methods in the future, you need to revise this plan. Nutrient levels for different application methods are not the same. The estimated acres needed to apply the animal waste is based on typical nutrient content for this type of facility. In some cases you may want to have plant analysis made, which could allow additional waste to be applied. Provisions shall be made for the area receiving waste to be flexible so as to accommodate changing waste analysis content and crop type. Lime must be applied to maintain pH in the optimum range for specific crop production. This waste utilization plan, if carried out, meets the requirements for compliance with 15A NCAC 2H .0217 adopted by the Environmental Management Commission. You should plan time and have appropriate equipment to apply the waste in a timely manner. The farm should produce adequate plant available nitrogen to satisfy the requirements of the crops listed above. The applicator is cautioned that P and K may be over applied while meeting the N requirements. In the future, regulations may require farmers in some parts of North Carolina to have a nutrient management plan that addresses all nutrients. This plan only addresses nitrogen. In interplanted fields ( i.e. small grain, etc, interseeded in bermuda), forage must be removed through grazing, hay, and/or silage. Where grazing, plants should be grazed when they reach a height of six to nine inches. Cattle should be removed when plants are grazed to a height of four inches. In fields where small grain, etc, is to be removed for hay or silage, care should be exercised not to let small grain reach maturity, especially late in the season (i.e. April or May). Shading may result if small grain gets too high and this will definately interfere with stand of bermudagrass. This loss of stand will result in reduced yields and less nitrogen being utilized. Rather than cutting small grain for hay or silage just before heading as is the normal situation, you are encouraged to cut the small grain earlier. You may want to consider harvesting hay or silage two to three times during the season, depending on the time small grain is planted in the fall. The ideal time to interplant small grain, etc, is late September or early October. Drilling is recommended over broadcasting. Bermudagrass should be grazed or cut to a height of about two inches before drilling for best results. If you remove the sludge every 5 years, you will have approximately 7488 pounds of plant available nitrogen to utilize. Assuming you apply this PAN to hybrid bermuda grass hayland at the rate of 300 pounds of nitrogen per acre, you will need 24 acreas of land. If you apply the sludge to corn at a rate of 125 pounds per acre, you will need 59.904 acres of land. Please note that these are only estimates of the PAN produced and the land required to utilize that PAN. Actual values may only be determined by sampling the sludge for plant available nitrogen content prior to application Actual utilization rates will vary with soil type, crop, and realistic yield expectations for the specific application fields designated for sludge application at time of removal. APPLICATION OF WASTE BY IRRIGATION: The irrigation application rate should not exceed the intake rate of the soil at the time of irrigation such that runoff or ponding occurs. This rate is limited by initial soil moisture content, soil structure, soil texture, water droplet size, and organic solids. The application amount should not exceed the available water holding capacity of the soil at the time of irrigation nor should the plant available nitrogen applied exceed the nitrogen needs of the crop. If surface irrigation is the method of land application for this plan, it is the responsibility of the producer and irrigation designer to ensure that an irrigation system is installed to properly irrigate the acres shown in the preceding table. Failure to apply the recommended rates and amounts of nitrogen shown in the tables may make this plan invalid. 'This is the maximum application amount allowed for the soil assuming the amount of nitrogen allowed for the crop is not over applied. In many situations, the application amount shown cannot be applied because_ of the nitrogen limitation. The maximum application amount shown can be applied under optimum soil conditions. Your facility is designed for >180 days of temporary,storage and the temporary storage must be removed on the average of once every 6 months. In no instance should the volume of the waste stored in your structure be within the 25 year 24 hour storm storage or one foot of freeboard except in the event of the 25 year 24 hour storm. Any discharge of waste which reaches surface water is prohibited. There must be documentation in the design folder that the producer either owns or has an agreement for use of adequate land on which to properly apply the waste. If the producer does not own adequate land to properly dispose of the waste, he/she shall provide evidence of an agreement with a landowner, who is within a reasonable proximity, allowing him/her the use of the land for waste application. It is the responsibility of the owner of the waste production facility to secure an update of the Nutrient Utilization Plan when there is a change in the operation, increase in the number of animals, method of application, recieving crop type, or available land. 3 Animal waste shall be applied to meet, but not exceed, the nitrogen needs for realistic crop yields based upon soil type, available moisture, historical data, climatic conditions, and level of management, unless there are regulations that restrict the rate of applications for other nutrients. 4 Animal waste shall be applied to land eroding less than 5 tons per acre per year. Waste may be applied to land eroding at more than 5 tons' per acre per year but less than 10 tons per acre per year provided grass filter strips are installed where runoff leaves the field (See USDA, NRCS Field Office Technical Guide Standard 393 - Filter Strips). 5 Odors can be reduced by injecting the waste or disking after waste application. Waste should not be applied when there is danger of drift from the land application field. 6 When animal waste is to be applied on acres subject to flooding, waste will be soil incorporated on conventionally tilled cropland. When waste is applied to conservation tilled crops or grassland, the waste may be broadcast provided the application does not occur during a season prone to flooding (See "Weather and Climate in North Carolina" for guidance). Liquid waste shall be applied at rates not to exceed the soil infiltration rate such that runoff does not occur offsite or to surface waters and in a method which does not cause drift from the site during application. The potential for salt damage from animal waste should also be considered. 10 Nutrients from waste shall not be applied in fall or winter for spring planted crops on soils with a high potential for leaching. Waste/nutrient loading rates on these soils should be held to a minimum and a suitable winter cover crop planted to take up released nutrients. Waste shall not be applied more than 30 days prior to planting of the crop or forages breaking dormancy. 11 Any new swine facility sited on or after October 1, 1995 shall comply with the following: The outer perimeter of the land area onto which waste is applied from a lagoon that is a component of a swine farm shall be at least 50 feet from any residential property boundary and canal. Animal waste, other than swine waste from facilities sited on or after October 1, 1995, shall not be applied closer than 25 feet to perennial waters. 12 Animal waste shall not be applied closer than 100 feet to wells. 13 Animal waste shall not be applied closer than 200 feet of dwellings other than those owned by the landowner. 14 Waste shall be applied in a manner not to reach other property and public right-of-ways. 15 Animal waste shall not be discharged into surface waters, drainageways, or wetlands by discharge or by over -spraying. Animal waste may be applied to prior converted cropland provided the fields have been approved as a land application site by a "technical specialist". Animal waste shall not be applied on grassed waterways that discharge directly into water courses, and on other grassed waterways, waste shall be applied at agronomic rates in a manner that causes no runoff or drift from the site. 16 Domestic and industrial waste from washdown facilities, showers, toilets, sinks, etc., shall not be discharged into the animal waste management system. 2 of 3 NUTRIENT UTILIZATION PLAN REQUIRED SPECIFICATIONS (continued) 17 A protective cover of appropriate vegetation will be established on all disturbed areas (lagoon embankments, berms, pipe runs,,etc.). Areas shall be fenced, as necessary, to protect the vegetation. Vegetation such as trees, shrubs, and other woody species, etc., are limited to areas where considered appropriate. Lagoon areas should be kept mowed and accessible. Berms and structures should be inspected regularly for evidence of erosion, leakage, or discharge. 18 If animal production at the facility is to be suspended or terminated, the owner is responsible for obtaining and implementing a "closure plan" which will eliminate the possibility of an illegal discharge, pollution and erosion. 19 Waste handling structures, piping, pumps, reels, etc., should be inspected on a regular basis to prevent breakdowns, leaks and spills. A regular maintenance checklist should be kept on site. 20 Animal waste can be used in a rotation that includes vegetables and other crops for direct human consumption. However, if animal waste is used on crops for direct human consumption, it should only be applied pre -plant with no further applications of animal waste during the crop season. 21 Highly visible markers shall be installed to mark the top and bottom elevations of the temporary storage (pumping volume) of all waste treatment lagoons. Pumping shall be managed to maintain the liquid level between the markers. A marker will be required to mark the maximum storage volume for waste storage ponds. 22 Waste shall be tested within 60 days of utilization and soil shall be tested at least annually at crop sites where waste products are applied. Nitrogen shall be the rate -determining nutrient, unless other restrictions require waste to be applied based on other nutrients, resulting in a lower application rate than a nitrogen based rate. Zinc and copper levels in: the soil shall be monitored and alternative crop sites shall be used when these metals approach excessive levels. pH shall be adjusted and maintained for optimum crop production. Soil and waste analysis records shall be kept for a minimum of five years. Poultry dry waste application records shall be maintained for a minimum of three years. The plant nutrients in the animal waste should be used to reduce the amount of commercial fertilizer required for the crops in the fields where the waste is to be applied. This waste utilization plan uses nitrogen as the limiting nutrient. Waste should be analyzed before each application cycle. Annual soil tests are strongly encouraged so that all plant nutrients can be balanced for realistic yields of the crop to be grown. Several factors are important in implementing your waste utilization plan in order to maximize the fertilizer value of the waste and to ensure that it is applied in an environmentally safe manner. Always apply waste based on the needs of the crop to be grown and the nutrient content of the waste. Do not apply more nitrogen than the crop can utilize. Soil types are important as they have different infiltration rates, leaching potentials, cation exchange capacities, and available water holding capacities.. Normally waste shall not be applied to land eroding at greater than 5 tons per acre per year. With special precautions, waste maybe applied to land eroding at up to 10 tons per acre per year. Do not apply waste on saturated soils, when it is raining, or when the surface is frozen. Either of these conditions may result in runoff to surface waters which is not allowed under DEM regulations. Wind conditions should also be considered to avoid drift and downwind odor problems. To maximize the value of nutrients for crop production and to reduce the potential for pollution, the waste should be applied to a growing crop or applied to bare ground not more than 30 days prior to planting. Injecting the waste or disking will conserve nutrients and reduce odor problems. The estimated acres needed to apply the animal waste is based on typical nutrient content for this type of facility. Acreage requirements should be based on the waste analysis report from your waste management facility. Attached you will find information on proper sampling techniques, preparation, and transfer of waste samples to the Iab for analysis. Animal waste shall not reach surface waters of the state by runoff, drift, manmade conveyances, direct application, or direct discharge during operation or land application. Any discharge of waste which reaches surface water is prohibited. Illegal discharges are subject to the assessment of civil penalties of $10,000 per day by the Division of Environmental Management for every day the discharge continues. 2. The Field Office must have documentation in the design folder that the producer either owns or has long term access to adequate land. on which to properly apply the waste. If the producer does not own adequate land to properly dispose of waste, he shall provide NRCS with a copy of a written agreement (sample enclosed) with a landowner who is within a reasonable proximity, allowing him/her the use of the land for waste application for the life expectancy of the production facility. It is the responsibility of . the owner of the facility to secure an update of the Waste Utilization Plan when there is a change in the operation, increase in the number of animals, method of utilization, or available land. 3_ Animal waste shall be applied to meet, but not exceed, the Nitrogen needs for realistic crop yields based on soil type, available moisture, historical data, climate conditions, and level of management, unless there are regulations that restrict the rate of application for other nutrients. 4. Animal waste may be applied to land that has a Resowce Management System (RMS) or an Alternative Conservation System (ACS)_ If an ACS is used the soil loss shall be no greater than 10 tons per acre per year and appropriate filter strips will be used where runoff leaves the field. These filter strips will be in addition to 'Buffers" required by DEM. [See FOTG Standard 393 -. Filter Strips and Standard 390 (Interim) - Riparian Forest Buffers.] 5. Odors can be reduced by injecting the waste or disking after waste application. Waste should not be applied when the wind is blowing. 6. When animal waste is to be applied on acres subject to flooding, it will be soil incorporated on conventionally tilled cropland. When applied to conservation tilled crops or grassland, the waste may be broadcast provided the application does not occur during a season prone to flooding. (See "Weather and Climate in North Carolina" in the Technical Reference - Environment file for guidance.) k yr REQUIRED SPECIFICATIONS (continued) 7. Liquid waste shall be applied at rates not to exceed the soil infiltration rate such that runoff does not occur offsite or to surface waters and in a method which does not cause drift from the site during application. Animal waste shall not be applied to saturated soils, during rainfall events, or when the surface is frozen- 9. Animal waste shall be applied on actively growing crops in such a manner that no more than 20 to 25 percent of the leaf area is covered. 10. Waste nutrients shall not be applied in fall or winter for spring planted crops on sods with a high potential for leaching. Waste nutrient loading rates on these soils should be held to a minimum and a suitable winter cover crop planted to take up released uut i uts. Waste shall not be applied more than 30 days prior to planting of the crop on bare sod 11. Animal waste shall not be applied closer than 25 feet to surface water. This distance may be reduced for waters that are not perennial provided adequate vegetative filter strips are present. (See Standard 393 - Filter Strips) 12. Animal waste shall not be applied closer than 100 feet to Wells. 13. Animal waste shall not be applied closer than 200 feet of dwellings other than those owned by the landowner. 14. Waste shalt be applied in a manner not to reach other property and public right-of- ways. 15. Animal waste shall not be discharged into surface waters, drainageways or wetlands by a discharge or by over -spraying. Animal waste may be applied to prior converted wetlands provided they have been approved as a land application site by a "technical specialist". Animal waste should not be applied on grassed waterways that discharge directly into water courses, and only then at agronomic rates provided the application causes no runoff or drift from the site. 6 REQUMED SPEC FICATIONS (continued) 16. Domestic and industrial waste from washdown facilities, showers, toilets, sinks, etc., shall not be discharged into the animal waste management system. 17. Lagoons and other uncovered waste containment structures must maintain a maximum . operating level to provide adequate storage for a 25-year, 24-hour storm event in addition to the one (1) foot mandatory freeboard. 18. A protective cover of appropriate vegetation will be established on all disturbed areas (lagoon embankments, berms, pipe runs, etc.). If needed, special vegetation shall be . provided for these areas and shall be fenced, as necessary, to protect the vegetation. Vegetation such as trees, shrubs, and other woody species, etc. are limited to areas where considered appropriate. Lagoon areas should be kept mowed and accessible. Lagoon berms and structures should be inspected regularly for evidence of erosion, x' � y, O- discharge. 19. If animal production at the facility is to be suspended or terminated, the owner is responsible for obtaining and implementing a "closure plan" which will eliminate the possibility of an illegal discharge, pollution and erosion. 20. Waste handling structures, piping, pumps; reels, etc., should be inspected on a regular basis to prevent breakdowns, leaks, and spills. A regular maintenance checklist should be kept on site. The fact that contract growers and independent farmers are not being penalized for the same exceedances clearly shows unfairness and inequality and therefore this item should be erased from the Notice. 3) The overexceedence of PAN on the 2000 fescue crop was due to a record keeping error of using a waste analysis for greater than 60 days and was unintentional. Records have been corrected and will continue to be closely evaluated to prevent mistakes. 4) We have disked Field 4 and will re -seed fescue within 30 days. 5) Our large volume of soil sampling led to a labeling error that was noted and corrected. 6) Within two weeks we will begin biological treatment with a large initial treatment followed by monthly dosing to continue indefinitely to reduce sludge accumulation. Therefore: Murphy Family Farms is and will continue to be in -violation of the General Permit until the situation is corrected. 2) Overapplication of Plant Available Nitrogen (PAN) has occurred on Field 3 Hydrant 2 on the 1999-2000 small grain crop; the Certified Animal Waste Management Plan allowed 75 lbs PAN/acre on the referenced crop, while 103.5 lbs PAN/acre was applied resulting in overapplication of 28.5 lbs PAN/acre: This is a violation of Part II.Operation and Maintenance Requirements, Section 4 of the General Permit which requires that in no case shall land application rates exceed the PAN rate for the receiving crop or result in runoff during any given application. I am in receipt of the notice of violation response letter dated November 22, 2000 from Mr. John Bizic in which he indicates that the overapplication was a result of following the "Plan Amendment to Include Chronic Rainfall Practices and Standards through March 31, 2000" which allowed for application up to 200 lbs PAN/acre. Mr. Bizic indicates in his letter that these were followed until the revised BMPs were instituted in February 2000 which allowed for application of 75 lbs PAN/acre, but according to Mr. Bizic, this amount had already been exceeded. Murphy Family Farms'was required to cease use of the Plan Amendment allowing application of up to 200 lbs PAN/acre on December 10, 1999 in accordance with a court ruling placing a temporary injunction on the use of said practices; Murphy Family Farms was aware of said court ruling on the date indicated and was to return to operation under the unamended waste utilization plan until the matter could be settled in the courts. Furthermore, all of the applications to the -referenced crop occurred after December 10, 1999. 3) Overapplication of Plant Available Nitrogen (PAN) -has occurred on -Field 2 Hydrant 7 on the 2000 fescue crop; the Certified Animal Waste Management Plan .allows 1501bs PAN/acre on the referenced crop, while 166.4 lbs'PAN/acre was applied resulting in overapplication of 16.4 lbs PAN/acre. This is a violation of Part 11. Work to ensure that cropping practices are in agreement with the waste utilization plan. 5) Fescue was labeled as'the receiving crop in fields which are planted in Bermuda on the soil test report. Be sure to label the proper receiving crop on soil samples for soil analysis purposes. Ensuring that the proper crop is labeled on the soil sample will help ensure that proper recommendations are made. Inspector Stonewall Mathis mistakenly added a set of IRR-2s from the 1997 bermuda to the 1999 bermuda records. See #4 below. 3) The overapplication of PAN to the 1999-2000 small grain crop occurred before the PAN rate was changed by the SWCC. Certainly you remember this crop followed Hurricane Floyd. We correctly applied to the small grain using the 200 LB PAN rate from the "Plan Ammendment to Include Chronic Rainfall Practices and Standards through March 31, 2000" signed by Technical Specialist Kraig Westerbeek on 11/11/99. After the SWCC revised the set of BM Ps on 2/11100, Mr. Westerbeek sent a revised Plan Amendment to the farm changing the PAN allowance to 75 LB, but by then the farm had already exceeded that amount on Field 3 Routine 2 (see attached Plan Ammendments and IRR-2s). DENR had stated it would not penalize growers for nutrient applications based on a prior -authorized higher rate when the rate changed, given the confusing and difficult aftermath of this 500-year storm event. 4) When the inspector questioned the year date of a set of IRR-2s that did not include the year in the date column, OIC Michael Norris phoned me and I arrived on -site to help determine the correct date. I had a prior commitment so could only stay 10 minutes. I determined within that time that the records in question were 1997 bermuda and not 1999, due to the fact that no other 1997 bermuda records were present and many entry dates were too close together to have been entered on two sets of records. The inspector, without justification, evidently decided to ignore my explanation and conclude the records were from 1999, which is the basis for the overapplication charge in #2 above and #5, #6 & #10 below. This proves our original point and clearly contradicts the inspector's assumption in #2 of your letter. 5) The only two sets of IRR-2s for the same cropping season in our filebox were from the 1999-2000 small grain and were a result of the changing SWCC guidance on PAN rates following Hurricane Floyd. We combined the two and they are attached. 6) The maximum allowable application amount was not exceeded at any time in 1999. The inspector mistakenly assumed, ignoring our explanation, that 1997 records were actually from1999. Two events from 1997 did exceed the current hydraulic limit but this was before the farm had a precise irrigation design and before the farm was Generally Permitted. 7) Although November is probably not a good month to evaluate the quality of a bermuda stand, we do acknowledge that due to some field drainage work we performed this past summer, some areas of bermuda will probably need re - sprigged in the spring of next year. 8) Field 4 fescue pasture does include some bermuda, however our NUP limits our PAN application amount to that of fescue even though it would be higher for bermuda. Dr. Jim Green of NCSU has assured us that a monoculture in grazed grassland is neither attainable nor necessary. We will continue to manage the field to strengthen the fescue and spot re -seed if necessary in early spring. 9) Murphy Farms soil samples annually in November or December of each year. Soil samples were delivered to the NCDA lab for all fields of this farm the same date as your letter, November 15''. 10) PAN allowances have changed with Nutrient Utilization Plan (NUP) changes through the past five years, but the only variation in the PAN allowance the past two years on our IRR-2s came after 1999's Hurricane Floyd when the SWCC changed their recommendation on small grain three times during the season. 11) All OICs have been directed to use waste analyses dated within 60 days of application, which means as new analyses come in (every 90 days) the OIC may need to revise IRR-2s back 30 to 60 days. 12) The lagoon identified as needing a level gauge gravity flows through pipes to the final stage lagoon. It maintains the same level year-round. We have previously been advised by DENR that a gauge is not necessary in this case. Please advise us if this is a new requirement. 13) A signed copy of the NUP (attached) has been placed in the farm's environmental filebox. Although our pre-1999 irrigation records may not have been perfectly organized, we did successfully pass multiple State inspections that reviewed those records. Based on the information supplied here, we ask you to rescind this NOV. Please respond ASAP. On the northern most outside slope of the northern most lagoon there are several small trees growing on the slope. The trees on this slope will be cut and removed from this slope. The intent is certainly to remove all woody vegetation and weeds from this slope and establish grass vegetation, however the time of the year is wrong. Permanent grass vegetation will need to be established. Since the existing dike appears to be stable and without significant erosion, the dike slopes shall be seeded in March when there is a much higher probability of successfully establishing a good stand of grass. The existing ground cover should be left undisturbed until weather will allow vegetation to be established quickly. The western side of the lagoon is built immediately adjacent to the property line. The dike on that side of the lagoon is substantially higher than the lowest top of dike elevation, which is located on the east side. This additional elevation makes the dike appear to have a significant height above the original grade. However, if the top of lagoon elevation is defined as the lowest elevation along the perimeter of the inside top of dike, the dike is approximately 3 feet high with approximately 4 feet of additional fill. From this observation, if these trees fell, they would most likely not breach the embankment below the start pump elevation. Because these trees mark the property line, it is the neighbors wish that the trees not be disturbed despite Murphy Farms wishes. Additionally, based on past advice received from NCDNR Department of Land Quality section in July of 1999 in a similar situation, it appears that existing trees of large diameters pose less of treat left in place than to disturb the embankment structure with their removal. Furthermore, these trees have currently withstood several major hurricane events in the last five years and proved to be stable. Based on these considerations,) feel that the trees along the west dike do not present a significant treat and the risks associated with their removal are substantial enough that the trees should not be required to be removed. The Certified Animal Waste Management Plan (CAWMP) allows up to 235 lbs PAN/acre to be applied on the referenced crop; 3l 9 lbs PAN/acre was applied resulting in 84 lbs PAN/acre overapplication. This is a violation of Part 11. Operation and Maintenance Requirements, Section 4 of the General Permit which requires that in no case shall land application rates exceed the PAN rate for the receiving crop or result in runoff during any given application. 3) Overapplication of PAN has occurred on the 1999-2000 small grain crop on Field 3 Routine 2. The Certified Animal Waste Management Plan (CAWMP) allows up to 75 lbs PAN/acre to be applied on the referenced crop; 107.7 lbs PAN/acre was applied resulting in 32.7 lbs PAN/acre overapplication. This is a violation of Part II.Operation and Maintenance Requirements, Section 4 of the General Permit which requires that in no case shall land application rates exceed the PAN rate for the receiving crop or result in runoff during any given application. 4) Some IRR-2 forms did not have a year denoted in the date column. Murphy representatives were unable to chronologically place these IRR-2 forms. This is a violation of Part 11I. Monitoring -and Reporting Requirements, Section 5 of the General Permit which requires that records including land application events shall be maintained in chronological and legible form. 5) Two sets of IRR-2 forms were being kept for the same application area during the same cropping season. These sets of IRR-2's contained differing information regarding application events. This can create confusion and it appears that this may have played a part in the overapplication noted in items 2 and above. One set of IRR-2 forms should be kept for a given application area during a given cropping season. b) The maximum allowable application amount for a given event was exceeded on application events on August 25, 1999 and September 4, 1999 on Field 2 Routine 9. This is a violation of Part 11(4) of the General Permit which requires that land application rates shall be in accordance with the CAWMP. 7) The bermuda crop needs improvement in some areas of Field 3 in accordance with Part ll(I & 2) of the General Permit. 8) Field 4 needs to have Bermuda eliminated and fescue established on the entirety of the field in accordance with Part II(1 & 2) of the General Permit. 9) A representative Standard Soil Fertility Analysis (soil test) needs to be performed for all fields to receive animal waste and the proper receiving crop needs to be designated on the soil sample in accordance with Part III. I assume that this occurred during or after Hurricane Floyd. The main damage is an area of the wall that has slid into the lagoon. While this is an older structure constructed with native soils and has no dike wall in this area that poses a possibility of breaching, it does need to be repaired. The area in question is approximately 15 feet long by 4 feet wide and the full depth of the wall in this area. Filling and compacting this area with fill dirt, then establishing vegetation should suffice as the only repair needed. However, it should be repaired according to NRCS standards if i am incorrect as to the age of the structure or the repair needed. In addition, the inner walls on most of the structure need stabilization and re -vegetating to some extent, thus this should be completed at the same time. I would suggest that mowing of the inner wall be limited to removing unwanted vegetation to help grasses thrive and provide the greatest stability. It was observed that some erosion of the clay liner has occurred on the lagoon. Large cuts were observed in various sections of the inner dike walls of the lagoon. It is our concern that some of these gullies may become deep enough to cut through the liner material and sacrifice the integrity of the structure. As discussed at the time of the inspection, the cuts should be filled with a suitable clay material, compacted and reseeded with an appropriate vegetative cover. In addition, excessive vegetaion on the inner and outer walls of the lagoon should be mowed, and all trees should be removed. Bare areas should be reseeded with an appropriate vegetative cover. We would like to remind you that existing feedlots which meet the size thresholds listed in the rule, and any new or expanded feedlots constructed between February 1, 1993 and December 31, 1993 must submit a signed certification form (copy enclosed) to DEM by December 31. 1997. New or expanded feedlots constructed after December 31, 1993 must obtain signed certification J,efore ahimalls are stocked on th farm. Certification of an approved animal waste management plan can be obtained after the Soil and Water Conservation Commission adopts rules later this year.
