The time required for the planned fluid level to be reached may vary due to soil conditions, flushing operations, and the amount of fresh water added to the system. Land application of waste water is recognized as an acceptable method of disposal. Methods of application include solid set, center pivot, guns, and traveling gun irrigation. Care should be taken when applying waste to prevent runoff from the field or damage to crops. The following items are to be carried out: 1. It is strongly recommended that the treatment lagoon be pre - charged to 1/2 its capacity to prevent excessive odors during start-up. Pre -charging reduces the concentration of the initial waste entering the lagoon thereby reducing odors. Solids should be covered with effluent at all times. 2. The attached waste utilization plan shall be followed. This plan recommends sampling and testing of waste (see Attachment B) before land application. 3. Begin pump -out of the lagoon when fluid level reaches eleva- tion 52.3 as marked by permanent markers. Stop pump -out when the fluid level reaches elevation 50-3§9-.+- or before fluid depth is less than 6 feet deep (this prevents the loss of favorable bacteria) . 4. The recommended maximum amount to apply per irrigation is one (1) inch and the recommended maximum application rate is 0.4 inch per hour. 5. Keep vegetation on the embankment and areas adjacent to the lagoon mowed annually. Vegetation should be fertilized as needed to maintain a vigorous stand. 6. Repair any eroded areas or areas damaged by rodents and establish in vegetation. 7. All surface runoff is to be diverted from the lagoon to stable outlets. 8. The Clean Water Act of 1977 prohibits the discharge of pollutants into waters of the United States. The Department of Environment, Health, and Natural Resources, Division of Environ- mental Management, has the responsibility for enforcing this law. Thorpe, Ph.D. Acting Director Division of Water Quality October 15, 2001 CERTIFIED MAIL # 7000 2870 0000 1709 6922 RETURN RECEIPT REQUESTED Mr. Barney Rhodes B&C Farm P.O. Box 4067 Surf City, NC 28445 Subject: NOTICE OF VIOLATION B&C Farm Facility Number. 31-90 Duplin County Dear Mr. Rhodes: This is to notify Mr. Barney Rhodes, who holds a non -discharge permit for an animal waste disposal system pursuant to 15A NCAC 2H .0200 and North Carolina G.S.143.215.1, of violations with Animal Waste Permit AWS 310090. On September 19, 2001, Mr. Dean Hunkele from the Wilmington Regional Office of the Division of Water Quality inspected your animal operation and the animal waste management system serving this . operation. The following violations were noted during the inspection: 1. No Crops in Fields Listed in Waste Plan During the inspection it was observed that you were notfollowing your certified animal waste utilization plan. Yourwaste plan indicatesthat Fields A & D are bermuda overseeded with small grain, however, no bermuda is planted in either location. This is a violation of the General Permit under Part 2. Operation & Maintenance Requirements; Section 2. This plan was constructed for your facility to adequately address the amount of animal waste produced by utilizing it on planted/managed cover crops on specific fields. This plan must always be followed without exception. If you would like to change your cropping system, then a technical specialist prior to making any cropping changes must amend your waste utilization plan. 2. Record Keeping During the inspection it was observed that your irrigation records are claiming more acreage than is listed in your waste utilization plan for Field B. The maximum that can be claimed is the amount in the plan. Acreage needs to be reduced in the records to match the waste plan until the amount of Wetted Acres is determined for the farm and the waste plan is revised to match. Wilmington Regional Office 127 Cardinal Drive Extension Wilmington, NC 28405-3845 Phone: 910-395-3900 Fax: 910-350 2004 6.1 Mr. Barney Rhodes October 15, 2001 Page 2 3. Excessive Weeds on Dike Walls During the inspection it was observed that the inner dike walls had excessive weed growth and prevented inspection. This is in violation of the General Permit under Part 2.Operation & Maintenance Requirements; Section 10. Excessive weed growth must be controlled on inner and outerdike wallsto prevent shading and subsequent death of grassed vegetation. It also aids in detecting structural problems such as erosion and rodent or animal burrows during inspections by animal inspectors or the facility owner. More frequent mowing or occasional use of appropriate herbicides are needed for control. Furthermore, your facility was sent a letter in October 2000 requiring that a Wetted Acres Determination be completed within 6 months_ This includes any modifications needed including the installation of additional irrigation equipment, incorporation of new fields, changes in cropping system, etc. To date, no action has been taken to complete this activity and two fields in your waste plan are not planted correctly as mentioned in Item 1. To correct these violations, please submit a detailed Plan of Action to the Wilmington Repional Office of the Division of Water Quality that describes the actions to be taken to address these violations of Animal Waste Permit AWS 310090. The proposed written plan of action must be received by this office within fifteen (15) working days of the receipt of this notice. Upon approval and implementation of the plan, you must notify this office when the corrective actions are complete. Contact your Service Company, county Soil & Water district office. or - county extension office for any assistance they may be able to provide. If the violations are not corrected, the Division of Water Quality may pursue additional avenues to achieve compliance including civil penalties, injunctive relief, or permit revocation. If you have any questions concerning this matter please do not hesitate to contact either. Only the acres that are wetted can be credited in the waste management plan as receiving waste application. Any acreage within the plan that can not be reached by waste application equipment can not be used as part of your plan. An evaluation by Brian Wrenn on 214/99 was made to review the actual number of acres at your facility that receive animal waste during land application. The evaluation of your facility has yielded one of the following two results as indicated by the box marked with an "X". Category 1: ❑ The evaluation of your facility could not be completed due to a lack of information. Please contact your Technical Specialist to assist in providing Dean Hunkele the necessary information to potentially exempt your facility from undergoing a complete wettable acre determination. Please submit this information to Dean Hunkele, at 127 Cardinal Drive Extension, Wilmington, NC 28405-3845, within in 90 days of the receipt of this letter. If you have any questions please contact Dean Hunkele at (910) 395-3900. Therefore, some or all of your fields may be exceeding the allowable loading rates set in your Certified Animal Waste Management Plan. In order to resolve this issue, please contact a designated Technical Specialist to have him or her conduct a Wettable Acre Determination for your facility. The Technical Specialist must be one that has been approved by the Soil and Water Conservation Commission to conduct Wettable Acre Determinations. Many Technical Specialist with the N.C. Cooperative Extension Service, the Soil and Water Conservation Districts, the Natural Resources Conservation Service, and the Division of Soil and Water Conservation have received this special designation. You may also contact a private Technical Specialist who has received this designation, or a Professional Engineer. All needed modifications to your Animal Waste Management System must be made and the Wettable Acres Determination Certification must be returned to DWO within the next 180 days. if the needed modifications are not made and if the form is not returned within the required time, DWQ will be forced to take appropriate enforcement actions to bring this facility into compliance. These actions may include civil penalty assessments, permit revocation, and/or injunctive relief. Once a Wettable Acre Determination has been completed, a copy of the attached Wettable Acre Determination Certification must be submitted to the address listed on the form. Please note that both the owner and the Technical Specialist must sign the certification. A copy of all the Wettable Acre Determination documentation that applies to your Waste Utilization Plan must be kept at your facility. Hampstead NC 28443 Dear Mr. Rhodes: This is to inform you that your completed registration form required by the recently modified nondischarge rule has been received bv_ the Division of Environmental Management (DEM), Water Quality Section. T On December 10, 1992 the Environmental Management Commission adopted a water quality rule which governs animal waste management systems. The goal of the rule is for animal operations to be managed such that animal waste is not discharged to surface waters of the state. The rule allows animal waste systems to be "deemed permitted" if certain minimum criteria are met (15A NCAC 2H .0217). By submitting this registration you have met one of'the criteria for being deemed permitted. We would like to remind you that existing feedlots which meet the size thresholds listed in the rule, and any new or expanded feedlots constructed between February 1, 1993 and December 31, 1993 must submit a signed certification form (copy enclosed) to DEM by December 31, 1997. New or expanded feedlots constructed after December 31, 1993 must obtain sinned certification before animals are stocked on the farm. Certification of an approved animal waste management plan can be obtained after the Soil and Water Conservation Commission adopts rules later this year. We appreciate you providing us with this information. If you have any question about the new nondischarge rule, please contact David Harding at (919) 733-5083. enc: Sincerely, In OA' 4 W, 'M - Steve Tedder, Chief Water Quality Section P.O. I wanted to let you know I have taken care of item 3 by mowing the inner dike walls of my lagoon on 11/5/01. The other items will addressed as depicted by the 10/17/01 Plan of Action letter. This is an update of the current situation at my farm (pictures enclosed). I do not understand why I received an Notice of Violation for these items rather than a Notice of Deficiency since to my knowledge I have never received any prior notices and have been following the rules? Is this a change in normal procedure? I have talked to other producers and they have received Notices' of Deficiencies rather than Violations for the same type of infractions. I do not see the consistency or understand the difference. Vi.iste should be anaivzed before each application cycle and annual soil tests are required if animal wane is being applied. Soil tests should be used to balance the nutrient application amounts with the realistic yields of the crop to be grown.
