Dear Mr. Matthis:
This letter is to inform the Division of Water Quality of what actions are going to be
taken in order to lower the lagoon levels at Coastal Farms 1-3_
1. Lagoon liquids will be transferred to other Prestage Farms lagoons.
2. The transferring method will be to pump and haul.
3. The pump and haul method will consist of honeywagons and tanker trucks.
4. We will start irrigating as weather permits and spray fields dry out.

Dear Mr. Gray:
This letter is to notify you that the Wilmington Regional Office of the Division of Water Quality is
considering submittal of a recommendation for enforcement action to the Director of the Division of Water
Quality. The recommendation concerns the violation of Title 15A of the North Carolina Administrative
Code, Chapter 2, Subchapter 2H, Section .0217(d). On February 11, 1998, Coastal Farms was issued a
Notice of Violation resulting from an inspection on January 27, 1998. On February 26, 1998 and March
13 and March 17, 1998, staff from the Wilmington Office of the Division of Water Quality conducted
follow-up inspections of your animal operation and the lagoon(s) serving this operation. It was observed
that the over -application of waste onto saturated spray fields had resulted in excessive ponding and runoff
of animal waste. These incidents resulted in the discharge of animal waste to waters of the State and is a
violation of your Animal Waste Operation General Permit number: AWS240009.
If you have an explanation for this violation that you wish to present, please respond in writing to
me within ten (10) days after receipt of this Notice. Your explanation will be reviewed and if an enforcement
action is still deemed appropriate, your explanation will be forwarded to the Director with the enforcement
package for his consideration.

You are hereby notified that Coastal Farms, Inc., which has been permitted to have a
nondischarge permit for an animal waste disposal system pursuant to 15A NCAC 211.0217 and G_S
143.215.1, has been found to be in violation of its Animal Waste Permit.
On January 27, 1998, staff from the Wilmington Office of the Division of Water Quality
conducted a follow-up inspection of your animal operation and the lagoons) serving this operation.
It was observed that lagoons 92 and #3 had insufficient freeboard of 8 inches and 6 inches,
respectively.
The Division of Water Quality may proceed to revoke Coastal Farms' permit unless the
following conditions are completed:
1. Immediately eliminate the discharge of wastewater and/or list actions to correct the noted
violation.
2. Make any and all modifications needed to ensure there will be no future discharges.

To remain a permitted facility, all corrective actions must be made within seven (14) days.
Failure to comply with the above conditions will cause the existing animal waste management
system serving your animal operation to be considered in operation without a permit as required by
North Carolina General Statute 143-215.1.
Please be advised that this assessment does not prevent the Division of Water Quality from
taking enforcement actions for this violation or any past or future violations.
When all required corrective actions are complete, please notify this office in writing. If you
have any questions concerning this matter please do not hesitate to contact either Mr. Brian L.
