Lagoon liquids will be transferred to other Prestage Farms lagoons. 2. The transferring method will be to pump and haul. 3. The pump and haul method will consist of honeywagons and tanker trucks. 4. We will start irrigating as weather permits and spray fields dry out. Please contact me should you need additional information. The recommendation concerns the violation of Title 15A of the North Carolina Administrative Code, Chapter 2, Subchapter 2H, Section .0217(d). On February 11, 1998, Coastal Farms was issued a Notice of Violation resulting from an inspection on January 27, 1998. On February 26, 1998 and March 13 and March 17, 1998, staff from the Wilmington Office of the Division of Water Quality conducted follow-up inspections of your animal operation and the lagoon(s) serving this operation. It was observed that the over -application of waste onto saturated spray fields had resulted in excessive ponding and runoff of animal waste. These incidents resulted in the discharge of animal waste to waters of the State and is a violation of your Animal Waste Operation General Permit number: AWS240009. If you have an explanation for this violation that you wish to present, please respond in writing to me within ten (10) days after receipt of this Notice. Your explanation will be reviewed and if an enforcement action is still deemed appropriate, your explanation will be forwarded to the Director with the enforcement package for his consideration. The Division of Water Quality may proceed to revoke Coastal Farms' permit unless the following conditions are completed: 1. Immediately eliminate the discharge of wastewater and/or list actions to correct the noted violation. 2. Make any and all modifications needed to ensure there will be no future discharges. R. Failure to comply with the above conditions will cause the existing animal waste management system serving your animal operation to be considered in operation without a permit as required by North Carolina General Statute 143-215.1. Please be advised that this assessment does not prevent the Division of Water Quality from taking enforcement actions for this violation or any past or future violations.
