There is 364 linear feet of intermittent and 883 linear feet of perennial stream (CH 100) on the subject property. There is 6.57 acres of wetlands and 1.62 acres of open water on site. The enclosed permit application request is for 82 linear feet of permanent intermittent stream impact and 36 linear feet of temporary intermittent stream impact for a road crossing to gain access across the project site. Included in the application is the request to permanently impact 0.353 acre and temporarily impact 0.113 acre of wetlands. The permanent impacts are for infrastructure road construction and fill for one lot. Temporary wetland impacts are necessary during site construction. These areas will be restored and replanted with wetland vegetation once work within the areas are completed. The project requires 8,173 square feet of zone 1 buffer impacts and 7,689 square feet of zone 2 buffer impacts for the one stream road crossing and three storm water pond outlets. The stream on site is an unnamed, intermittent and perennial tributary to Mills Branch which is classified as a "C; NSW" water by the North Carolina Division of Water Resources. A jurisdictional determination has been submitted to the Corps. The Corps conducted a site visit on March 6, 2018. Enclosed are Statements of Availability for 2:1 wetland mitigation credit, 3:1 zone 1 buffer mitigation credit, and 1.5:1 zone 2 buffer mitigation credit from Restoration Systems and RES. A down payment has been made to Restoration Systems to secure the wetland and buffer mitigation credits that they are providing for the project. Stream impacts are limited to one road crossing which is necessary to gain access to high ground across the project. Over 93% of the stream on site has been avoided. Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The engineering design of the project only requires a single stream road crossing. The permanent impacts of this road crossing have been minimized by placement within the intermittent section of stream and in a location with minimal surrounding wetlands. The stream crossing is also placed in a location with little topographical relief where side slopes will be minimal. Wetland impacts have been minimized by intentionally designing the development to avoid the largest areas of wetland as open space and only impacting areas necessary for road construction and one lot preparation. Over 93% of the stream will be avoided. Almost 95% of the wetlands have been avoided. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Construction techniques have been used to minimize and avoid impacts by the placment of roads and the steepness of the side slopes. Many of the roads and lots abut wetlands areas but do not impact wetland areas. By controling the steepness of the side slopes permanent wetland impacts have been greatly reduced.
