We are also requesting a 401 WQC from NCDWR for the above referenced impacts, as well as a Buffer Authorization for 6,138 sf of impacts to Neuse River Riparian Buffers. The project area is ±1.22 acres in size and is located on the east side of Shelley Lake, north of Shelly Lake Park on W. Millbrook Road in Raleigh, Wake County (Latitude: 35.860574°N; Longitude: -78.659053°W). The project is located in the Neuse River basin and onsite waters drain to Shelley Lake/Mine Creek. The Water Quality Classification for Min Creek is C; NSW and the Stream Index Number is: 27-33-14. The cataloging unit for the site is 03020201. Proposed Project The purpose of the proposed project is to realign the existing greenway trail crossing to relocate the greenway and pedestrian bridge outside of the existing sewer easement. Bridge #19 is being relocated because the existing bridge is only -3 If from top of a City of Raleigh sewer line, which will be replaced in the near future. Therefore, the City of Raleigh is relocating a the portion of the greenway trail and Bridge #19 in advance of the sewer replacement in order to prevent the greenway trail from being closed during sewer replacement, as well as eliminate sewer maintenance disturbing the greenway in the future. The proposed project consists of the construction of a new 12 -ft wide x 85 -ft long pedestrian bridge to cross the existing stream and wetland. Additionally, new sections of 10 -ft asphalt greenway trail will be constructed on both sides of the new bridge in order to realign the greenway trail to tie the existing trail to the new bridge location. Your Success. In order to prevent the disruption of greenway traffic during construction, the existing bridge will be left in place. Once construction of the realigned greenway and new bridge, the existing trail and bridge will be demolished and removed, and the disturbed area restored to natural grade and seeded for stabilization. The wetlands will be seeded with a wetland seed mix. During construction, access for equipment and materials from W. Millbrook Road to the project area will utilize the existing culverted greenway crossing of the stream south of the project area in order to stream impacts for a temporary construction crossing (see Bridge 19 Access Exhibit in the Impact Maps). Proiect History Onsite wetlands were delineated by WithersRavenel in May 2017. A Preliminary JD Request packet has been provided as an Appendix in support of the delineation. WR is not requesting issuance of a JD for the proposed project. The stream within the project area is depicted on the Wake Co. Soil Survey and was determined to be intermittent in the field. Therefore, subjectivity to Neuse River Riparian Buffers was conceded, and a formal buffer determination from NCDWR was not requested. Proposed Impacts The proposed impacts consist of 0.07 acres of temporary wetland impacts and 6,138 sf of impacts to Neuse River Riparian Buffers. The demolition and removal of the existing pedestrian bridge will result in 0.04 acres of temporary wetland impacts (Impact 1), 2,335 sf of temporary Zone 1 impacts and 1,548 sf of temporary Zone 2 impacts (Impact 3). The construction of the new pedestrian bridge will result in 0.03 acres of temporary wetland impacts (Impact 2) during construction of the pedestrian bridge. Construction of the greenway trail and pedestrian bridge will result in 1,358 sf of permanent Zone 1 buffer impacts and 897 sf of permanent Zone 2 impacts (Impact 4). Avoidance and Minimization Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and "waters" could be minimized. Wetland impacts have been minimized to only temporary impacts necessary for construction of the new pedestrian bridge and demolition/removal of the existing pedestrian bridge. Stream impacts have been avoided through the use of the pedestrian bridge to cross the stream, as well as utilizing an existing culverted greenway crossing for construction access over the stream to the south of the project area. Upon completion of construction and demolition activities, temporary wetland impact areas will be restored to natural grade and seeded with a wetland seed mix. Temporary buffer impact areas will be restored to natural grade and seeded with a riparian seed mix. Permanent riparian buffer impacts have been minimized by crossing the stream at a perpendicular angle. Mitigation The proposed wetland impacts will be temporary, and therefore wetland mitigation is not proposed. The removal of the existing greenway trail and pedestrian bridge (Impacts 1 & 3) are classified as an "Exempt" activity in the Neuse River Riparian Buffer Rules and therefore, mitigation is not required. The construction of the new greenway trail and pedestrian bridge (Impacts 2 & 4) is classified as an "Allowable" activity in the Neuse River Riparian Buffer Rules and therefore, mitigation is not required. The current request is for 0.07 acres of temporary wetland impacts and 6,138 sf of impacts to Neuse River Riparian Buffers. (see attached maps and PCN for details).
