RO 28458 Duplin County Permit no. f1Cn23181 6 INCIDENT SYNOPSIS -- CASE NO; DV-2007-0001 ENFORCEMENT ACTION 1 CIVIL PENALTIES FARM NAME: Rockfish Farms #1 and 2 PERMIT NO: NCA231816 VIOLATOR NAME: Crystal Davis FACILITY NO: 31-0816 COUNTY: Duplin OFFICE: WIRO CASE BACKGROUND September 6, 2006 — Discharge Notice On September 6, 2006, the WIRO received notice from Premium Standard Farms that animal wastes were being discharged from Rockfish Farms into a field ditch that drains to Taylors Creek (Class C Sw waters). September 7, 2006 - Inspection WIRO inspected the Rockfish Farm and found: N Lagoon #1 freeboard level was at 8 inches (photos 1 & 2) 1► Lagoon #2 freeboard level was at 13 inches (photos 6 & 7) N A pump discharge pipe was in the ditch (photos 3 to 5) N No animal wastes were in the ditch N Premium Standard was removing pigs PHOTO COMMENTS PHOTO NO, COMMEMT . 1 & 2 . Note no stains or bath tub ring on inlet pipes and freeboard marker 3 & 5 1 Li uid in ditch is rainwater not ink animal wastes The Farm Manager, Justin Usher, stated that the waste level in Lagoon #1 was high and he was afraid that the lagoon would overflow and breech the dam. He tried to get assistance from Premium Standard, but got no response. He tried to pump to Lagoon #2, but the pipe was too short. Consequently, Justin Usher pumped an estimated 540,000 gallons of wastes from Lagoon #1 to the field ditch. On September 5, Justin -Usher had reported to the WIRO, freeboards of 14 inches in Lagoon #1 and 15 inches in #2. No samples were taken because there was no waste in the ditch, Pumping wastes to the ditch was intentional, the Farm Manager (Justin Usher) did not deny it, and the decision was the Farm Manager's, not the farm's owner (Crystal Davis). See attached note (undated) from Justin Usher. October 13, 2006 - NOV A NOV was issued.October 13, 2006 citing two violations: 1 • Waste was pumped into a field ditch that discharged into Taylors Creek. 2. The Farm Manager, Justin Usher, certification as an animal wastewater operator is not current. dgl 02/9/2007 _October 23, 2006 - Response to NOV Crystal Davis' response to the NOV was: /► Justin Usher was hired in 2001 and supposedly had an up to date OIC certification. A copy of his certification (dated December 1996) was attached. ►► Justin Usher's ditch pumping was without her knowledge or approval. ►► Justin Usher was fired and replaced by a Farm Manager recommended by Premium Standard. N She has invested money to remedy environmental issues- 2004 — Contracted Triple S Farms to reduce lagoon levels via aerway sprayer. 2005 — Spent $88,000 on a center pivotal irrigation system. Currently - $21,000 to clean ditches and improve drainage. - Purchased an aerway sprayer for $12,000. - $28,000 for water cups to reduce water usage in the houses. - Repaired lagoon influent pipelines. M $33,000 has been lost in hog production as a result of removing all the hogs. N A Public Notice was published in the newspaper; copy attached. ►► A sample of the Lagoon #1 effluent was obtained and data attached. N She is a first grade school teacher with a "school teacher's income". PREVIOUS VIOLATIOINS AND PENALTIES There are five NODs and NOVs, and one penalty. The penalty, in 2004, was for a discharge. The violations were: L July 1997 -- NOD for lagoon erosion and unapproved spray field crops. 2. October 1998 — NOD for N2 over application and unapproved spray field crops. 3. September 2003 — NOV and Recommendation for Enforcement for a discharge, waste ponding, and improper OIC inspection. 4. March 2004 -- $6,978.67 civil penalty (DV-04-002) for the September 2003 violations. Discharge = $4,000 Application Runoff = $1,000 Failure to Inspect Site for Runoff = $1,000 Enforcement Costs = $978.67 Remission = $2,000 Case closed 7/15/2004,@ $4,978.67. 5. 'April 2006 — NOV for failure to submit Annual Certification Form. This was due to storm rainfall of 12", rain two days later of 4", and next day of 1 '/2", for a total of 17 1/2" on site. Lagoon # .1 had a total of 2" before running over at this -time and it was still raining. I called Premium Standard Farms and talked to Jeremy Hill. I explained the problem, but got no response to .problem from anyone. I tried to pump water in the other lagoon, but pipe was too short and if Lkept it there, it would have washed the dike- out of lagoon # 2. I did not know what else to do, I panicked and put the hose in the ditch. The service lady came to farm, heard the pump -running and called her boss. He came to farm and shut off the pump. It had run about 3 hours at low r.p.m. The next day I called DWQ at 7:00 am and left a message. Chester Cobb returned my call at 8:00 am. Box 757 Rose Hill, NC 28458- Subject: Notice of Violation and Recommendation for Enforcement Case No, NOV-2006-DV-0059 Rockfish Farm #1 and 2 Facility Number: 31-816 Duplin County Dear Ms. Davis: This is to notify you of violations to North Carolina General Statute 143-215.1 and to Swine Waste Management System General NPDES Permit NCA200000 issued on April 9, 2003 under Certificate of Coverage NCA231816. On September 7, 2006, staff from the Wilmington Regional Office of the Division of Water Quality inspected the farm due to notification of waste discharge from the integrator and the operator, Mr,- Juston'Usher. The staff observed piping -from a hydrant that led to a field ditch. that drained into Taylors Creek. Taylors Creek is classified as class C Swamp waters of the State within the Cape Fear River. Based on the size of the lagoon and drop in level, it was estimated than about .542,500 gallons of waste was discharged into Taylors Creek. The following violations are noted from the discharge: 1. Waste Discharged into Waters of the State Waste was pumped into a field ditch. that discharged into Taylors Creek. This is in violation of North Carolina General Statute 143-215.1 that states that no person shall make an outlet into the waters of the State' without- having .obtained and abided by the appropriate permit. This is also a violation Condition I.' 1 of NPDES Permit NCA200000 that states ' in part that "Waste shall not reach surface waters or wetlands by runoff, drift, manmade conveyance, direct application, direct discharge or through ditches not otherwise classified as state waters." This is in -violation of Condition No. V. 2 of the NPDES Permit that states, "The Permittee shall designate a certified animal waste management system operator with a valid certification to be in charge of the animal waste management system. The waste management system shall be operated by the OIC or a person under the OIC's supervision." In response to these violations, this office must receive the following information, within fifteen (15) working days of the receipt of this notice: a, A written explanation of the violations and a description of the actions to be taken to prevent the recurrence of these violations. b. A copy of the press release and public notice concerning the discharge. c.• A copy of. the waste analysis that was done for the following parameters: fecal coliform bacteria: five-day biochemical oxygen demand (BOD5); total suspended solids (TSS); total phosphorus as phosphorus; ammonia -nitrogen as nitrogen; TKN as nitrogen; and nitrate. You may wish to contact your County Soil & Water Conservation District Office, County Extension office, a qualified technical specialist, and/or a professional engineer for any assistance they may be able to provide. Be advised that this Office is considering recommending assessment of civil penalties to the Director of the Division of Water "Quality for the above noted violations. Failure to respond may result in more violations. These violations may result in civil penalties of up to $25,000 per violation in accordance with North Carolina General Statute 143- 215.6A(a)(2). You may also be assessed for reasonable costs of the investigation in ,accordance with North Carolina General Statute 143-215.3(a)(9). I had no prior knowledge of Mr. Usher's actions. I am a single woman without hands-on farm experience. I am a first grade teacher at Warsaw Elementary School. I inherited this farm from my family and retained Mr. Usher hi 2001 to oversee and manage it. I was in constant contact with Mr. Usher concerning all major decisions. Mr. Ushers salary allowed him to hire his own employees and make day to day decisions that were in the farm's best interest. Mr. Usher presented a certification and assured me that his certification was up to date and in compliance with all'legal and permit conditions. As a result of the incident on September 6 h, I immediately discharged Mr. Usher. In the winter of 2004,1 was informed that lagoons were in the red and needed immediate attention. I then contacted Mr. Johnny Smith (Tripe S Farms) to quickly reduce the lagoon levels using an aerway. This was extremely expensive,, In November 2005,1 purchased a center pivot at a cost of approximately $80,000.00, fully intending that its use would insure safe waste water levels in the lagoons prevent any run off and give me peace of mind. The actions I have taken in the past and those described in the next paragraphs should prove that I have never resorted to or believed in illegal actions to solve problems. Having limited knowledge, I trusted Mr. Usher would (legally) keep the lagoons at the appropriate levels. I.have always been willing to bear the expense to insure that the farm ran smoothly. Because of Mr. Usher's citation, my farm was completely evacuated'of hogs within one week. I estimate that.the loss of hog production .for approximately 46 days of total down time cost about $33,000.00. The next week Mr. Kenny Barnhill became manager and certified waste operator for Rockfish Farris. He was recommended by Mr. John Sargent, for Premium Standard Farms. Mr. BamEll assures me that as the onsite representative, he will assume full responsibility (including any fines imposed) should a citation ever be imposed. I am confident that the lagoons will be pumped down during the dryer, summer months to prepare for any storms and the winter season. Since the incident, I have consulted with Mr. Billy Houston from Duplin County Soil and Water for advice concerning the spray fields. W. John Kilpatrick has cleaned out all the ditches and installed tile to further drain the land at a total cost of $2 1 ,000.00. I purchased an aerway sprayer for approximately $12,000.00. I have ordered cup waters at a cost of $28,000.00 for all the houses to decrease water usage. Some water lines are being repaired to insure good flow from the houses to the lagoons. Two holding ponds were drained to prevent any possible problems. Coastal bermuda and fescue will be planted on the other fields malting more land available to spray on. ' I have enclosed a copy of the waste analysis report and the press release. In reference to the second violation, I have enclosed a copy of Mr. Justin Usher's wastewater operator's certificate. Mr. Usher panicked on September 6 and made a mistake when he pumped waste in the ditch. However, he carried out this action .entirely without my knowledge or approval and he no longer . works on my farm. When considering this case, I would ask that you make note of who committed the act on September 6`' and the remedial actions I have already taken due to this incident. Moreover, please note that I am primarily a public school teacher with a teacher's income. I have retained my interest in the farm in deference to my family's longstanding ties to the land. Nevertheless; I stand by my responsibility to be a good steward and owner of the land. This was due to storm rainfall of 12", rain two days later of 4", and next day of ' 1 I/z", for a total of 17 1/z" on site. Lagoon # 1 had a total of 2" before running over at this time and it was still raining. -I called Premium Standard Farms and talked to Jeremy Hill. I explained the problem, .but got no response to problem from anyone. I tried to pump water in the other lagoon, but pipe was, too short and if I kept it there, it would have washed the dike out of lagoon # 2. 1 did not know what else to do, I panicked and put the hose in the -ditch. The service lady came to farm, heard the pump running and .called her boss. He came to farm and shut off the pump. It had run about 3 hours at low r.p.m. The next day I called DWQ at 7:00 am and left a message. Chester Cobb returned my call at 8:00 am. DWQ staff observed the pipe in the field ditch that the waste was pumped through. The ditch drains into Taylors Creek. Also, the Facility was in violation of Condition No. V. 2 of NPDES Permit NCA200000 by not having a valid certified animal waste management system operator. A Notice of Violation and Recommendation for Enforcement (Case # NOV-2006-PC-0059) was issued on October 13, 2006 for the discharge and the failure to have a certified operator. It is recommended that appropriate civil penalties be assessed in accordance with G.S. 143- 215:6A(a)(2). It is also recommended that all of the enforcement costs incurred in the investigation be recovered in the amount of $353.46 pursuant to G.S. 143-215.3(a)(9) and G.S. 14313-282.1(b)(8). A service .person with the company heard the pump running.but did not see any application occurring. Company.representatives found waste being pumped into a field ditch and shut the pump off. The following morning Mr. Cobb received a call from the farm manager, Mr. Juston'Usher about the discharge. On September 7, 2006, Mr. Cobb along with Mr. Jim Bushardt inspected the -farm. Upon arriving at the farm, the freeboard level at Lagoon #1 was observed to be eight (8) inches (photos 1 - 2) and the level at Lagoon #2 at thirteen (13) 'inches (photos 6 — 7). The lagoon structures were stable and the dike walls had well -established grass coverage. The pipe was still in the ditch where the animal waste had been pumped (photos 3 — 5). No animal waste was observed in the field ditch upon arrival. The field ditch drains into Taylors Creek. Mr. Usher said that the waste level in Lagoon #1 was at the bottom of the pvc cap on the lagoon marker and that he was afraid that the lagoon might overflow, breeching the dam. He said that he tried to get up with Premium Standard Farms about the high level but received no response. The only call the Wiimington.Regional Office received from Mr. Usher concerning the freeboard levels at Rockfish Farm was on September 5, 2006. At that time, Mr. Usher reported freeboard levels of fourteen (14) and fifteen (15) inches. Premium Standard -had started removing the pigs when we arrived. Farm and/or Company Compliance History:_ Include a copy of CAFO Designation letters, previous NOV's, NOD's previous civil assessments, etc. July 24, 1997 Notice of Deficiency issued for erosion on inner wall and for crops . grown in sprayfields not listed in CAWMP. October 12, 1998 Notice of Deficiency issued for over application of nitrogen to field 3A and for crops planted' in sprayfields not listed in WUP. September 10, 2003 Notice of Violation and Recommendation for Enforcement issued for discharge to Waters of the State, waste ponding and runoff, and improper inspection by OIC. March 22,1004 Civil Penalty assessed for $6,978.67concerning case number. DV- 04-002. Case closed on July 15, 2004 after paying $4,978.67. April 27, 2006 Notice of Violation issued for failure to submit Annual Certification Form by March 1, 2006. Amount of Waste Discharge (if applicable). If amount cannot be estimated, what is the rate of flow reaching surface water. The discharge was estimated to be 542,500 gallons based on the freeboard drop in Lagoon 91. Mr. Usher said the lagoon was around 2 inches and the lagoon was around 8 inches the following day. Sample Results {If applicable) with locations of samples taken noted in relation to the dischar a oint: No samples were taken because by the time we arrived, there was no evidence of waste in the ditch. Violator's degree of cooperation(including efforts to prevent or restore recalcitrance: The farm manager did not deny that he had pumped waste in the ditch. Fish kill observed? YIN If yes, include report from WRC: No fish kill observed at time of inspection. _Mitigating Circumstances: The decision to pump waste in the ditch was the farm manager's decision and not the owner's. Recommendation: The Wilmington Regional Office is recommending assessment of civil penalties to the Director of the Division of Water Quality pursuant to'G.S. 143-215.6A. Include a copy of the previously completed Animal Operations Inspection Form, pictures and site sketch of waste flow if waste is discharged to surface waters. Also include violator's response to Notice of Recommendation for Enforcement, If citing certified plan or permit condition violations, include copies ofpermit or plan. Assessment Factors required to be considered by G.S. 143B-282.1(b): 1. The degree and extent of harm to the natural resources of the State, to the public health, or to private property resulting from violation: Unknown. 2. The duration and gravity of the violation: The pump probably ran for several hours pumping animal waste into the ditch prior to the discharge being discovered by a service person from Premium Standard Farms. 3. The effect on ground or surface water quantity or quality or on air quality: Unknown. 4. The cost of rectifying the damage; Unknown. 5. The amount of money saved by noncompliance: Unknown. 6. C. On September 7, 2006, DWQ staff inspected the farm after having received notification of the discharge of animal wastes into a field ditch. DWQ staff observed the pipe in the field ditch that the waste was pumped through. The ditch drains into Taylors Creek. Taylors Creek is classified as Class C Sw waters of the State within the Cape Fear River Basin. D. Crystal Davis had no valid permit for the above -described activity. E. Condition No. V. 2 of NPDES Permit NCA200000 states ' The Permittee shall designate a, certified animal waste management system operator with a valid certification to be in charge of the animal waste management system. The waste management system shall be operated by .the 'OIC or a person under the OIC's supervision." F. After September 7, 2006, it was learned that there was no valid certified animal waste management system operator for the facility, G. The cost to the State of the enforcement procedures in this matter totaled $353,46 Based upon the above Findings of Fact, I make the following: II. CONCLUSIONS OF LAW: A. Crystal Davis is a "person" within the meaning of G.S. 143-215.6A pursuant to G.S. 143-212(4). B. A permit for an animal waste management system is required by. G.S. 143-215.1. C. Taylors Creek constitutes waters of the State within the meaning of G.S. 143- 215.1 pursuant to G.S. 143-212(6). D. The above -cited discharge constitutes making an outlet into waters of the State for purposes of G.S. 143-215.1(a)(1), for which a permit is required by G.S. 143- 215.1. This is somewhat of a difficult case to know how much to assess given the following: 1) the guy, Juston Usher, who was managing the farm for Ms. Davis is the one who made the decision to pump the waste in the ditch. Ms Davie has not really been involved with the farm. 2) I was not able to get any physical evidence that he pumped waste in the ditch. All I have is the pictures of the pipe in the ditch and a phone call from Jeremy Hill that waste was being pumped in the ditch. 3) No documentation of any environmental impacts. Given that this Facility was fined $6,978.67 in 2003 for a discharge, I would say that this fine would need to be more. You are thinking $12,000 for the discharge or $2,000?? Normal discharge fines are $4,000 to $5,000. The last major discharge I had was"$10,000 for discharging 400,000 gallons at Hendrix Livestock. On August 13, 2003, staff from the Wilmington Regional Office of the Division of Water Quality flew over Rockfish Farms #1 and 2. The staff observed animal waste running off two separate land application sites and flowing into Taylors Creek. Division staff also performed an inspection of the farm and observed animal waste running off the land application sites and flowing into Taylors Creek. Taylors Creek is classified as class C Swamp waters of the State within the Cape Fear River Basin. F. Crystal Davis had no valid permit for the above -described activity. G. Crystal Davis owns and operates the Rockfish Farms #1 and 2, a swine animal operation located west of Rose Hill, NC along SR1101 in Duplin County. B. Crystal Davis was issued Certificate of Coverage NCA231 S 16 under Swine Waste Management System General NPDES Permit NCA200000 issued pursuant to North Carolina General Statute 143-215.1 on April 9, 2003, effective on April 9, 2003, with an expiration date of July 1, 2007 for the operation of a swine waste collection, treatment, storage and application system. C. On September 7, 2006, DWQ staff inspected the farm after having received notification of the discharge of animal wastes into a field ditch. DWQ staff observed the pipe in the field ditch that the waste was pumped through. The ditch drains into Taylors Creek. Taylors Creek is classified as Class C Sw waters of the State within the Cape Fear River Basin. D. Crystal Davis had no valid permit for the above -described activity. E. Condition No. V. 2 of NPDES Permit NCA200000 states "The Permittee shall designate a certified animal waste management system operator with a valid certification to be in charge of the animal waste management system. The waste management system shall be operated by the OIC or a person under the OIC's supervision." F. After September 7, 2006, it was learned that there was no valid certified animal waste management system operator for the facility. G. The cost to the State of the enforcement procedures in this matter totaled $353.46 Based upon the above Findings of Fact, I make the following: H. CONCLUSIONS OF LAW: A. Crystal Davis is a "person" within the meaning of G.S. 143-215.6A pursuant to G.S. 143-212(4). B. A permit for an animal waste management system is required by G.S. 143-215.1. C. Taylors Creek constitutes waters of the State within the meaning of G.S. 143- 215.1 pursuant to G.S. 143-212(6). D. The above -cited discharge constitutes making an outlet into waters of the State for purposes of G.S. 143-215.1(a)(1), for which a permit is required by G.S. 143- 215.1. E. Crystal Davis may be assessed civil penalties pursuant to G.S. 143-215.6A(a)(2) which provides that a civil penalty of not more than twenty-five thousand dollars ($25,000) per violation may be assessed against a person who is required, but fails to apply for or to secure a permit required by G.S. 143-215.1. F. Crystal Davis violated Condition No. V. 2 of NPDES Permit NCA200000 by failing to secure a valid certified animal waste management system operator for the facility. G. Crystal Davis may be assessed- civil penalties pursuant to G.S. 143-215.6A(a)(2) which provides that a civil penalty of not more than twenty-five thousand dollars ($25,000) per violation may be assessed against a person who fails to act in accordance with the terms, conditions, or requirements of a permit required by G.S. 143-215.1. H. The State's enforcement costs in this matter .may be assessed against Crystal Davis pursuant to G.S. 143-215.3(a)(9) and G.S. 143B-282.1(b)(8). I. A service person with the company heard the pump running but did not see any application occurring. Company representatives found waste being pumped into a field ditch and shut the pump off. The following morning Mr. Cobb received a call from the farm manager, Mr. Juston Usher about the discharge. On September 7, 2006, Mr. Cobb along with Mr. Jim Bushardt inspected the farm. Upon arriving at the farm, the freeboard level at Lagoon #1 was observed to be eight (8) inches (photos 1 - 2) and the level at Lagoon #2 at thirteen (13) inches (photos 6 — 7). The lagoon structures were stable and the dike walls had well -established grass coverage. The pipe was still in the ditch where the animal waste had been pumped (photos 3 — 5). No animal waste was observed in the field ditch upon arrival. The field ditch drains into Taylors Creek. Mr. Usher said that the waste level in Lagoon #1 was at the bottom of the pvc cap on the lagoon marker and that he was afraid that the lagoon might overflow, breeching the dam. He said that he tried to get up with Premium Standard Farms about the high level but received no response. The only call the Wilmington Regional Office received from Mr. Usher concerning the freeboard levels at Rockfish Farm was on September 5, 2006. At that time, Mr. Usher reported freeboard levels of fourteen (14) and fifteen (15) inches. Premium Standard had started removing the pigs when we arrived. Mr. Usher said the lagoon was around 2 inches and the lagoon was around 8 inches the following day. Sample Results.(If applicable) with locations of samples taken noted in relation to the discharp,e point: No samples were taken because by the time we arrived, there was no evidence of waste in the ditch. Violator's degree of cooperation (including efforts to prevent or restore) recalcitrance: The farm manager did not deny that he had pumped waste in the ditch. Fish kill observed? Mitigating Circumstances: The decision to pump waste in the ditch was the farm manager's decision and not the owner's. Recommendation: The Wilmington Regional Office is recommending assessment of civil penalties to the Director of the Division of Water Quality pursuant to G.S. 143-215.6A. Include a copy of the previously completed Animal Operations Inspection Form, pictures and site sketch of waste flow if waste is discharged to surface waters. Also include violator's response to Notice of Recommendation for Enforcement. If citing certified plan or permit condition violations, include copies of permit or plan. C. On September 7, 2006, DWQ staff inspected the farm after having received notification of discharge of animal waste into field ditch. DWQ staff observed the pipe in the field ditch that the waste was pumped through. The ditch drains into Taylors Creek. Taylors Creek is classified as Class C Sw waters of the State within the Cape Fear River Basin. D. Crystal Davis had no valid permit for the above -described activity, E. Condition No. V. 2 of NPDES Permit NCA200000 states "The Permittee shall designate a certified animal waste management system operator with a valid certification to be in charge of the animal waste management system. The waste management system shall be operated by the OIC or a person under the OIC's supervision." Based upon the above Findings of Fact and Conclusions of Law, I make the following: 11I. This was due to storm rainfall of 12", rain two days later of 4", and next day of 1 '/z", for a total of 17 '/z" on site. Lagoon # 1 had a total of 2" before running over at this time and it was still raining. I called Premium Standard Farms and talked to Jeremy Hill. I explained the problem , but got no response to problem from anyone. I tried to pump water in the other lagoon, but -pipe was too short and if I kept it there, it would have washed the dike out of lagoon # 2. I did not know what else to do, I panicked and put the hose in the ditch. The service lady came to fann, heard the pump running and called her boss. He came to farm and shut off the pump. It had run about 3 hours at low r.p.m. The next day I called DWQ at 7:00 am and left a message. Chester Cobb returned my call at 8:00 am. The staff observed piping from a hydrant that led to a field ditch that drained into Taylors Creek. Taylors Creek is classified as class C Swamp waters of the State within the Cape Fear River. Based on the size of the lagoon and drop in level, it was estimated that about ,542,500 gallons of waste was discharged into Taylors Creek. The following violations are noted from the discharge: 1. Waste Discharged into Waters of the State Waste was pumped into a field ditch that discharged into Taylors Creek. This is in violation of North Carolina -General Statute 143-215.1 that states that no person shall make an outlet into the waters of the State without having obtained and abided by the appropriate permit. Environmental Regional Supervisor 11 North Carolina Division of Water Quality Wilmington Regional Office 127 Cardinal Drive Extension Wilmington, N.C. 28405 Re: Case No. Nov-2006-DV-0059 Facility Number 31-816 `Duplin County Dear Mr. Stelu-nan, On September 6, 2006 at 9:30 p.m., Mr. Juston Usher (the manager and certified waste operator of Rockfish Farms) called to inform me that he had been confronted by Premium Standard staff with his actions of allegedly pumping waste water into the field ditch on my faun. I had no prior knowledge of Mr. Usher's actions. I am a single woman without hands-on farm experience. I am a first grade teacher at Warsaw Elementary School. I inherited this farm from my family and retained Mr. Usher hi 2001 to oversee and manage it. I was in constant contact with Mr. Usher concerning all major decisions. Mr. Usher's salary allowed him to hire his own employees and make day to day decisions that were in the farm's best interest. Mr. Usher presented a certification and assured me that his certification was up to date and in compliance with all legal and permit conditions. As a result of the incident on September 6`h. I immediately discharged Mr. Usher. In the winter of 2004,1 was infon-ned that lagoons were in the red and needed immediate attention. I then contacted Mr. Johnny Smith (Tripe S Farms) to quickly reduce the lagoon levels using an aerway. This was extremely expensive. In November 2005,1 purchased a center pivot at a cost of approximately $80,000.00, fully intending that its use would insure safe waste water levels in the lagoons prevent any run off and give me peace of mind. The actions I have taken in the past and those described in the next paragraphs should prove that I have never resorted to or believed in illegal actions to solve problems. Having limited knowledge, I trusted Mr. Usher would (legally) keep the lagoons at the appropriate levels. I have always been willing to bear the expense to insure that the farm ran'smoothly. Because of Mr. Usher's citation, my farm was completely evacuated of hogs within one week. I estimate that the loss of hog production for approximately 46 days of total down time cost about $33,000.00. The next week Mr. Kenny Barnhill became manager and certified waste operator for Rockfish Farms. He was recommended by Mr. John Sargent, for Premium Standard Farms. Mr. Barnhill assures me that as the onsite representative, he will assume full responsibility (including any fines imposed) should a citation ever be imposed. I_ am confident that the lagoons will be pumped down during the dryer, summer months to prepare for any storms and the winter season. Since the incident, I have consulted with Mr. Billy Houston from Duplin County Soil and Water for advice concerning the spray fields. Mr. John Kilpatrick has cleaned out all the ditches and installed tile to further drain the land at a total cost of $2 1 ,000.00. I purchased an aerway sprayer for approximately $12,000,00, I have ordered cup waters at a cost of $28,000.00 for al l the houses to decrease water usage. Some water lines are being repaired to insure good flow from the houses to the lagoons. Two holding ponds were drained to prevent any possible problems. Coastal berrnuda and fescue will be planted on the other fields making more land available to spray on. I have enclosed a copy of the waste analysis report and the press release. In reference to the second violation, I have enclosed a copy of Mr. Justin Usher's wastewater operator's certificate. Mr. Usher panicked on September 6 and made a mistake when Ile pumped waste in the ditch. However, he carried out this action entirely without my knowledge or approval and he no longer works on my fann. When considering this case, I would ask that you make note of who committed the act on September 60' and the remedial actions I have already taken due to this incident. Moreover, please note that I am primarily a public school teacher with a teacher's income. I have retained my interest in the farm in deference to my family's longstanding ties to the land. Nevertheless; I stand by my responsibility to be a good steward and owner of the land. This was due to storm rainfall of 12", rain two days later of 4", and next day of 1 1/z", for a total of 17 1/2" on site. Lagoon # 1 had a total of 2" before running over at this time and it was still raining. I called Premium Standard Farms and talked to Jeremy Hill. I explained the problem, but got no response to problem from anyone. I tried to pump water in the other lagoon, but pipe was too short and if I kept it there, it would have washed the dike out of lagoon # 2. I did not know what else to do, I panicked and put the hose in the ditch. The service lady came to farm, heard the pump running and called her boss. He came to farm and shut off the pump. It had run about 3 hours at low r.p.m. The next day I called DWQ at 7:00 am and left a message. Chester Cobb returned my call at 8:00 am.
