Nutrient removal via alum, pre -sedimentation by impoundment using three separate
reservoirs operated in series. Pre -oxidation with chlorine dioxide. Clarification by
coagulation, up -flow clarification or sedimentation, and filtration. Primary coagulant is
ferric sulfate with polymer coagulant aid and pH adjustment as necessary with sulfuric
acid or sodium hydroxide. Water is disinfected with chlorine gas. Zinc-Orth-Phosphate
corrosion inhibitor is applied, as is Hydrofluorosilicic acid, and additional pH adjustment
as necessary with sodium hydroxide.

facility:
Process sludge is dewatered and thickened with polymer. Decant water, filter backwash
waste and any additional process waste waters are stored in two retention ponds typically
operated in series. Stabler plant filter backwash waste is directed to a holding tank
which then feeds into the retention ponds. Calcium thiosulfate is applied as necessary
for residual chlorine removal. Retention ponds gravity flow through a V-notch weir for
flow measurement prior to discharge into the Yadkin River.

WATER TREATMENT PLANT RESIDUALS MANAGEMENT PLAN
GENERAL
The Davidson Water Treatment Plant is a 30 MGD Water Treatment Plant divided into two trains. The
primary train consists of a 15 MGD Super Pulsator/conventional filter facility and the secondary train
consists of a 12 MGD settling basin utilizing lamella plates and sludge collection system/conventional
filters.
Residuals are generated from the plants from two sources: 1) Residuals removed during the
sedimentation phase of the project, and 2) Residual removed by the filter. Listed below are descriptions
for the generation, as well as residual handling:
RESIDUALS GENERATED
15 MGD SUPERPULSATOR PLANT — The treatment process utilizes ferric sulfate and a polymer to
precipitate and coagulate impurities in the raw water supply. The residuals are continuously removed
from the Super Pulsator and pumped to a sludge thickener. The total residuals generated include the total
suspended particles in the water, as well as any precipitant generated through the use of the coagulant
and the polymer.
SUPERPULSATOR FILTERS— Filters are backwashed on a routine interval based upon headloss in the filters.
The headloss is accounted for by any suspended particles that are collected on top of the filters. Backwash
operations remove these particles. The flow from the backwash process goes to the backwash
equalization lagoon prior to any residuals handling.
LAMELLA PLATE SETTLERS — In the conventional water treatment plant, the residuals are settled through
the use of lamella plate settlers. The residuals are removed continuously from the bottom of the
sedimentation basins where they are piped to the sludge thickener.
EXISTING PLANT FILTERS
The backwash operation occurs similar to the filters previously discussed with backwash flow going to the
equalization basins.
RESIDUALS HANDLING SYSTEM
The residuals handling system consists of four basic processes, including backwash equalization, sludge
thickening, sludge dewatering, and decant. As described above, the flow from the backwash operations

are piped to an equalization tank. The residuals are allowed to settle to the bottom of the tank and the
clarified water is decanted to the NPDES discharge in the Yadkin River. Residuals are allowed to
accumulate in the bottom of the equalization tank and periodically removed by pumping and piped to the
sludge thickener.
The thickening operation consists of a round, clarifier type thickener. The residuals that are consistently
removed from the sedimentation processes (Super Pulsator and lamella plate) are piped into the sludge
thickener where they are allowed to settle and thicken on the bottom of the tank. The supernatant is
decanted from the system and piped to the NPDES discharge in the Yadkin River. The thickened residuals
on the bottom of the tank vary in consistency from approximately 1.5% to 4% by volume.
The residuals removed from the thickener and piped to a dewatering system that consists of a drum
thickener. Polymer is added to the influent flow. The residuals are thickened to a consistency of
approximately 30% by volume. The residuals are then allowed to continue drying and are stored on a
concrete pad adjacent to the thickening building. The residuals are periodically removed from the site and
transported to the landfill for final disposal. Any decant from the thickening operation is piped back to the
clarifier type thickener where it is returned to the process.

In response to Case Number LV-2019-0030, I have reviewed the violations and have
provided a response for the violations that occurred in the month of October below.
The first sign of a plant upset occurred in the last week of October. The upset
created heavy solids loading on the membranes decreasing treatment capability. By
November 19th 2018 we had recovered from the upset and had compliant lab results.
Air to the headworks was turned off during the upset, now that the event had pasted
the air was turned back on, by the fourth week in November our Ammonia began to
climb and then our BOD. At the time this occurred we were unaware an unknown
substance had entered the plant, by turning the air back onto the headworks we placed
the unknown substance into suspension which allowed it to enter the aeration zone of
the plant and then the membranes, fouling them to the point of shutdown. The
substance was identified and removed with its discovery on December 3rd 2018. My
first call was to Atlantic Sewage for the removal and my second call was to Robbie
Bullock to immediately notify the State.
In order to remove the substance we had to remove the entire biological mass
that the substance had attached itself to, leaving us to try and reestablish the plant's
organisms in cold temperatures. A total of 72,000 gallons had to be removed at a cost
of 20640.00. A cleaning consultant was brought on site and with his recommendations
a new membrane cleaning system was installed allowing us to heat the cleaning water
to 150 degrees, the temperature recommended by the cleaning consultant's lab; an
additional 2600.00 dollars was spent on specialty cleaners to remove the substance
from the membranes. To date we are still trying to reestablish the plants treatment, the
trend of BOD and Ammonia failures continued from the October upset to current date.
Attached are the most recent sampling results I have received, Ammonia is the only
parameter out of compliance with a 70% removal rate. We are working hard to show a
positive trend and hope to continue to do so.

This letter transmits a Notice of Violation and assessment of civil penalty in the amount of $670.00 ($600.00 civil penalty
+ $70.00 enforcement costs) against Dare County.
This assessment is based upon the following facts: a review has been conducted of the Discharge Monitoring Report
(DMR) submitted by Dare County for the month of October 2018. This review has shown the subject facility to be in
violation of the discharge limitations and/or monitoring requirements found in NPDES WW Permit No. NC0088391. The
violations, which occurred in October 2018, are summarized in Attachment A to this letter.
Based upon the above facts, I conclude as a matter of law that Dare County violated the terms, conditions or
requirements of NPDES WW Permit No. NCO088391 and G.S. 143 -215. 1 (a)(6) in the manner and extent shown in
Attachment A. In accordance with the maximums established by G.S. 143-215.6A(a)(2), a civil penalty may be
assessed against any person who violates the terms, conditions or requirements of a permit required by G.S.
143-215.1(a).

Based upon the above findings of fact and conclusions of law, and in accordance with authority provided by the
Secretary of the Department of Environmental Quality and the Director of the Division of Water Resources, I, Robert
Tankard, Assistant Regional Supervisor, Washington Regional Office hereby make the following civil penalty assessment
against Dare County:

Pursuant to G.S. 143-215.6A(c), in determining the amount of the penalty I have taken into account the Findings of Fact and
Conclusions of Law and the factors set forth at G.S. 143B-282.l(b), which are:
(1) The degree and extent of harm to the natural resources of the State, to the public health, or to private property
resulting from the violation;
(2) The duration and gravity of the violation;
(3) The effect on ground or surface water quantity or quality or on air quality;
(4) The cost of rectifying the damage;
(5) The amount of money saved by noncompliance;
(6) Whether the violation was committed willfully or intentionally;
(7) The prior record of the violator in complying or failing to comply with programs over which the Environmental
Management Commission has regulatory authority; and
(8) The cost to the State of the enforcement procedures.
Within thirty (30) days of receipt of this notice, you must do one of the following:
(1) Submit payment of the penalty, OR
(2) Submit a written request for remission, OR
(3) Submit a written request for an administrative hearing

Payment should be made directly to the order of the Department of Environmental Quality (do not include waiver
form). Payment of the penalty will not foreclose further enforcement action for any continuing or new violation($).

Option 2: Submit a written request for remission or mitigation including a detailed justification for such
request:
Please be aware that a request for remission is limited to consideration of the five factors listed below as they may
relate to the reasonableness of the amount of the civil penalty assessed Requesting remission is not the proper
procedure for contesting whether the violation(s) occurred or the accuracy of any of the factual statements contained in
the civil penalty assessment document. Because a remission request forecloses the option of an administrative hearing,
such a request must be accompanied by a waiver of your right to an administrative hearing and a stipulation and
agreement that no factual or legal issues are in dispute. Please prepare a detailed statement that establishes why you
believe the civil penalty should be remitted, and submit it to the Division of Water Resources at the address listed below.
In determining whether a remission request will be approved, the following factors shall be considered-
(1) whether one or more of the civil penalty assessment factors in NCGS 143B-282. I (b) was wrongfully
applied to the detriment of the petitioner;
(2) whether the violator promptly abated continuing environmental damage resulting from the violation;
(3) whether the violation was inadvertent or a result of an accident;
(4) whether the violator had been assessed civil penalties for any previous violations; or
(5) whether payment of the civil penalty will prevent payment for the remaining necessary remedial actions.
Please note that all evidence presented in support of your request for remission must be submitted in writing. The
Director of the Division of Water Resources will review your evidence and inform you of his decision in the matter of
your remission request. The response will provide details regarding the case status, directions for payment, and
provision for further appeal of the penalty to the Environmental Management Commission's Committee on Civil Penalty
Remissions (Committee). Please be advised that the Committee cannot consider information that was not part of the
original remission request considered by the Director. Therefore, it is very important that you prepare a complete and
thorough statement in support of your request for remission.
In order to request remission you must complete and submit the enclosed "Request for Remission of Civil Penalties,
Waiver of Rich# to an Administrative Hearing and Stipulation of Facts" form within thirty (30) days of receipt of this
notice The Division of Water Resources also requests that you complete and submit the enclosed "Justification for
Remission Reauest."

If you wish to contest any statement in the attached assessment document you must file a petition for an administrative
hearing. You may obtain the petition form from the Office of Administrative Hearings. You must file the petition with
the Office of Administrative Hearings within thirty (30) days of receipt of this notice. A petition is considered filed
when it is received in the Office of Administrative Hearings during normal office hours. The Office of Administrative
Hearings accepts filings Monday through Friday between the hours of 8:00 a.m. and 5:00 p.m., except for official state
holidays. The petition may be filed by facsimile (fax) or electronic mail by an attached file (with restrictions) - provided

EXPLANATION:
Dare County Utilities is asking for remission based off option C: the violation was inadvertent or a result
of an accident (i.e., explain why the violation was unavoidable or something you could not prevent or
prepare for)
A homeowner doing a remodel dumped his reaming paint into the sewer system, the amount of paint is
unknown but it was a large enough volume to coat his tank and to clog the membranes of the
50,000gpd treatment facility. While trying to remove the paint form the membranes, staff inadvertently
created polysaccharides, this occurs when a low pH cleaning solution, a high pH cleaning solution and
organics combine together in the cleaning process. To avoid this the staff should have done a fresh
water flush between the low pH solution and the high pH solution.
