On May 24. 2016. staff of the NC Division of Water Resources (DWR). Water Quality Regional
Operations Section (WQROS), conducted a compliance inspection at your facility and documented permit
condition violations.
As a result of this incident, you are hereby notified that, having been permitted to have a non -discharge
permit for the subject animal waste disposal system pursuant to 15A NCAC 2T Section .1300, you failed
to obtain a current waste analysis and had freeboard discrepancies in accordance with your Certified
Animal Waste Management Plan and the Swine Waste System General Permit No. AWG 100000 that you
are covered to operate under.
Violation 1:
Failure to obtain a current waste analysis for June 2015 irrigation in accordance with the facility's
Certified Animal Waste Management Plan in accordance with Condition 1I1,5. of Swine Waste System
General Permit No. AWG 100000.
On May 24, 2016 the Division documented that the facility failed to obtain a current waste analysis for
irrigation on 6/19115, 6/22/2015, and 6/23/2015.
Required Corrective Action for Violation I. -
Take all necessary additional steps to insure that a current waste analysis is secured within 60 days of ail

Violation 2:
Freeboard records d❑ not correspond with rainfall and irrigation in accordance with the facility's Certified
Animal Waste Management Plan in accordance with Condition I11.5. of Swine Waste System General
Permit No. A W G 100000.
In October of 2015 the lagoon level dropped without any documented irrigation. On 10/18/2015 the
lagoon level was 28 inches and on 10/22/2015 the level was 36 inches.
Required Corrective Action for Violation 2:
Take all necessary additional steps to insure that irrigation is recorded and lagoon levels are recorded
accurately.
You are required to take any necessary action to assure that the above violations do not re -occur in
the future. You are required to provide a written response to this Notice, including any additional
information that you wish to provide related to this incident that you ►Fish for the Division to
consider, within 10 days of receipt of this letter. Please include in your response all corrective actions
already taken and a schedule for completion of any corrective actions not addressed.
Failure to comply with conditions in a permit may result in a recommendation of enforcement action, to

We have noted chronic rainfall events in North Carolina that are historic rainfall totals in some
areas. Thank you for your call regarding the freeboard levels at your facility. On February 5,
2016, staff of the NC Division of Water Resources (DWR), received a call reporting a high
freeboard level of 18 inches in your lagoon.
Please be advised that failure to maintain waste levels in your lagoon/storage ponds in
accordance with the facility's Certified Animal Waste Management Plan and with Condition V.
2. of NC Swine Waste System General Permit could result in other actions being taken by the
Division in response to compliance matters.
Deficiency 1: On February 5, 2016, a lagoon/storage pond level was documented at 18 inches in
lagoon 1. A level of 19.5 inches is the maximum level allowed by your permit and Certified
Animal Waste Management Plan.
Please submit a 30-day Plan of Action for the high freeboard occurrence. Take all necessary
additional steps to insure lagoon levels remain in compliance with Section 2 of your permit.

Please work to ensure that your facility is managed in a way to maintain compliance with permit
and animal waste management plan requirements. Failure to comply with conditions in a permit
may result in a recommendation of enforcement action, to the Director of the Division of Water
Quality who may issue a civil penalty assessment of not more that twenty-five thousand
($25,000) dollars against any "person" who violates or fails to act in accordance with the terms,

This letter is to notify you that the Washington Regional Office of the Division of Water Quality is
considering sending a recommendation for enforcement action to the Director of the Division of Water
Quality. The recommendation concerns violation of conditions in your Swine Waste Operation General
Permit, Certified Animal Waste Management Plan and North Carolina Administrative Code Subchapter
15A NCAC 2-I' .1300.
The referenced facility, Creekside Farms, is located off Honolulu Road in Craven County, North
Carolina. On August 12, 2008, Mrs. Megan StiIley of NC Division of Water Quality conducted an
inspection at your facility noting freeboard discrepancies, failure to submit a sludge plan of action, and
failure to obtain a 2007 soil test. A Notice of Violation was sent on August 12, 2008 and was returned to
DWQ because it was never picked up. DWQ re -sent the Notice of Violation on September 2, 2008 and has
not received a response Irom the facility. The following violations were identified:
I. The facility's freeboard level did not change after rain events totaling over three inches. There
were no corresponding irrigation events to account for the non changing freeboard level. In
accordance with condition III, item 2.a. of your State General Permit, highly visible waste -
level gauges shall be maintained to mark the level of waste in each lagoon/storage pond that
does not gravity feed through a free flowing transfer pipe into a subsequent structure. The
gauge shall have readily visible permanent markings.

2. As of the effective date of this General Permit, the Statute requires that the analysis be conducted
at least annually. The facility failed to obtain a 2007 soil sample. In accordance with
condition Ill, item 4 of your State General Permit, a representative Standard Soil Fertility
Analysis, including pH, phosphorus, copper, and zinc, shall be conducted on each
application field receiving animal waste in accordance with NCGS 143-215.I0C(e)(6).
3. The facility failed to submit a sludge plan of action based on the findings of the December 2007
sludge survey. In accordance with condition III, item 19 of your State General Permit, all
facilities, which are issued a COC to operate under this General Permit, shall conduct a
survey of sludge accumulation in all lagoons within two (2) years of receiving the COC and
every year thereafter. This survey shall include but not be limited to a sketch showing the
depth of sludge in the various locations within each lagoon. This survey frequency may be
reduced if it can be demonstrated to the satisfaction of the Division that the rate of sludge
accumulation does not warrant an annual survey. If the sludge accumulation is such that it
is greater than the volume for which the lagoon was designed or the accumulation reduces
the lagoon's minimum treatment volume to less than the volume for that which the lagoon
was designed, a sludge removal or management plan must be submitted to the appropriate
Division Regional Office within ninety (90) days of the determination. The plan shall
describe removal and waste utilization procedures to be used.
Please provide this office with an explanation of the violations and a copy of freeboard, irrigation,
waste and soil records for 2007-2008 within ten (10) working days from receipt of this Notice to:

recommendation for enforcement action to the Director of the Division of Water Quality.

violations/deficiencies and any other problems that may arise be resolved, as soon as possible. For

This letter is to notify you that facility number 25-50 is in violation of its CAWMP and North
Carolina Administrative Code Subchapter 15A NCAC 2T .1300 for freeboard discrepancies, failing to
submit a sludge plan of action, and failure to obtain 2007 soil test. Megan Stilley from the Washington
Regional Office Division of Water Quality conducted an inspection on August 12, 2008 at your facility
in Craven County noting these violations. The specific violations are as follows:
a In accordance wlth condition III, item 2.a. of your State General Permit, highly visible waste -
level gauges shall be maintained to mark the level of waste in each lagoon/storage pond that does
not gravity feed through a free flowing transfer pipe into a subsequent structure. 1-he gauge shall
have readily visible permanent markings. The facility's freeboard level did not change after rain
events totaling over three inches. There were no corresponding irrigation events to account for
the non changing freeboard level,
In accordance with condition III, item 4 of your State General Permit, a representative Standard
Soil Fertility Analysis, including pH, phosphorus, copper, and zinc, shall be conducted on each
application field receiving animal waste in accordance with N C G S 143-215.10C(e)(6). As of the
effective date of this General Permit. the Statute requires that the analysis be conducted at feast
annually. The facility failed to obtain a 2007 soil sample.

In accordance with condition 111, item 19 of your State General Permit, all facilities, which are
issued a COC to operate under this General Permit, shall conduct a survey of sludge
accumulation in all lagoons within two (2) years of receiving the COC and every year thereafter.
This survey shall include but not be limited to a sketch showing the depth of sludge in the
various locations within each lagoon. This survey frequency may be reduced if it can be
demonstrated to the satisfaction of the Division that the rate of sludge accumulation does not
warrant an annual survey. If the sludge accumulation is such that it is greater than the volume
for which the lagoon was designed or the accumulation reduces the lagoon's minimum treatment
volume to less than the volume for that which the lagoon was designed, a sludge removal or
management plan must be submitted to the appropriate Division Regional Office within ninety
(90) days of the determination. The plan shall describe removal and waste utilization procedures
to be used. The facility failed to submit a sludge plan of action based on the findings of the
December 2007 sludge surrey.
The Permittee shall provide to this office within thirty (30) working days from receipt of this
violation notice a written explanation and a plan that will ensure that the problem does not recur. Your
explanation �,viII be reviewed and be advised that if this violation continues, the Division will send
recommendation for enforcement action to the Director of the Division of Water Quality.
It is very important as the owner and/or the Operator in Charge that the aforementioned
violations./deficiencies and any other problems that may arise be resolved, as soon as possible. For

This letter is to notify you that facility number 25-50 is in violation of its CAWMP and North
Carolina Administrative Code Subchapter 15A NCAC 2H .0217 for over application of nitrogen on the
facilities small grain over seed with a PAN of 100 lbs of nitrogen per acre in February 2006. Megan
Hartwell from the Washington Regional Office Division of Water Quality conducted an inspection on
September 12, 2006 at your facility in Craven County noting nitrogen over application of 0.76 lbs on
fields 1 through 5. The specific violation is as follows:
• In accordance with condition II, item 4 of your State NPDES General Permit, land application
rates shall be in accordance with the CAWMP. In no case shall land application rates exceed the
Plant Available Nitrogen rate for the receiving crop. Facility 25-50 over applied on five small
grain over seeded fields during February 2006 as noted above.

It is very important as the owner and/or the Operator in Charge that the aforementioned
violations/deficiencies and any other problems that may arise be resolved, as soon as possible. For
additional assistance, please contact your Technical Specialist and an Agronomist. If you do plan to
carry over nitrogen applications to the next crop cycle make sure to get it written in the Waste
Management Plan before administering.
The facility was also missing rainfall records from July 2005 through December 2005. Please

Thank you for your recent submittal of the information requested in our letter dated April 16, 2003. We greatly
appreciate the effort that you made in compiling this information and sending it to our Washington Regional Office
by the date required. We also appreciate the fact that you reported the problem with high freeboard to our staff as
required by your permit and worked with our staff to manage the problem once it occurred.
Upon review and consideration of the information submitted, the Washington Regional Office has determined that
no further compliance/enforcement actions will be taken by the Division for these high freeboards.
Also, based on your actions to properly operate your facility, the Division of Water Quality hereby rescinds the
Notice of Violation that was issued to you on April 16, 2003 and replaces it with this Notice of Deficiency.
In the future, please continue to evaluate ways to maintain freeboard levels in the required range (19.5" to 44.7).
These methods include, but are not limited to, water conservation practices, adding additional application sites,
updating your cropping systems, adding additional and/or more flexible application equipment, and maintaining the
lagoon levels at the lowest allowable and appropriate levels throughout the year. Our staff looks forward to
continuing to work with you and your Technical Specialist to evaluate and implement any needed changes to your
system.

On March 21, 2003, a representative of your animal operation informed the Division of
Water Quality (DWQ) that there was inadequate freeboard in the lagoon(s) serving this facility.
This lack of adequate freeboard is in non-compliance with the Certificate of Coverage
issued to this facility on June 22, 2001. In addition to this Notice of Violation (NOV), this non-
compliance is subject to an appropriate enforcement action by DWQ. This action can consist of
one or more of the following: a civil or criminal enforcement action; an injunction; and/or a
requirement to apply for coverage under an individual permit. The action chosen will be based
on complete evaluation of all factors that resulted in the inadequate freeboard; the actions taken
to restore the needed freeboard; and the actions being proposed to prevent the problem from
reoccurring.
To assist us in our review, please provide the Washington Regional Office with an
evaluation of the reasons for the freeboard violation(s) and a strategy to prevent future freeboard
violation(s). This evaluation and strategy must include but is not limited to the following:

On June 14, 2001, 1 conducted an Animal Feedlot Operation Compliance inspection at Creekside Farms in Craven County.
A copy of the 'inspection report is attached for your review.
In general, this inspection included verifying that: (1) the farm has a Certified Animal Waste Management Plan (CA)XFMP) and
the General Permit; (2) the farm is complying with requirements of the State Rules 15 NCAC 2110217, Senate Bill 1217, the
Certified Animal Waste Management Plan and the General Pemnit; (3) the farm operation's waste management system is being
operated properly under the direction of a Certified Operator; (4) the required records are being kept; and that (5) there are no
signs of seepage, erosion, and/or runoff. The following deficiencies were observed during the inspection.
Your Certified Animal VI =e Management Plan records did not include a soil analysis for 2000. in Section 11I.
Monitoring and Reporting Requirements, item number 3 of the General Permit it is a requirement that a soil analysis be
collected annually on each application field receiving animal waste. Further, Section 11. Operation and Maintenance
Requirements, item number 3 requires that time be applied, as needed, to maintain sail pH in the optimum range for crop
production. This information is received from your annual soil analysis.
The IRR-2 forms of the irrigation records for the irrigation activities on Coastal Bermuda for 2001 were incomplete. It is
the responsibility of the Certified Operator in Charge to complete the irrigation records. These records should be
completed as soon as possible, maintained for a period of three years, and readily available for inspection.
It is very important as the owner and the Operator in Charge that you resolve these aforementioned deficiencies and any other
problems that may arise, as soon as possible. Nothing in this letter should be taken as absolving this facility of the
responsibility and liability of any violations that have resulted or may result from these deficiencies.
