Water Quality Regional Operations Section (WQROS), conducted a compliance inspection at your facility and documented permit condition violations. As a result of this incident, you are hereby notified that, having been permitted to have a non -discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2T Section .1300, you failed to obtain a current waste analysis and had freeboard discrepancies in accordance with your Certified Animal Waste Management Plan and the Swine Waste System General Permit No. AWG 100000 that you are covered to operate under. Violation 1: Failure to obtain a current waste analysis for June 2015 irrigation in accordance with the facility's Certified Animal Waste Management Plan in accordance with Condition 1I1,5. of Swine Waste System General Permit No. AWG 100000. On May 24, 2016 the Division documented that the facility failed to obtain a current waste analysis for irrigation on 6/19115, 6/22/2015, and 6/23/2015. Required Corrective Action for Violation I. - Take all necessary additional steps to insure that a current waste analysis is secured within 60 days of ail irrigation events. In October of 2015 the lagoon level dropped without any documented irrigation. On 10/18/2015 the lagoon level was 28 inches and on 10/22/2015 the level was 36 inches. Required Corrective Action for Violation 2: Take all necessary additional steps to insure that irrigation is recorded and lagoon levels are recorded accurately. You are required to take any necessary action to assure that the above violations do not re -occur in the future. You are required to provide a written response to this Notice, including any additional information that you wish to provide related to this incident that you ►Fish for the Division to consider, within 10 days of receipt of this letter. Please include in your response all corrective actions already taken and a schedule for completion of any corrective actions not addressed. Thank you for your call regarding the freeboard levels at your facility. On February 5, 2016, staff of the NC Division of Water Resources (DWR), received a call reporting a high freeboard level of 18 inches in your lagoon. Please be advised that failure to maintain waste levels in your lagoon/storage ponds in accordance with the facility's Certified Animal Waste Management Plan and with Condition V. 2. of NC Swine Waste System General Permit could result in other actions being taken by the Division in response to compliance matters. Deficiency 1: On February 5, 2016, a lagoon/storage pond level was documented at 18 inches in lagoon 1. A level of 19.5 inches is the maximum level allowed by your permit and Certified Animal Waste Management Plan. Please submit a 30-day Plan of Action for the high freeboard occurrence. Take all necessary additional steps to insure lagoon levels remain in compliance with Section 2 of your permit. The recommendation concerns violation of conditions in your Swine Waste Operation General Permit, Certified Animal Waste Management Plan and North Carolina Administrative Code Subchapter 15A NCAC 2-I' .1300. The referenced facility, Creekside Farms, is located off Honolulu Road in Craven County, North Carolina. On August 12, 2008, Mrs. Megan StiIley of NC Division of Water Quality conducted an inspection at your facility noting freeboard discrepancies, failure to submit a sludge plan of action, and failure to obtain a 2007 soil test. A Notice of Violation was sent on August 12, 2008 and was returned to DWQ because it was never picked up. DWQ re -sent the Notice of Violation on September 2, 2008 and has not received a response Irom the facility. The following violations were identified: I. The facility's freeboard level did not change after rain events totaling over three inches. There were no corresponding irrigation events to account for the non changing freeboard level. In accordance with condition III, item 2.a. of your State General Permit, highly visible waste - level gauges shall be maintained to mark the level of waste in each lagoon/storage pond that does not gravity feed through a free flowing transfer pipe into a subsequent structure. The gauge shall have readily visible permanent markings. The facility failed to obtain a 2007 soil sample. In accordance with condition Ill, item 4 of your State General Permit, a representative Standard Soil Fertility Analysis, including pH, phosphorus, copper, and zinc, shall be conducted on each application field receiving animal waste in accordance with NCGS 143-215.I0C(e)(6). 3. The facility failed to submit a sludge plan of action based on the findings of the December 2007 sludge survey. In accordance with condition III, item 19 of your State General Permit, all facilities, which are issued a COC to operate under this General Permit, shall conduct a survey of sludge accumulation in all lagoons within two (2) years of receiving the COC and every year thereafter. This survey shall include but not be limited to a sketch showing the depth of sludge in the various locations within each lagoon. This survey frequency may be reduced if it can be demonstrated to the satisfaction of the Division that the rate of sludge accumulation does not warrant an annual survey. If the sludge accumulation is such that it is greater than the volume for which the lagoon was designed or the accumulation reduces the lagoon's minimum treatment volume to less than the volume for that which the lagoon was designed, a sludge removal or management plan must be submitted to the appropriate Division Regional Office within ninety (90) days of the determination. The plan shall describe removal and waste utilization procedures to be used. Please provide this office with an explanation of the violations and a copy of freeboard, irrigation, waste and soil records for 2007-2008 within ten (10) working days from receipt of this Notice to: Mr. David May Division of Water Quality 943 Washington Square Mall Washington.
