Cowan Farms 425-29 AWS250029 Craven County NOD-2016-PC-0270 Dear Mr. Cowan: On June 3, 2016, staff of the NC Division of Water Resources (DWR), Water Quality Regional Operations Section (WQROS), conducted a compliance inspection at your facility and documented an over application of plant available nitrogen (PAN), As a result of this incident, you are hereby notified that, having been permitted to have a non - discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2T Section .1300, you have been found to have an over application of PAN in accordance with your Certified Animal Waste Management Plan and the Swine Waste System General Permit No, AWG100000 that you are covered to operate under. Deficiency 1: Failure to land apply wastewater in accordance with the facility's Certified Animal Waste Management Plan in accordance with Condition 11.4. of Swine Waste System General Permit No. AWG 100000. On June 3, 2016 the Division documented that the facility over applied PAN on the 2015-2016 small grain overseed. This year a temporary modification to the waste plan was made granting a 100 lb/acre of PAN to the small grain with no split application windows. However, the facility is limited to a total application of 25 lb/acre of PAN during December and January. The facility applied approximately 34.4 lb/acre in December and January on fields 5 and 6. Therefore, this facility has a 9.4 lb/acre over application on the small grain overseed on fields 5 and 6. Please read this inspection and keep it with all other documents pertaining to your annual operation for future inspections. In general, this inspection included verifying that: (1) the farm is complying with requirements of the State Rules 15 NCAC 2H.0217, Senate Bill 1217, the Certified Animal Waste Management Plan and/or General Permit; (2) determine whether the waste utilization plan is based on total or actual wetted acres, (3) the farm operation's waste management system is being operated properly under the direction of Certified Operator; (4) the required records are being kept; (5) there are no signs of seepage, erosion, and/or runoff. The following deficiencies were observed during the inspection(s). cp In accordance with condition III, item 2 of your general permit, you are required to record weekly freeboard levels on forms provided and/or approved by DWQ.
