This Letter is in response to the Notice of Violation letter I received, for the compliance
inspection of my farm on February 20, 2013.
Violation 1:
For land application rates that exceeded the agronomic rate of nutrient of concern for the
receiving crop.
In the future I will monitor the application as it occurs, to insure there is enough PAN left
in the balance.
Violation 2:
Failure to obtain an annual soil analysis.
I have collected samples for 2013, and will collect samples earlier in each year for the
future.
Violation 3:
Failure to obtain a current waste analysis for irrigation events.
In the future I will obtain a waste analysis more regularly. This will insure that there will
always be a 60 day window for any irrigation event.

(APS), conducted a compliance inspection at your facility and noted several violations.
As a result of this incident, you are hereby notified that, having been permitted to have a non -discharge
permit for the subject animal waste disposal system pursuant to 15A NCAC 2T Section .1300, you have
been. found to be in violation of your Certified Animal Waste Management Plan and the Swine Waste
System General Permit No. AWG 100000 that you are covered to operate under.
Violation 1:

There was an over application of nitrogen on the 1294 Coastal Bermuda field. Specifically there was a
10% over application on tract 1 and a 5% over application on tracts 2, 3, and 4.
Required Corrective Action for Violation 1:
In the future track application as it occurs, so you will be aware of the remaining PAN balance. Take all
necessary steps to prevent this from occurring in the future.

This letter is to notify you that facility number 25-17 is in violation of its CAWMP and North
Carolina Administrative Code Subchapter 15A NCAC 2H .0217 for over application of nitrogen on the
facilities small grain over seed with a PAN of 50 lbs of nitrogen per acre in February 2007. Megan
Stilley from the Washington Regional Office Division of Water Quality conducted an inspection on July

violation notice a written explanation and a plan that will ensure that the problem does not recur. Your
explanation will be reviewed and be advised that if this violation continues, the Division will send
recommendation for enforcement action to the Director of the Division of Water Quality.
It is very important as the owner and/or the Operator in Charge that the aforementioned
violations/deficiencies and any other problems that may arise be resolved, as soon as possible. For
additional assistance, please contact your Technical Specialist and an Agronomist. If you do plan to
carry over nitrogen applications to the next crop cycle make sure to get it written in the Waste
Management Plan before administering.

for lagoons/storage ponds must not exceed the level that provides adequate storage to contain a 25
year. 24 hour storm event plus an additional foot of structural freeboard.

Enclosed are copies of my Freeboard, Irrigation, Waste and Soil Records
for 2005-2006 as requested.
In regards to the violations sited in your letter:
1. Lagoon level: Due to the large amounts of rain in excess of 15 + inches
within a two week period that saturated my spray fields, it made the
conditions unfavorable to irrigate.
2. Failed to notify the Washington Regional Office: After learning from my
brother-in-law, who works for me, that Ms. Megan Hartwell had visited by
farm on Saturday September 2, 2006, and also knowing I had a scheduled
inspection with Ms. Pat Hams on September 6, 1 just assumed I did not
need to call. This was definitely a mistake on my part, when in taking
concretion the attention my farm was receiving from the appropriate
officers.

Dear Mr. Rhodes:
On July 5, 2001, l conducted an Animal Feedlot Operation Compliance Inspection at the Rhodes Livestock Fame
in Craven County. A copy of the inspection report is attached for your review.
In general, this inspection is to determine that: (1) the farm has a Certified Animal Waste Management Plan
(CAWMP) and the General Permit (2) the farm is complying with requirements of the State Rules 15 NCAC
2H.0217, Senate Bill 1217, the Certified Animal Waste Management Plan and the General Permit; (3) the farm
operation's waste management system is being operated property under the direction of a Certified Operator, (4)
the required records are being kept; and that (5) there are no signs of seepage, erosion, and/or runoff. The following
deficiencies were observed during the inspection.
The inside and outside of the lagoon dike walls needs to be mowed. Broadleaf weeds are the main vegetation
on the entire dike wall rather than a grass cover as required by the General Permit. The top of the dike wall had
been recently mowed and it was evident that the grass on the top of the dike wall has been shaded out due to
the excessive growth of broadleaf weeds. You indicated during the inspection that you mow once or twice a
year on the outside and inside dike walls, however if is evident that this is insufficient to maintain a grass cover
on the dike walls of the lagoon per the requirements of the General Permit. You are advised to modify your
maintenance of the lagoon structure to maintain compliance with your General Permit and Operation and
Maintenance Plan.
A Your Certified Animal Waste Management Plan records did not include a soil analysis for 2000. In Section ill.
Monitoring and Reporting Requirememts, item number 3 of the General Permit if is a requirement that a soil
analysis be collected annually on each application field receiving animal waste. Further, Section ll. Operation
and Maintenance Requirements, item number 3 requires that lime be applied, as needed, to maintain soil pH in
the optimum range for amp production. This information is received from your annual sail analysis.
It was also noted that the freeboard level for this faci}ity is within compliance of greater than 19 inches. however it
should be considerably lower due to the end of growing season that is approaching and the time of the year with
possible tropical storms and hurricanes with associated heavy rainfall events. The freeboard level should be lowered
as weather & soil conditions permit -

t is very important as the owner and the Operator in Charge that you resolve these aforementioned deficiencies
and any Other problems that may arise, as soon as possible. Nothing in this letter should be taken as absolving
this facility of the responsibility and liability of any violations that have resulted or may result from these
deficiencies.

On July 5, 2001, 1 conducted an Animal Feedlot Operation Compliance Inspection at the Rhodes Livestock Farm
in Craven County. A copy of the inspection report is attached for your review,
In general, this inspection is to determine that: (1) the farm has a CertifFed'Animal Waste Management Plan
(CAWMP) and the General Permit; (2) the farm is complying with requirements of the State Rules 15 NCAC
2H.0217, Senate Bill 1217, the Certified Animal Waste Management Plan and the General Permit, (3) the farm
operation's waste management system is being operated property under the direction of a Certified Operator, (4)
the require, records are bring kept, and that (5) there are no signs of s--page, erosion, and/or runoff. The foliowing
deficiencies were observed during the inspection.
The inside and outside of the lagoon dike walls needs to be mowed. Broadieaf weeds are the main vegetation
on the entire dike wall rather than a grass cover as required by the General Permit. The top of the dike wall had
been recently mowed and it was evident that the grass on the top of the dike wall has been shaded out due to
the excessive growth of broadleaf weeds. You indicated during the inspection that you mow once or twice a
year on the outside and inside dike walls, however it is evident that this is insufficient to maintain a grass cover
on the dike walls of the lagoon per the requirements of the General Permit. You are advised to modify your
maintenance of the lagoon structure to maintain compliance with your General Permit and Operation and
Maintenance Plan -
Your Ceriitred Animal Waste Management Plan records did not include a soil analysis for 2000. In Secction III.
Monitoring and Reportng Requirements, harm number 3 of the General Permit it is a requirement that a soil
analysis be collected annually on each application field receiving animal waste. Further, Section Il. Operation
and Maintenance Requirements, item number 3 requires that lime be applied, as needed, to maintain soil pH in
the optimum range for crop production. This information is received from your annual soil analysis.
It was also noted that the freeboard level for this facility is within compliance of greater than 19 inches, however it
should be considerably lower due to the end of growing season that is approaching and the time of the year with
possible tropical storms and hurricanes with associated heavy rainfall events. The freeboard level should be lowered
as weather & soil conditions permit.
It is very important as the owner and the Operator in Charge that you resolve these aforementioned deficiencies
and any other problems that may arise, as soon as possible. Nothing in this letter should be taken as absolving
this facility of the responsibility and liability of any violations that have resulted or may result from these
deficiencies.
