Violation 1: For land application rates that exceeded the agronomic rate of nutrient of concern for the receiving crop. In the future I will monitor the application as it occurs, to insure there is enough PAN left in the balance. Violation 2: Failure to obtain an annual soil analysis. I have collected samples for 2013, and will collect samples earlier in each year for the future. Violation 3: Failure to obtain a current waste analysis for irrigation events. In the future I will obtain a waste analysis more regularly. This will insure that there will always be a 60 day window for any irrigation event. Megan Stilley from the Washington Regional Office Division of Water Quality conducted an inspection on July 26, 2007 at your facility in Craven County noting nitrogen over application of 12 lbs (24%) on tract 6037 field 3. The specific violation is as follows: In accordance with condition H, item 4 of your State General Permit, land application rates shall be in accordance with the CAWMP. In no case shall land application rates exceed the Plant Available Nitrogen rate for the receiving crop. Lagoon level: Due to the large amounts of rain in excess of 15 + inches within a two week period that saturated my spray fields, it made the conditions unfavorable to irrigate. 2. Failed to notify the Washington Regional Office: After learning from my brother-in-law, who works for me, that Ms. Megan Hartwell had visited by farm on Saturday September 2, 2006, and also knowing I had a scheduled inspection with Ms. Pat Hams on September 6, 1 just assumed I did not need to call. This was definitely a mistake on my part, when in taking concretion the attention my farm was receiving from the appropriate officers. A copy of the inspection report is attached for your review. In general, this inspection is to determine that: (1) the farm has a Certified Animal Waste Management Plan (CAWMP) and the General Permit (2) the farm is complying with requirements of the State Rules 15 NCAC 2H.0217, Senate Bill 1217, the Certified Animal Waste Management Plan and the General Permit; (3) the farm operation's waste management system is being operated property under the direction of a Certified Operator, (4) the required records are being kept; and that (5) there are no signs of seepage, erosion, and/or runoff. The following deficiencies were observed during the inspection. The inside and outside of the lagoon dike walls needs to be mowed. Broadleaf weeds are the main vegetation on the entire dike wall rather than a grass cover as required by the General Permit. The top of the dike wall had been recently mowed and it was evident that the grass on the top of the dike wall has been shaded out due to the excessive growth of broadleaf weeds. You indicated during the inspection that you mow once or twice a year on the outside and inside dike walls, however if is evident that this is insufficient to maintain a grass cover on the dike walls of the lagoon per the requirements of the General Permit. You are advised to modify your maintenance of the lagoon structure to maintain compliance with your General Permit and Operation and Maintenance Plan. A Your Certified Animal Waste Management Plan records did not include a soil analysis for 2000. In Section ill. Monitoring and Reporting Requirememts, item number 3 of the General Permit if is a requirement that a soil analysis be collected annually on each application field receiving animal waste. Further, Section ll. Operation and Maintenance Requirements, item number 3 requires that lime be applied, as needed, to maintain soil pH in the optimum range for amp production. This information is received from your annual sail analysis. It was also noted that the freeboard level for this faci}ity is within compliance of greater than 19 inches. however it should be considerably lower due to the end of growing season that is approaching and the time of the year with possible tropical storms and hurricanes with associated heavy rainfall events. The freeboard level should be lowered as weather & soil conditions permit - i t is very important as the owner and the Operator in Charge that you resolve these aforementioned deficiencies and any Other problems that may arise, as soon as possible. A copy of the inspection report is attached for your review, In general, this inspection is to determine that: (1) the farm has a CertifFed'Animal Waste Management Plan (CAWMP) and the General Permit; (2) the farm is complying with requirements of the State Rules 15 NCAC 2H.0217, Senate Bill 1217, the Certified Animal Waste Management Plan and the General Permit, (3) the farm operation's waste management system is being operated property under the direction of a Certified Operator, (4) the require, records are bring kept, and that (5) there are no signs of s--page, erosion, and/or runoff. The foliowing deficiencies were observed during the inspection. The inside and outside of the lagoon dike walls needs to be mowed. Broadieaf weeds are the main vegetation on the entire dike wall rather than a grass cover as required by the General Permit. The top of the dike wall had been recently mowed and it was evident that the grass on the top of the dike wall has been shaded out due to the excessive growth of broadleaf weeds. You indicated during the inspection that you mow once or twice a year on the outside and inside dike walls, however it is evident that this is insufficient to maintain a grass cover on the dike walls of the lagoon per the requirements of the General Permit. You are advised to modify your maintenance of the lagoon structure to maintain compliance with your General Permit and Operation and Maintenance Plan - Your Ceriitred Animal Waste Management Plan records did not include a soil analysis for 2000. In Secction III. Monitoring and Reportng Requirements, harm number 3 of the General Permit it is a requirement that a soil analysis be collected annually on each application field receiving animal waste. Further, Section Il. Operation and Maintenance Requirements, item number 3 requires that lime be applied, as needed, to maintain soil pH in the optimum range for crop production. This information is received from your annual soil analysis. It was also noted that the freeboard level for this facility is within compliance of greater than 19 inches, however it should be considerably lower due to the end of growing season that is approaching and the time of the year with possible tropical storms and hurricanes with associated heavy rainfall events. The freeboard level should be lowered as weather & soil conditions permit. It is very important as the owner and the Operator in Charge that you resolve these aforementioned deficiencies and any other problems that may arise, as soon as possible.
