As a result of this incident, you are hereby notified that, having been permitted to have a non - discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2T Section .1300, you failed to maintain lagoon banks, conduct a sludge survey, calibrate the irrigation equipment in accordance with your Certified Animal Waste Management Plan and the Swine Waste System General Permit No. AWG100000 that you are covered to operate under. Violation 1: Failure to maintain lagoon banks in accordance with the facility's Certified Animal Waste Management Plan in accordance with Condition 1I.12. of Swine Waste System General Permit No. AWG100000. On April 30, 2018 the Division documented severe erosion and woody vegetation on the lagoon banks. Soil should be added to the eroded areas on the banks. Banks should be seeded with grass and then mulched, Violation 2: Failure to complete a sludge survey in 2017 in accordance with the facility's Certified Animal Waste Management Plan in accordance with Condition 11I.18, of Swine Waste System General Permit No. AWG100000. On April 30, 2018 the Division documented that the facility failed to complete a 2017 sludge survey. Required Corrective Action for Violation 2: Take all necessary additional steps to ensure that a sludge survey is completed every year, unless an extension is granted by the Division, Violation 3: Failure to complete a calibration of your irrigation equipment since 2015 in accordance with the facility's Certified Animal Waste Management Plan in accordance with Condition II.24. of Swine Waste System General Permit No. AWG 100000. On April 30, 2018 the Division documented that the facility failed to complete a calibration of the irrigation equipment. The last calibration was in 2013. Required Corrective Action for Violation 3: Take all necessary additional steps to ensure that a calibration is completed in 2018 and every other year thereafter. You are required to take any necessary action to assure that the above violations do not re- occur in the future. You are required to provide a written response to this Notice, including any additional information that you wish to provide related to this incident that you wish for the Division to consider, within 10 days of receipt of this letter. Please include in your response all corrective actions already taken and a schedule for completion of any corrective actions not addressed. Bush Jr., Chief of the Aquifer Protection Section of the Division of Water Quality (DWQ), make the following: FINDINGS OF FACT: A. Rivers Edge Farm is a corporation organized and existing under the laws of the State of North Carolina. B. Carson Jones owns and operates Rivers Edge Farms, a perrnittedlcertified swine animal feeding operation in Craven County. Mr. Jones was issued Certificate of Coverage NCA225008 under General NPDES Permit NCA200000 for Rivers Edge Farms on March 14, 2003, effective upon issuance, with an expiration date of July 1, 2007, C. Condition No. V. 3 of the "General Conditions" of the General NPDES Perrot states in part that "The maximum waste level in lagoons/storage ponds shall not exceed that specified in the Certified Animal Waste Management Plan (CAWMP). At a minimum, maximum waste level for lagoons/storage ponds must not exceed the level -that provides adequate storage to contain the 25-year, 24-hour storm event plus an additional one (1) foot of structural freeboard." D. Condition No. Ill. 11 e. of the "Monitoring and Reporting Requirements" of the General NPDES Permit requires that the perrnittee shall report by telephone to the appropriate Regional Office as soon as possible, but in no case more than 24 hours following first knowledge of the occurrence of failure to maintain storage capacity in a lagoon/storage pond greater than or equal to that required in Condition V. 3. of the issued permit. E. On December 1, 2006, DWQ observed the level of the facility's lagoon to be into the designed freeboard of the lagoon at approximately fifteen (15) inches. F. The Washington Regional Office had not received notification from Mr. Jones that the waste level exceeded the level specified in the CAWMP. G. Mr. Jones was not previously cited for comparable violations. H. Mr. Carson Jones does not have a valid permit for the above -described activity. I. The cost to the State of the enforcement procedures in this matter totaled $ 273,14. Based upon the above Findings of Facts, I make the following: II. CONCLUSIONS OF LAW: A. Carson Jones is a "person" within the meaning of G. S. 143-215.6A pursuant to G. S. 143-212(4). B. A permit for an animal waste management system is required by G.S. 143-215.1. C. The above -cited failure to maintain the liquid level in the lagoon at the level specified in the CAWMP violated Condition No. V. 3. of the General NPDES Permit. D. The above -cited failure to report by telephone to the appropriate Regional Office as soon as possible, but in no case more than 24 hours following first knowledge of the occurrence of failure to maintain storage capacity in a lagoon/storage pond greater than or equal to that required in Condition No. V. 3 violated Condition No. 111, 11, e. of the General NPDES Permit. E. Mr. Carson Jones may be assessed civil penalties in this matter pursuant to G. S. 143-215.6A(a)(2), which provides that a civil penalty of not more that twenty-five thousand dollars ($25,000.00) per violation may be assessed against a person who is required but fails to act in accordance with the terms, conditions, or requirements of a permit required by G. S. 143-215.1. F. The State's enforcement costs in this matter may be assessed against Mr. Carson Jones pursuant to G. S. 143-215.3(a)(9) and G. S. 143B-282.1(b)(8). G. The Supervisor of the Animal Feeding Operation Permitting Compliance Unit, Division of Water Quality, pursuant to delegation provided by the Secretary of the Department of Environment and Natural Resources and the Director of the Division of Water Quality, has the authority to assess civil penalties in this matter Based upon the above Findings of Facts and Conclusions of Law, I make the following: III. DECISION: Accordingly, Mr. Carson Jones, owner of Rivers Edge Farm is hereby assessed a civil penalty of For violating Condition No. V. 3. of the General NPDES Permit by failing to maintain the liquid level in the lagoon at the level specified in the CAWMP. For violating Condition No. 111. 11. e. of the General NPDES Permit by failing to report by telephone to the appropriate Regional Office as soon as possible, but in no case more than 24 hours following first knowledge of the occurrence of failure to maintain storage capacity in a lagoon/storage pond greater than or equal to that required in Condition No. V. 3 as required by G. This facility, located on the southern side of State Road 1400 in Craven County, began operation in 1995. The facility has the capacity to raise 3672 feeder to finish swine and the overall design for this facility is 495,720 steady state live weight. Report: On December 1, 2006, Ms. Megan Hartwell of NC Division of Water Quality (DWQ) visited the facility to conduct a structural review. Upon inspection the water level in the lagoon was found to be approximately fifteen (15) inches. During the structural review inspection the following was noted: 1) lagoon level observed to be 15 inches in the lagoon and 2) Mr. Jones failed to notify DWQ that lagoon level was above designed freeboard. The lagoon level was determined to be fifteen (15) inches. Penalty assessments are recommended for: 1) failure to notify regional office of elevated freeboard level and 2) high freeboard in designed zone. 2. Other Comments: DWQ conducted a structural review at the beginning of September and found the lagoon level to be at eighteen (18) inches. DWQ took no action against Mr. Jones but it is important for the facility to report high freeboard levels in the future. Section III: Assessment Factors required to be considered by G.S. 143B-282.1(b): The degree and extent of harm to the natural resources of the State, to the public health, or to private property resulting from the violation: The lagoon's structural integrity was the main concern. The lagoon was at a dangerous level and the walls could have breached allowing millions of gallons of hog waste to escape into North Carolina's surface waters. Animal waste has the potential to deplete dissolved oxygen in the affected water body to a point which is harmful to aquatic life. Waste water also contains nutrients which have the potential to spawn algal growth to the point which is harmful to aquatic life. 2. The duration and gravity of the violation: The facili 's freeboard level was not compliant December 1, 2006. Irrigation may not have been performed as necessary. The facility records -show that there was over 100 pounds of PAN on several fields not used over the summer months. 3. The cost of rectifying the damage: The owner could have been better prepared by utilizing all the spray fields more efficiently.. 4. The amount of money saved by noncompliance: Money is saved when better management skills are implemented to improve overall management of the facility, environmentally and productively. 5. A copy of the inspection report is attached for your review. In general, this inspection is to determine that (1) the farm has a Certified Animal Waste Management Plan (CAWMP) and the General Pem* (2) the farm is complying with requirements of the State Rules 15 NCAC 2H.0217, Senate Bill 1217, the Certified Animal Waste Management Plan and the General Permit; (3) the farm operation's waste management system is being operated property, under the direction of a Certified Operator, (4) the required records are being kept; and that (5) there are no signs of seepage, erosion, andlor runoff. The following deficiencies were observed during the inspection_ The vegetation around the lagoon structures needs to be removed and maintained at a manageable level. This is a requirement of this facility's Operation & Maintenance Plan for visual inspections of the lagoon dike walls. The visual inspections are important to monitor the integrity of the lagoon dike walls. See inspection report further comrents. n Hydrant I in the back spray field should be repaired to prevent future discharge problems. A small leak with spray was noted coming from the hydrant. No discharge of animal waste to Waters of the State Was observed. It is very important as the owner and the Operator in Charge that you resolve these aforementioned deficiencies and any other problems that may arise, as soon as possible. A copy of the inspection report is attached for your review. In general, this inspection is to detern-dne that': (1) the farm has a Certified Animal Waste Management Plan (CAWMP) and the General Permit; (2) the farm is complying with requirements of the State Rules 15 NCAC 2H.0217, Senate &111217, the Certified Animal Waste Management Plan and the General Permit; -(3) the farm operation's waste management system is being operated property under the direction of a Certified Operator, (4) the required records are being kept and that (5) there are no signs of seepage, erasion, and/or runoff. The following deficiencies were observed during the inspection. ➢ The vegetation around the lagoon stnctures needs to be removed and maintained at a manageable level. This is a requirement of this facility's Operation & Maintenance Plan for visual inspections of the lagoon dike walls. The visual inspections are important to monitor the integrity of the lagoon dike walls. See inspection report further comments. ➢ Hydrant I in the back spray field should be repaired to prevent future discharge problems_ A small leak with spray was noted coning from the hydrant. No discharge of animal waste to Waters of the State was observed. It is very important as the owner and the Operator in Charge that you resolve these aforementioned deficiencies and any other problems that may arise, as soon as possible. Nothing in this letter should be taken as absolving this facility of the responsibility and liability of any violations that have resulted or may result from these deficiencies.
