Magnolia NC 28453 SUBJECT: NOTICE OF DEFICIENCY Harrells #1 Facility No. 82-400 Permit No. AWS820400 Sampson County To Whom It May Concern: On September 15, 2006 you or staff from your farm notified the Fayetteville Regional Office of the Division of Water Quality, as required by General Permit condition 111.6.e that the freeboard level of the lagoon was less than the minimum required by the General Permit. The liquid level of the lagoon 2 was reported as 18 inches. General Permit condition V.3 states "The maximum waste level in lagoonsistorage ponds shall not exceed that specified in the CAWMP. At a minimum, maximum waste level for lagoons/storage ponds must not exceed the level that provides adequate storage to contain the 25-year, 24-hour storm event plus as additional 1 foot of structural freeboard.' The Division of Water Quality will take no further action for this reported incident at this time. However, if you have not done so, you are asked to please notify this office in writing within 15 days of receipt of this letter as to what date the lagoon was lowered within the specified time frame in which the Plan of Action (POA) allotted. Based on the 2002 compliance record and the information previously submitted, the Division has determined that no further action will be taken at this time for violations previously noted. Thorpe, Ph.D, Acting Director Division of Water Quality You are hereby notified that, having been permitted to have a non discharge permit for the subject animal waste disposal system pursuant to 1 5A NCAC 2H .0217, you have been found to be in violation' of your 2H .0217 Pen -nit. On December 7, 2001, staff from the Fayetteville Regional Office of the Division of Water Quality conducted a routine compliance inspection of the Harrells # 1 swine farm located off of Highway 421 in Sampson Cowi€y. The inspection revealed that a lagoon level of 1 S inches had been recorded in the farm records on 5/3/01. Through a September 17, 2001-Show Cause Meeting, we understand that these freeboard records were obtained from Brox n's of Carolina because no on farm freeboard records had been kept. There was no record that the Regional Office of the Division of Water Quality had been notified that the lagoon level was higher than the compliance boundary of 19 inches. The General Permit condition I1I.6.e. states: " The Permittee shall report by telephone to the appropriate Regional Office as soon as possible, but in no case more than 24 hours following first knowledge of the occurrence of any of the following events: e. Failure to maintain storage capacity in a lagoon/storage pond greater than or equal to that required in Condition V(3) of this General Permit." The Division of Water Quality requests that the following item(s) be addressed: 1. Thorpe, Ph.D. Acting Director Division of Water Quality The Fayetteville Regional Office of the Division of Water Quality has reviewed the information submitted by J&K Farms, during the Show Cause Meeting, on September 17, 2001 for the subject facility. After consideration of the information submitted, this Office has determined that it will not proceed with recommendations to the Water Pollution Control System Operators Certification Commission for further action against you as the Operator In Charge (O1C). This letter is also a reminder of your duties as the OIC for this facility_ These duties are outlined in the North Carolina Administrative Code Title I5A:08F — Certification of Operators of Animal Waste Management Systems, a copy of which was provided to you during the Show Cause Meeting. Please remember that all farm records must be provided for review during any inspection of this facility at the time of inspection. Failure to provide needed records will be considered a violation of the permit. Also, the Fayetteville Regional Office of the Division of Water Quality will have no choice but to recommend action by the Water Pollution Control System Operators Certification Commission if future violations of T15A:08F occur. This letter is also to request additional information regarding the freeboard and irrigation records prop ided for this facility during the Show Cause Meeting. The freeboard records show that this facility was at 18 inches of freeboard on May 3, 2001. There is no record that this office was notified that the facility was in violation of the minimum freeboard level as required by your permit. Typically, one irrigation event cannot lower a lagoon by 10 inches. The Division of Water Quality requests that the additional information provide clarification of the fi-eeboard violation and irrigation record inconsistencies. Please provide this office with a written response to these requests on or before October 31, 2001. OFFICE This letter is in response to your letter dated 8/20/01 concerning NOTICE OF VIOLATION AND SHOW CAUSE MEETING involving Harrells Sow Faun Facility 482-400. This response was originally requested by 9/3/01, but after conversation with Bob Heath & Paul Sherman was extended until 9/21/01. The concerns were corn crop partially planted in field 2, waste samples not analyzed since July 2000 and freeboard levels not recorded since Dec_ 2000_ As requested for this response the farm is: 1- Preparing all fields for required crops 2- Collecting lagoon waste sample timely (Feb 2001, July 2001 and Sept_ 2001 included) 3- Recording freeboard levels weekly and maintaining with farm records 4- Providing one year irrigation records 5- Providing all freeboard and waste analysis records In conclusion I would like to point out that Greer Moore is now our Technical Consultant and we look forward to improved record keeping and we also have Murphy - Brown Technical Specialists scheduled to visit our farms on the week of Sept. 24t3i. (b) These Rules apply to all operators of animal waste management systems that are required to designate an operator in charge as specified by G.S. 90A-47-2(a). These animal waste management systems include those systems that are designed to serve an animal operation as defined by G.S. 143B-215.10B(1). (c) The Certification Commission shall classify animal waste management systems based on the types of structures and nonstructural practices serving a feedlot that provide for the collection, treatment, storage, or land application of animal waste. (c) "Approved training program" means a training program that has been approved by the Certification Commission in cooperation with the Cooperative Extension Service. (d) "Certified operator" means a person who holds a currently valid certification as an animal waste management system operator. (e) "Certification Commission" means the Water Pollution Control System Operators Certification Commission (WPCSOCC) created by G.S. 14313-300. (f) "Contract animal waste management system operator" means any certified animal waste operator who contracts with the ovmer or person in control of an animal operation pursuant to G.S. 90A-47.2(b). (h) "Emergency circumstances" means any extraordinary meteorological event, natural catastrophe, or equipment failure that threatens the integrity of the animal waste management system. (i) "Person under the supervision of an Operator in Charge" means a person who takes directions from the Operator in Charge and who may only land apply animal waste when the Operator in Charge is available for consultation and advice at any time during the application of animal waste. (1) Type A: These animal waste management systems generally include the following structures and nonstructural components that provide for the collection, treatment, storage and land application of animal waste and primarily rely on an anaerobic lagoon and soillplant systems for the treatment of animal waste: anaerobic lagoon; pumps, pipes and associated appurtenances that convey the waste from point of generation to final treatment/disposal site; flushing systems; solids separation equipment; irrigation equipment; and land application site and crops. Type A animal waste management systems are generally used to treat waste generated by nionogastric animals which produce a low -fiber waste. (2) Type B: These animal waste management systems generally include the following structures and nonstructural components that provide for the collection, treatment, storage and land application of animal waste and Primarily rely on soiUplant systems for the treatment of animal waste: dry stacks; solids and slurry collection equipment; storage ponds for the collection of solids and runoff, pumps, pipes and associated appurtenances that convey the waste from point of generation to final Type B animal waste management systems are generally used to treat waste generated by ruminants and other animals which produce a high -fiber waste. (b) Animal waste management systems which include components that are significantly different than the system described in Subparagraph (a)(1) of this Rule shall be evaluated by the Commission, or its designee, to determine if the system is subject to classification in accordance with 1 5A NCAC SC _0102(b). The applicant mill be notified by letter, which will serve as the receipt for the examination fee, of hisiber eligibility and arill be advised of the date, time and place of the examination. In cases where the applicant is ineligible for examination, the applicant will also be notified by letter and advised of the reason for ineligibility. The examination fee will be refunded in the event that the applicant is determined to be ineligible for the examination. Upon notification of ineLgibility, the applicant may request a hearing to be heard by the Certification Conurussion at the next regularly scheduled meeting, relative to the ineligibility. Such requests must be in writing and shall be submitted postmarked at least 30 days prior to the next regularly scheduled mecting. Any applicant who intentionally supplies false information on the application for certification for the purpose of gaining eligibility, will be ineligible for the examination and will forfeit the exarrrination fee. Applicants who have intentionally supplied false information and who have been determined to be ineligible who wish to reapply for certification shall follow the procedure set forth in Rule .0407(d) of this Section. (4) When each applicant receives hisdher examination paper, he/she shall identify themselves by way of a valid driver's license or other form of photo identification satisfactory to the proctor of the examination. (5) Representatives of the Certification Commission or its designee(s), who are supervising the examinations may take appropriate action against applicants; including dismissal from the examination, if the examination policies and procedures are not followed. 4 (b) An examination score of 70 percent or higher shall constitute a passing score. (7) The applicant shall be notified. in Writing only, of the score achieved on the examination by the Certification Commission or its designee. The results of the examination shall be mailed to the address submitted with the application for examination.
