Contact and secure approval from the DWQ prior to transfer of waste to a site not covered in the facility's CAWMP. Operation will be partially or fully depopulated. Garland, North Carolina 28441-8215 Subject: NOTICE OF VIOLATION NOV-2009-PC-0644 Administrative Code 15A NCAC 2H .0217 Marshall Horne Farm, Facility No. 82-381, Permit No. AWS820381 Sampson County Dear Mr. Horne: Dee Freeman Secretary On July 17, 2009, staff of the NC Division of Water Quality (DWQ), Aquifer Protection Section (APS), inspected. the Marshall Horne Farm and the permitted waste disposal system. We wish to thank Mr. Samuel Home, who was present and assisted during the inspection. As a result of this inspection, you are hereby notified that, having been permitted to have a non -discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 21-1 .0217, you have been found to be in violation of your 2H .0217 Permit. Violation 1 : Failure to calibrate the Nvaster system (Permit No. AWS820381, Section 11.24) The permit requires that all waste application equipment must be tested and calibrated at least once every two years. According to the records, the waste system was last calibrated on September 18, 2006, Required Corrective Action for Violation I : Please install the correct spray heads and calibrate the system for flow and uniformity of coverage. You are required to take any necessary action to correct the above violations on or before August 21, 2009 and to provide a written response to this notice by August 28, 2009. Horne: The Animal Feeding Operation Unit of Division of Water Quality's Aquifer Protection Section has completed a preliminary review of your renewal permit application package. Additional information is required before we may continue our review. Please address the following item(s) within 30 (thirty) days of receipt of this letter: Missing Waste Utilization Plan: You were requested to submit two copies of your facility's waste utilization plan (WUP or, nutrient management plan, NMP) that include information on the number and type of animals, amount of waste produced, crop types, and fields along with technical specialist and owner signatures. Our records show portion of waste plan listing animal numbers and waste production is missing in your permit package. Please reference the subject application number when providing the requested information. All revised and/or additional documentation shall be signed, sealed and dated, with two (2) copies submitted to my attention at the address below. Please note that failure to provide this additional information on or before the above requested date may result in your application being returned as incomplete. Please be aware that you are responsible for meeting all requirements set forth in North Carolina rules and regulations. Any oversights that occurred in the review of the subject application package are still the responsibility of the applicant. In addition, any omissions made in responding to the above items shall result in future requests for additional information. Failure to request renewal of your coverage under a general permit within the time period specified may result in a civil penalty. Operation of your facility without coverage under a valid general permit would constitute a violation of NCGS 143-215.1 and could result in assessments of civil penalties of up to $25,000 per day.
