Dear Mr. Godwin:
On September 6, 2000, staff from the Fayetteville Regional Office of
the Division of Water Quality conducted an annual inspection of the Paul
Maguire swine farm located off SR 1214 in Sampson County. The
inspection revealed that the lagoon level was within the required freeboard
(18 inches) and a copy of the Certificate of Coverage and General Permit
were not readily available. In addition, freeboard records were not
available, soil samples had not been collected since 1997, and the irrigation
records were being maintained by field.
The Division of Water Quality requests that the following items be
addressed:
1. Begin lowering the lagoon to the required freeboard level as soon as
weather permits.
2. Obtain a copy of the Certificate of Coverage and General Permit for
the farm records.

3. Begin immediately maintaining lagoon freeboard records in accordance with your
General Permit.
4. Collect soil samples from each field annually and apply the required lime in
accordance with the recommendations for the crop.
5. Begin maintaining irrigation records (IRR -2 forms) by the pull acreage rather than the
field acreage.
Please be advised that this notice does not prevent the Division of Water Quality from
taking enforcement actions for this violation or any past or future violation. Furthermore, the
Division of Water Quality has the authority to levy a civil penalty of not more than $25,000.00
per day per violation.

Contact and secure approval from the Division of Water Quality prior to transfer of waste
to a site not covered in the facility's certified animal waste management plan.
Operation will be partially or fully depopulated.
