On September 1, 2006 you or staff from your farm notified the Fayetteville Regional Office of the Division of Water Quality, as required by General Permit condition 111.6.e, that the freeboard level of the lagoon was less than the minimum required by the General Permit. The liquid level of the lagoon 1 was reported as 16 inches.. General Permit condition V.3 states "The maximum waste level in lagoonslstorage ponds shall not exceed that specified in the CAWMP. At a minimum, maximum waste level for lagoons/storage ponds must not exceed the level that provides adequate storage to contain the 25 -year, 24-hour storm event plus as additional 1 foot of structural freeboard." The Division of Water Quality will take no further action for this reported incident at this time. However, if you have not done so you are asked to please notify this office in writing within 15 days of receipt of this letter as to what date the lagoon was lowered within the specified time frame in which the Plan of Action (POA) allotted. It will also close this event out within your file. The over- application of PAN that was showing in his IRR -2 at the time of inspection was due to him entering the wrong "N" amount from his Waste Analysis Report during the allowable time frame of the date on the analysis. In my review of his records I see no reason as to why the 2/17/06 application made can not be credited toward the Summer Annual (Sudan) due to the fact Mr. Carter did have the crop in the ground within 30 days of that application. I have enclosed the original IRR -2 showing the over -application and a revised IRR -2 showing the 2117/06 application credited toward the Summer Annual (Sudan). I have also enclosed many of the Waste Analysis Reports. This plan provides an estimate of the number of acres of cropland needed to use the nutrients being produced. The plan requires consideration of the realistic yields of the crops to be grown, their nutrient requirements, and proper timing of applications to maximize nutrient uptake. This table provides an estimate of the amount of nitrogen required by the crop being grown and an estimate of the nitrogen amount being supplied by manure other by-products, commercial fertilizer and residual from previous crops. An estimate of the quantity of solid and liquid waste that will be applied on each field order to supply the indicated quantity of nitrogen from each source is also included, A balance of the total manure produced and the total manure applied is included in the table to ensure that the plan adequately provides for the utilization of the manure generated by the operation. At a minimum, maximum waste level for lagoons/storage ponds must not exceed the level that provides adequate storage to contain the 25 -year, 24-hour storm event plus an additional 1 foot of structural freeboard." On your farm, that is a maximum waste level of 19 or 19.5 inches freeboard. The Division of Water Quality will take no further action for this reported incident at this time. Converting from the open style hog house to a closed hog house is going to eliminate storm water from entering the hog houses and filling the lagoon with excess stormwater. This should have a tremendous "positive" impact with being able to better manage lagoon water/levels. Lastly, I emphasized the importance of getting his lagoon level 8 inches below stop pump between June 15th — October 3151, and trying to maintain that level going into hurricane season. I also went over his available PAN rates on all crops, and again emphasized the importance of utilizing those rates during the summer months to get his lagoon level down in preparation for hurricane season and/or a wet winter. It was determined that a discharge had occurred several hours before the inspection due to a blockage in the building drainage system prior to the pump station. The discharge had been contained on-site and did not appear to reach surface waters. Waste application records were adequate, however, the PAN rates and the field numbers did not agree with the certified animal waste management plan (CAWMP). In regard to the deficiencies noted during the inspection, the following actions are requested: 1. Immediately contact an engineer to evaluate the plumbing problems that resulted in the discharge and implement corrections to prevent future discharges. 2.
