Dear Mr. Carter.
On September 1, 2006 you or staff from your farm notified the Fayetteville
Regional Office of the Division of Water Quality, as required by General Permit condition
111.6.e, that the freeboard level of the lagoon was less than the minimum required by the
General Permit. The liquid level of the lagoon 1 was reported as 16 inches.. General
Permit condition V.3 states "The maximum waste level in lagoonslstorage ponds shall not
exceed that specified in the CAWMP. At a minimum, maximum waste level for
lagoons/storage ponds must not exceed the level that provides adequate storage to
contain the 25 -year, 24-hour storm event plus as additional 1 foot of structural freeboard."
The Division of Water Quality will take no further action for this reported incident
at this time. However, if you have not done so you are asked to please notify this office
in writing within 15 days of receipt of this letter as to what date the lagoon was lowered
within the specified time frame in which the Plan of Action (POA) allotted. It will also
close this event out within your file. If you have any. questions concerning this matter,

Dear Mr. Revels,
I recently spoke with you regarding the NoV Mr. Ronnie Carter received on his
82-361 facility due to over application of PAN on his Winter Annual crop. The over-
application of PAN that was showing in his IRR -2 at the time of inspection was due to
him entering the wrong "N" amount from his Waste Analysis Report during the
allowable time frame of the date on the analysis. In my review of his records I see no
reason as to why the 2/17/06 application made can not be credited toward the Summer
Annual (Sudan) due to the fact Mr. Carter did have the crop in the ground within 30 days
of that application. I have enclosed the original IRR -2 showing the over -application and
a revised IRR -2 showing the 2117/06 application credited toward the Summer Annual
(Sudan). I have also enclosed many of the Waste Analysis Reports.

Narrative
Nitrogen Rates for Lynn Haven Soil Types (120 lbs/acre) were grandfatherd from prior NUP developed
1/02/02 by Sampson Soil and Water. Aerway acres were computated by subtracting wetted acres from
total field acres, then deducting requirred set backs (buffers) from remaining acreage to leave allowable
acreage for aerway application (broadcast).

The Waste Utilization table shown below summarizes the waste utilization plan for this operation. This plan provides an estimate of the number of acres of
cropland needed to use the nutrients being produced. The plan requires consideration of the realistic yields of the crops to be grown, their nutrient requirements,
and proper timing of applications to maximize nutrient uptake.
This table provides an estimate of the amount of nitrogen required by the crop being grown and an estimate of the nitrogen amount being supplied by manure
other by-products, commercial fertilizer and residual from previous crops. An estimate of the quantity of solid and liquid waste that will be applied on each field
order to supply the indicated quantity of nitrogen from each source is also included, A balance of the total manure produced and the total manure applied is
included in the table to ensure that the plan adequately provides for the utilization of the manure generated by the operation.

On April 7, 2008, you, or staff from your farm, notified the Fayetteville Regional Office of the Division of
Water Quality, as required by General Permit condition III 13 C. that the freeboard level of the lagoon was less than
the amount required by the General Permit. The liquid level of lagoon #1 was reported as 18 inches. General
Permit condition V 2. states "The maximum waste level in lagoons/storage ponds shall not exceed that specified in
the CAWMP. At a minimum, maximum waste level for lagoons/storage ponds must not exceed the level that
provides adequate storage to contain the 25 -year, 24-hour storm event plus an additional 1 foot of structural
freeboard." On your farm, that is a maximum waste level of 19 or 19.5 inches freeboard.
The Division of Water Quality will take no further action for this reported incident at this time. The
Division recommends that you review your facilities and procedures with the goal of eliminating future high
freeboards, which could lead to mandatory review of your Waste Utilization Plan by a Technical Specialist,
Notices of Violation or monetary penalties.
The Division appreciates your cooperation in self -reporting high freeboards, pumping down lagoon levels,

On December 9, 2009, staff of the NC Division of Water Quality (DWQ), Aquifer Protection Section
(APS) were notified by Greer Moore of a high freeboard level in the lagoon 1. We wish to thank Mrs.
Moore for notifying DWQ of this incident.
As a result of this incident, you are hereby notified that, having been permitted to have a non -discharge
permit for the subject animal waste disposal system pursuant to 15A NCAC 2T Section .1300, you have
been found to be in violation of your Certified Animal Waste Management Plan and the Swine Waste
System General Permit No. AWG 100000 that you are covered to operate under, as follows:
Deficiency I:
Failure to maintain waste levels in your lagoon/storage ponds in accordance with the facility's Certified
Animal Waste Management Plan in accordance with Condition V. 2. of Swine Waste System General
Permit No. AWG 100000,
On December 9, 2009 a lagoon/storage pond level was documented at 18.00 inches in lagoon 1. A level
of 19 inches is the maximum level allowed by your permit and Certified Animal Waste Management
Plan.

Required Corrective Action for Deficiency 1:
DWQ has received a copy of your 30 Day Plan of Action (POA) for the high freeboard occurrence.
Take all necessary additional steps to insure lagoon levels remain in compliance with Section 2 of your
permit.
This is the second NOD in a three year period you are now required to obtain a review of your Waste
Management Plane by a Technical Specialist_ This review must be submitted to the Fayetteville
Regional Office in writing within 60 days of receipt of this NOD. The review must contain any
corrective action taken or proposed to be taken to improve the facility's compliance.
A compliance inspection was done 12/14/2010 and all records were reviewed and the date and time
lagoon I returned to compliance on 0311512010.

Dear Mr. Guyton,
I have performed a technical review of Mr. Ronnie Carter's Waste Management
Plan for facility 82-361. This facility is in the process of converting the open hog houses
to closed, as required by Murphy -Brown's new contract for all Mo. house style growers.
Converting from the open style hog house to a closed hog house is going to eliminate
storm water from entering the hog houses and filling the lagoon with excess stormwater.
This should have a tremendous "positive" impact with being able to better manage
lagoon water/levels.
Lastly, I emphasized the importance of getting his lagoon level 8 inches below
stop pump between June 15th — October 3151, and trying to maintain that level going into
hurricane season. I also went over his available PAN rates on all crops, and again
emphasized the importance of utilizing those rates during the summer months to get his
lagoon level down in preparation for hurricane season and/or a wet winter.

On November 27, 1997, staff from the Fayetteville Regional Office of the Division of Water
Quality inspected the Carter swine facility. It was determined that a discharge had occurred
several hours before the inspection due to a blockage in the building drainage system prior to the
pump station. The discharge had been contained on-site and did not appear to reach surface
waters. Waste application records were adequate, however, the PAN rates and the field numbers
did not agree with the certified animal waste management plan (CAWMP).
In regard to the deficiencies noted during the inspection, the following actions are requested:
1. Immediately contact an engineer to evaluate the plumbing problems that resulted in the
discharge and implement corrections to prevent future discharges.
2. Contact your waste management company in regard to the problems with the
recordkeeping and supply them with a copy of your CAWMP.
Please notify this office in writing on or before January 31, 1998 at the address below as to
the actions taken or proposed to be taken to resolve this deficiency. Nothing in this letter should
be taken as absolving this facility of the responsibility and liability of any violations that have or
may result from these deficiencies.
