Dear Mr. Allen:
On February 9, 2011; staff of the NC Division of Water Quality (DWQ), Aquifer Protection Section
(APS) were notified by Greer Moore of a high freeboard level in the lagoon 1. We wish to thank Mrs.
Moore for notifying DWQ of this incident.
As a result of this incident, you are hereby notified that, having been permitted to have a non -discharge
permit for the subject animal waste disposal system pursuant to 15A NCAC 2T Section .1300, you have
been found to be in violation of your Certified Animal Waste Management Plan and the Swine Waste
System General Permit No. AWG 100000 that you are covered to operate under, as follows:
Deficiency 1:
Failure to maintain waste levels in your lagoon/storage ponds in accordance with the facility's Certified
Animal Waste Management Plan in accordance with Condition V. 2. of Swine Waste System General
Permit No. AWG100000.
On February 9, 2011 a lagoon/storage pond level was documented at 18.00 inches in lagoon 1. A level
of 19 inches is the maximum level allowed by your permit and Certified Animal Waste Management
Plan.

This is the second NOD in a three _,ear period you are now required to obtain a review of your Waste
Management Plane by a Technical Specialist. This review must be submitted to the Fayetteville
Regional Office in writing Nvithin 60 days of receipt of this NOD. The review must contain any
corrective action taken or proposed to be taken to improve the facility's compliance.

SUBJECT: Technical Review for A&P Sow Farm (AWS820339)

Dear Mr. Guyton,
As a result of my technical review of the Nutrient Management Plan, irrigation records,
and the lagoon/rainfall records for A&P Sow Farm it is apparent that better lagoon level
management should have taken place during the past spring/summer months in
preparation of hurricane season and/or a wet winter season. I have recently emphasized
the importance of getting the lagoon levels to stop pump and below between March 151 -
September 30th. I also informed the producer of the time frame to get his lagoon 8"
below stop pump.
A&P Sow Farm lagoon level is currently 36". Producer has been irrigating on his
corn crop and plans to remain pumping on his corn crop through June 30°i. Producer will
start irrigating on his bermuda hay crop as of July 15`. Lastly, I have informed Mr. Allen
of his bermuda hay rates and emphasized the importance of utilizing close to all of the
PAN rates in preparation of the 2011 hurricane and/or a wet winter.
In conclusion, the farm has sufficient amount of land for the needs of the farm. I
also emphasized to the producer that it is important to utilize all irrigation pulls during
the time allowed by his NUP.

On March 21, 2003, a representative of your animal operation informed the Division of
Water Quality (DWQ) that there was inadequate freeboard in the lagoon(s) serving this facility.
This lack of adequate freeboard is in non-compliance with the Certificate of Coverage
issued to this facility on September 5, 1997. In addition to this Notice of Violation (NOV), this
non-compliance is subject to an appropriate enforcement action by DWQ. This action can
consist of one or more of the following: a civil or criminal enforcement action; an injunction;
and/or a requirement to apply for coverage under an individual permit. The action chosen will
be based on complete evaluation of all factors that resulted in the inadequate freeboard; the
actions taken to restore the needed freeboard; and the actions being proposed to prevent the
problem from reoccurring.
To assist us in our review, please provide the Fayetteville Regional Office with an
evaluation of the reasons for the freeboard violation(s) and a strategy to prevent future freeboard
violation(s). This evaluation and strategy must include but is not limited to the following:

Freeboard level records in the lagoon(s) for the past 12 months up to the date of submittal
Spraying records for the past 12 months up to the date of submittal

Cropping system and PAN specified in the CAWMP. If the cropping system was not in
compliance with.the facility's CAWMP, provide details of the cropping system in place
for the past 12 months.
A summary of actions taken to restore the needed freeboard in the lagoon(s) including but
not limited to removal of animals from the site, delay of restocking of animals, pumping
and hauling waste to another site (specify site), securing additional irrigation equipment,
and securing additional spray sites.
A description of water conservation measures in use at the facility and the date(s)
installed.
If the Iagoon level(s) are still in violation of the facility's CAWMP and Permit, provide
an updated Plan of Action as to how the facility will return to compliance.
Provide a detailed description of the actions taken or proposed to be taken to insure that
there are no further freeboard violations at this facility.
This information must be received by the Fayetteville Regional Office at the following
address no later than 10 days following receipt of this letter.

Once this information is received and evaluated by the DWQ staff, a determination will
be made as to the appropriate compliance/enforcement actions to be taken. Each case will be
evaluated on its own merit. The efforts by the owner/producer to notify DWQ of the problem,
efforts made to resolve the problem once identified, and efforts proposed to prevent future
problems will be positive factors in this determination.
Nothing in this letter should be taken as removing from you either the responsibility or
liability for this non-compliance or future cases of non-compliance. If you have any questions
regarding this letter, please do not hesitate to contact our Fayetteville Regional Office Staff at

Thank you for your recent submittal of the information requested in our letter dated April 15,
2003. We greatly appreciate the effort that you made in compiling this information and sending
it to our Fayetteville Regional Office by the date required. We also appreciate the fact that you
reported the problem with high freeboard to our staff as required by your permit and worked with
our staff to manage the problem once it occurred.
Upon review and consideration of the information submitted, the Fayetteville Regional Office
has determined that no further compliance/enforcement actions will be taken by the Division for
these high freeboards.
Also, based on your actions to properly operate your facility, the Division of Water Quality
hereby rescinds the Notice of Violation that was issued to you on April 15, 2003, and replaces it
with this Notice of Deficiency.
In the fixture, please continue to evaluate ways to maintain freeboard levels in the required range.
These methods include, but are not limited to, water conservation practices, adding additional
application sites, updating your cropping systems, adding additional and/or more flexible
application equipment, and maintaining the lagoon levels at the lowest allowable and appropriate.

On April 17, 2002, staff from the Fayetteville Regional Office of the Division of Water Quality, conducted an
annual inspection of the A & P Farm in Sampson County. The inspection revealed that the small grain overseed had
not been removed adequately by grazing in field 6 and could result in the loss of the coastal bermuda grass due to
shading. In addition, the records illustrate an over -application of 7 pounds of plant available nitrogen occurred on field
6.
The Division of Water Quality requests that the following items be addressed:
1. Immediately out and remove the small grain overseed. The overseed should be removed by grazing or
mechanical means prior to seeding to prevent possible loss or stunting of the primary crop (coastal bermuda).
2. Maintain current IRR -2 forms to prevent future over -application of PAN.

Dear Mr. Allen:
The reported malfunction of your irrigation system on March 13,
1999 was investigated by staff of the Fayetteville Regional Office of the
Division of Water Quality. The spill was determined to have been contained
and efforts to recover the spill were deemed to have been appropriate and
adequate to maintain compliance with your General Permit. You indicated in
your five (5) day response letter that the cows possibly caused the
malfunction that resulted in the discharge. The Division recommends in the
future the cows be removed from the waste application field prior to
irrigating or confined to prevent access to the irrigation equipment. No
further actions are deemed necessary at this time.

This letter is to provide you information regarding the
waste spill that occurred at A&P Farms on March 13, 1999.
The spill occurred when the hose connecting the reel to a
hydrant came off while the system was in operation. i had
set the reel for a quick pull in so I could move to a
different location and observed the system in operation for
ten minutes while I was setting the speed for the reel.
There were no problems at start-up. The pipe clamp holding
the connection was not damaged, nor was the hood of the
hydrant broken. There were cattle in the field at the time
and I believe one of them may have stepped on the clamp and
unfastened it.
Our pump has a pressure sensitive cut-off which did shut the
system down as soon as the connection came -loose.
Unfortunately-, water continued to empty out of the
underground pipes because this hydrant is the lowest in the
network.
Some water ponded on the field. The remainder flowed into
our drainage ditch which feeds into a wooded drain on our
property. A small culvert drains our woods under Hwy 411
through another wooded drain which connects to another
system of field ditches.
When we found the spill, the water was in our ditch and
drain. We used a bobcat to haul dirt to the culvert to
prevent waste from leaving our property, and dammed the
drain on the other side of the highway as a precaution. My
wife, Dawn Williamson, then made the required phone calls.
We were told by Mr. Lewis with DWQ to dam the ditch and
contain the waste on our property until we could pump it
back on the land.
Since the weather forecast was calling for rain that evening
and it was too dark to do anything else, we went back to our
side of the culvert and boarded it with plywood then put
more dirt in it so it would have a better chance of holding.
On Sunday morning Bob Heath and Randy Barefoot met at the
farm to help decide what to do next. Some water had left
our side of the highway when I was boarding the culvert but
the dam we made as a precaution held. It was decided that
the water in the lower drain be removed first since the
t
water on our property was being contained by the boarded
culvert.
Sunday was spent on the lower drain and we pumped the drain
on our property Monday. The water from both sites was land
applied. As of this letter, the board has not been removed
from our side of the culvert.
Normally, we do not operate the irrigation equipment while
cows are in the field, but the cattle manager had moved them
in for the rye just ahead of my getting the reel out. If
this situation occurs again, someone will wait in the field
while the reel comes in and keep the cows off the pipes.
Also, we purchased a gasoline pump outfitted to handle
situations of this kind and will be able to begin recovering
the water more quickly than we were able to this time.
