SUBJECT: NOTICE OF DEFICIENCY
R.M. Jackson Farm

Dear Mr. Jackson:
On October 16, I997, staff from the Fayetteville Regional Office of the Division of Water
Quality inspected the R.M. Jackson swine facility. It was observed that animal waste was being
applied on a waste application field during a rain storm from a waste lagoon and that the primary
lagoon had a pipe in the lagoon (previous capped) that would allow waste to enter an excavated
hole behind the lagoon that was not designed by the Natural Resources and Conservation Service
(NRCS). This lagoon had approximately 6 inches of freeboard due to the discharge pipe to the
secondary lagoon being improperly installed. No liquid level markers had been installed in the
lagoons. An area of erosion was identified under the concrete slab at the west end of one of the
houses that could result in failure of the foundation resulting in a discharge of animal waste. In
addition, Mr. Jackson needs to modify his record keeping.
In regard to the deficiencies noted during the inspection, the following actions are requested:
1. Curtail waste application prior to or during a storm event.
2. Consult with the NRCS in regard to removal of the discharge pipe in the primary lagoon
to prevent future discharges into the excavated area behind the lagoon and the repair of the
lagoon to allow for adequate freeboard.
3. Cof,3.24 with a technical specialist in regard to repair of the erosion under the foundation
of the hog house building.

4. Begin immediately maintaining records of waste application by pull or hydrant on the
IRR -2 form for the actual acreage in the pull to prevent overapplication of plant available nitrogen
(PAN) to the crop.
Please notify this office in writing on or before November 21, 1997 at the address below as
to the actions taken or proposed to be taken to resolve this deficiency_ Nothing in this letter
should be taken as absolving .this facility of the responsibility and liability of any violations that
have or may result from these deficiencies. If you have any questions concerning this matter,
