I am responding to the letter I received on July 2, 1998 concerning the farm
Number 82-312, Top Hog Farm. On ,Tune 4, 1998, ponding and runoff was noted on
a follow up inspection for newly sprigged fields. This resulted from two
problems dealing with excessive heat and dryness at this time period.
First: We, my employees and I, were trying to keep the new
fields wet enough to seed in a good established cover
crop of new sprigs an sandy land. Due to the excessive
heat and slight but steady breeze, we had slowed the
reel down for better penetration of the soil, as well as
to allow time to get back to that section of the field,
due to the size of the fields being sprayed.
Second: We were moving equipment from one spot to another in a
more hasty manner which resulted in the second problem:
damage to the equipment. The damage was a kink in the
hose on the reel, which came from pulling out into the
field to fast. My employees did not understand that the
friction of moving water would eventually rub a hole in
this type of hose, if there was a kink in it. I
proceeded to explain hydraulic engineering to them so
this would not be considered as a problem in the future.
They said they checked the line after the kink happened
and there was no leak when they ran the system.
In resolving the problems, we attacked the most threating first. Due to the
imminent danger, if rain came, of further run off, I contacted an excavator when
was hired. By 11:00am, the day I received first notice from Scott, the problem
on the ditch was handled. We removed the waste, dredged the ditch and built up
a bream along the side of the ditch to protect it incase of heavy rain. We
discussed coming back and leveling the field away from the ditch, once the field
had dried out. This should be accomplished within the next three weeks, weather
permitting. In resolving the problem of the equipment, the hose has been
spliced, as should have been done on a kink and the speed of the reel has been
increased to aid in preventing the possibility of runoff.

Dear Mr. McLamb:
On June 4, 1998, staff from the Fayetteville Regional Office of the
Division of Water Quality responded to a referral by the Division of Soil and
Water at the Top Hog Farm located in Sampson County. The referral was
due to animal waste which had ponded in the waste application field and had
entered a ditch adjacent to the field.
The investigation revealed that waste had been allowed to pond in a
low area in the field and that said waste had run-off into the ditch. However,
the waste was contained in the ditch and had not left the property.
In regard to the deficiency noted during the inspection, the following
action is requested.
I. Irrigate in a manner so that waste does not run off the application
field.

Dear Mr. McLamb:
You are hereby notified that, having been permitted to have a non -
discharge permit for the subject animal waste disposal system pursuant to
15A NCAC 2H .0217, you have been found to be in violation of your
211.0217Permit.
On December 22, 1999, staff from the Fayetteville Regional Office of the
Division of Water Quality inspected the Top Hog swine facility. It was
observed that the lagoon level was less than required (14 inches), no winter
crop was established, and one of the discharge pipes was broken at the
lagoon bank. In addition, the General Permit and Certificate of Coverage
for the facility were not available.
The Division of Water Quality request that the following items be
addressed:
1. Lower the lagoon to the required level on a suitable crop as soon as
weather permits.
2. Consult with a technical specialist in regard to the evaluation of the
crop (rye overseed) to determine if an adequate stand exists or if
drilling is required.

4. Repair the broken discharge pipe to prevent further erosion of the lagoon liner and
consult with a technical specialist for repair guidance.
Failure to comply with the above conditions may result in the facility's General Permit being
revoked and being required to obtain an individual non -discharge permit for the facility.
Please be advised that this notice does not prevent the Division of Water Quality from taking
enforcement actions for this violation or any past or future violation. Furthermore, the Division
of Water Quality has the authority to levy a civil penalty of not more than $25,000.00 per day per
violation.
Please notify this office on or before February 14, 2000 at the address on the letterhead
regarding actions taken or planned. If you have any questions concerning this matter, please do

In reference to the NOV for Top Hog Farm, Facility #82-312,
item #2.
Mr. McLamb has consulted with our office regarding the stand
of rye overseed. There has been some growth of the rye
since the December visit by your office which would indicate
that the winter crop was planted.
We have found by site visits to various farms that the
initial establishment of this year's winter crop (overseed
and grain) has been below par. Nutrient levels in the soil
at planting had been compromised by heavy rain. Most
farmers have not been able to apply enough nitrogen via
lagoon effluent to get a good start. Just as weather and
field conditions began to allow some pumping, there was a
long freeze along with the extra water from snow.
Broadcast planting of overseed is an allowed practice and
has been successful at this site prior to this season. The
condition of all overseeded pasture, drilled or broadcast,
is much the same everywhere.

You are hereby notified that, having been permitted to have a non discharge permit for the subject animal
waste disposal system pursuant to 15A NCAC 2H.0217, you have been.found to be in violation of your 2H
.0217 Permit.
On March 27, 2001, staff from the Fayetteville Regional Office of the Division of Water Quality
performed a lagoon check of the Top Hog Farm located in Sampson County. The inspection revealed that the
freeboard level of the lagoon was sixteen to seventeen inches, which is less than the minimum required in
the General Permit for this facility. The General Permit condition Ill.6.e. states: "The Permittee shall report
by telephone to the appropriate Regional Office as soon as possible, but in no case more than 24 hours
following first knowledge of the occurrence of any of the following events: e. Failure to maintain storage
capacity in a lagoon/storage pond greater than or equal to that required in Condition V(3) of this
General Permit." A review of Regional records reveals that no report had been made concerning the high
freeboard.
The Division of Water Quality requests that the following item(s) be addressed:
1. Lower the lagoon to the required level as specified by your lagoon design on a suitable crop and at
agronomic rates.
2. Notify this office when your facility is back in compliance with the required freeboard.
3. Submit a Plan of Action detailing how you plan to lower the lagoon to the required freeboard.
4. Submit the freeboard records for the past twelve months.
5. Submit irrigation records for the past twelve months.
6. Submit a copy of the current Certified Animal Waste Management Plan for this facility.

This letter is to aid you in the understanding of my decisions on my
farm and wiht the calculations of the 30 -day PoA
With respect to the lagoon level being at or near the 20' mark, I was
trying to maintain a minimal pumping due to the exceptionally dry
season. This would aid my future decision on cost $ conversions of
covering my lagoon to prevent pumping rainfall compared to actual
cost of pumping. Covering my lagoon is my first objective after
being relieved of farm debt. This cover will reduce pumping and
reduce air quality concerns. Both issues are in the publics and my
interest of protecting the environment while watching cost closely.
On the night of March 26, two water lines in the front right pens of
two houses were found the next morning off of the water pipes.
These full 314" flows of water filled my lagoon very quickly. Weather
was the reason no pumping started right then. If the weather had
permitted, we would have had the lagoon back down the next day.
With respect to the 30 -day PoA forms you sent me, I carried them
straight to the MRCS office for the conversion factors and other
related numbers. My production of organic nutrients is rated in tons
and your forms want it in cubic feet then gallons. At first, the form
was filled out as printed, but the office and I noted discrepency in
yearly, monthly, and daily numbers being crossed over each other.
Thus, I broke down all numbers to daily for closer calculations to
actual figures.
Also on a related note, with respect to rainfall over evaporation, my
barns have a greater evaporation due to the cubic foot of each
animal. In my barns, the animals rush to the flush gutters getting
wet, then dry off by evaporation each time the system flushes during
the day. Thus, the surface area of my pigs (2400), will be added to
the calculations with that of the surface area of the lagoon. This will
increase the rate of water removed from my lagoon. Also, fans in
the houses can increase the drying rate on the pigs surface area
when they are used to cool the pig environment.

routine compliance inspection of the above referenced facility in Sampson County. The inspection revealed that
the waste application fields had a weak stand of coastal bermuda due to extensive competition from weeds. The
lagoon banks were overgrown with vegetation and not accessible for inspection. It was also noted that winter
applications were made using the 100 lb/acre PAN rate and guidelines, but the WUP was written for 50 lb/acre.
The Division of Water Quality requests that the following item(s) be addressed:
1. Spray waste application fields to control weeds. Harvest hay from application fields and inspect the coastal
bermuda stand and resprig where necessary.
2. Keep lagoon banks mowed to allow for inspection for erosion and rodent damage.
3, Amend WUP to include 100 Ib/acre PAN rate for winter applications.
Failure to comply with the above conditions may result in the facility losing its General Permit and being

Subject: Top Hog Farm Notice of Deficiency Facility No. 82-312
Item 1: Weed Control - On our farm in the past we have normally used hay
cutting to control our weed problems, but recent economic circumstances have forced us
to use outside hay cutters. These outside hay people don't cut as often as we use to.
Thus, we now are having to change our farm practices such as spraying pesticides to meet
the needs of our farm. Immediately after the cutting we will spray 2-4-D for the larger
weed control. Then if money allows we will follow up with "MSMA" or "Allie" for
competitive grasses. Then next spring in March preferably, we will use "Atrozeene" for
pre -emergence control of the seeded weeds.
Item 2: Mow Lagoon Banks - We have currently mowed the inside slope of the
lagoon. We discussed this matter on the day of inspection that my side cutting bush hog
needed an $18 gate valve replaced so that we would not leak out the $60 hydraulic fluids
onto the ground as we cut the banks. We had addressed this problem within the week of
the inspection. Also note that the outside slopes of the lagoon had been kept cut prior to
the inspection with a rear mount bush hog.
Item 3: Amended WUP to 100# / acre PAN for winter application - On this
matter, Mr. Paul and I both could not find the supplemental plan in my file box. So 1
proceeded checking all of my recorded locations to see if the plan had been misplaced.
After no success looking elsewhere. I proceeded directly to the Sampson County
Agriculture office for their assistance in the amended plan. Knowing that we had in the
past we had already addressed the 1001b./acre rates for the appropriate farms under my
direction we looked through their files first before rewriting another plan. Without
success we proceeded on the amendment. Matthew Barefoot took time out of his busy
schedule to address this issue as soon as I showed him your letter. He said on our first
visit weeks prior to receiving the letter that if a letter came from Paul that they would then
write the amended plan and he did so as he said promptly.
Closing: 1 apologize for any inconvenience that my shortcomings may have caused
you. I am currently trying to address these issues ASAP to try to keep my farms in good
working order. Thank you for pointing out the areas that need improvement on my farms.
