Facility No. 82-270 Sampson County Permit No. NCA282270 Dear Mr. Scronce: Alan W_ Klimek, P.E. Director Division of Water Quality You are hereby notified that, having been permitted to have a National Pollutant Discharge Elimination (NPDES) permit for the subject animal waste disposal system pursuant to N. C. General Statutes 143-215 et seq. and Section 402 of the Clean Water Act, you have been found to be in violation of your NPDES Permit. Violation 1: Failure to apply animal waste at rates in accordance with your permit and Certified Animal Waste Management Plan: (Permit No. NCA282270 Section 2 condition 4.) On March 15, 2006, a routine compliance inspection revealed waste application outside of the bermuda window on pulls 2B, 3A, 3B and 4. Moving these to your winter rye puts your PAN application over by more than 20%. The Division of Water Quality requests that, in addition to the specified corrective action plan above, please submit the following items on or before June 25, 2006 unless another time frame is indicated below: 1. Please have the OIC for this farm include an explanation as to how this violation occurred. 2_ Please have the OIC include a list of steps that will be taken to prevent this violation from occurring in the future. Please be advised that this notice does not prevent the Division of Water Quality from taking enforcement actions for these violations or any past or future violation. Furthermore, the Division of Water Quality has the authority to levy a civil penalty of not more than $25,000.00 per day per violation. In all of the previous nutrient management plans for this farm the application window was March — October. Due to an over sight of the technical specialist the plan was written with a March — September window and the OIC was not notified. The OIC and technical specialist have reviewed the existing plan in order to prevent any future reoccurrences. Also, the third party record keeper will notify the OIC when 50% of the PAN has been met to prevent over applying. The application amount of PAN was not over applied for coastal bermuda on any pull, however applications did occur outside March — September window. Bermuda hay was harvested after the last application in October and rye was drilled after the harvest. STEVENS DIRECTOR Larry Scronce 1301 Edmund Matthis Rd Clinton, NC 28328 SUBJECT: NOTICE OF DEFICIENCY Larry Scronce Farm Facility No. 82- 270 Sampson County Dear Mr. Scronce: On November 16,1999, staff from the Fayetteville Regional Office of the Division of Water Quality conducted a routine inspection of your swine facility located in Sampson County. The Certificate of Coverage (COC) and General Permit were not on the farm site for review. General Permit condition 1.4 states that "A copy of this General Permit, COC, certification forms, lessee and landowner agreements, and the CAWMP shall be readily available at the farm (stored in places such as the farm residence, office, outbuildings, etc.) where the animal waste management activities are being conducted for the life of this permit.". It was also noted that the freeboard levels were not being maintained weekly. General Permit condition 111.2 states that Waste lagoon and storage pond levels shall be recorded weekly on forms supplied or approved by the DWQ.". As noted last year, one field (Field #3, Tract #7666) was used for waste application that is not a designated field to receive waste according to the Certified Animal Waste Management Plan (CAWMP). The Division of Water Quality requests that the following items be performed: 1. Maintain a copy of the COC and the General Permit on the farm site. 2.
