Ross Jr., Secretary Alan Klimek, P.E., Director Division of Water Quality You are hereby notified that, having been permitted to have a non discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2H .0217, you have been found to be in violation of your 2H .0217 permit. On July 30, 2002, staff from the Fayetteville Regional Office of the Division of Water Quality conducted a routine compliance inspection of the above referenced facility in Sampson County. During the inspection, it was noted that no operator in charge (OIC) was designated for the facility and that the 2002 application records were not available for review. It was also noted that the soil and waste analysis results were not available for review. Lagoon banks were overgrown and not accessible for inspection. The Division of Water Quality requests that the following items be addressed: 1: Immediately complete the change of OIC for provided during the inspection and return to the address listed at the bottom of the form. 2. Submit copies of the 2002 application records. Maintain these records on the farm for review during inspections. 3. Submit copies of the last two years of soil and waste analysis. Cotton was planted in the spray field, however the crops specified for this field are com, wheat, and soybeans. The Division of Water Quality requests that the following items be performed: 1. Contact a technical specialist in order to revise the CAWMP to reflect the crops to be grown along with the specified Plant Available Nitrogen (PAN) rates for each crop. Please notify this office in writing on or before February 11, 2000 at the letterhead as to the actions taken or proposed to be taken to resolve these deficiencies. Nothing in this letter should be taken as absolving this facility of the responsibility and liability of any violations that have or may result from these deficiencies. It was observed that the coastal bermuda crop was utilized for waste application on both farms, however the crop was not harvested. The coastal spray field at Farm #1 still contained bales of hay from last growing season. The front spray field at Farm #1 had been utilized for spraying since August, however a small grain crop still had not been established at the time of the inspection. According to the Certified Animal Waste Management Plan (CAWMP), waste shall not be applied more than 30 days prior to planting. The Division of Water Quality requests that the following items be performed: 1. In the future, if a crop is used for the application of animal waste, the crop must be harvested and removed from the field. _ 2. If waste is going to be applied to a bare field, a crop must be established within 30 days of application.
