This letter transmits a Notice of Violation for failure to conform with conditions and limitations of the Certified Animal Waste Management Plan (CAWMP) as required by North Carolina General Statute 143-215.10_ An inspection of your farm conducted by staff from the Division of Water Quality (DWQ) Fayetteville Regional Office on September 24, 1997, revealed that a violation of your CAWMP as it clearly states-. "The irrigation application rate should not exceed the intake rate of the at the time of irrigation such that runoff or ponding occurs." Upon inspection of the facility, ponding of animal waste was observed adjacent to the waste lagoon in a field that is not included in the CAWMP. Failure to comply with these limitations and conditions specified in the CAWMP may result in the revocation of the deemed permited status, assessment of civil penalties, or other actions deemed necessary by the DWQ. By no later than November 21, you must notify this office in writing of what actions have been taken to comply with your CAWMP. Please be advised that this letter does not prevent the Division of Water Quality from taking enforcement actions for past or future violations. P.O. Annual permit fees are billed following the issuance of the permit and then annually thereafter on the anniversary of that date. Your animal waste management system permit was issued on 8/24198. Your annual permit fee for the period of 8/24/99 - 8/23/2000 is $150.00. Your payment was due 10/14/99. Because this fee was not fully paid within 30 days after being billed, this letter initiates action to revolve the subject permit, pursuant to 15 NCAC 2H .0205 (c) (4). and G_S_ 143-215.1 (b) (3). Effective 60 days from receipt of this notice, the subject permit is hereby revoked unless the required Annual Animal Waste Management System Permit fee for your animal operation is received within that time. Operation of an animal waste management system without a valid permit is a violation of North Carolina General Statute 143-215.1 and is subject to the assessment of a civil penalty of up to S 10,000 per day. The liquid level of the lagoon was reported as 16 inches. General Permit condition V.3 states that "The maximum waste level in lagoons/storage ponds shall not exceed that specified in the CAWMP. At a minimum, maximum waste level for lagoons/storage ponds must not exceed the level that provides adequate storage to contain the 25-year, 24-hour storm event plus as additional 1 foot of structural freeboard.". The Division of Water Quality will take no further action for this reported incident at this time. However, you are asked to please notify this office in writing within 15 days of receipt of this letter as to what date the lagoon was lowered to the required freeboard level. This information is essential in determining if the lagoon was lowered within the specified time frame in which the Plan of Action (POA) allotted. It will also close this event out within your file. Securing the lagoon designs for the farm book. Shortly after the inspection a trip was made to the Soil and Water Office to obtain a copy of the lagoon design. This copy was placed in the farm book and is available for inspection at any time, a second copy was placed in the Bearskin folder in the main office. 2. Keep a running nitrogen balance on the IRR-2 forms to ensure that there is no over application on the receiving crop. To avoid such occurrences the format of reporting application has changed. Applicators have now been trained on methods of tracking their own progress in the field using sheets similar to the state "IRR" forms, which does include a running nitrogen balance. In addition they will still be required to turn in the pumping records at more frequent intervals so that the numbers can be checked to verify that miscalculations have not occurred. An estimatcd 700-750 gallons were lccovered. The remaitifng 50-100 gallons were unrecoverable, as they mixed with freshwater in unreachable small pockets in the ditch Or soaked into the stitch bed. Access to the ditch was quite difficult and there were n few small packets (under fallen trees for example) in ,41tich all die effluent could not be recovercd- 2) The overflow resulted front oue of the discharge lixles becoming plugged by a one gallon plastic container. The container had been cut aff and made into a short "pall" for fly bait. The pan fell through the slat and capped the pit discharoe pipe. The flush tams are on butlers, so as the'tauks flushed; the: container prc:vanled the water from being discharged to the lagoon. Once the pit beneath the -slats was Full, the water exited the barn beneath the door. The farm employees have ttcrn instructed not to usr this type organ for baiting flies.
