Submit a written request for remission including a detailed justification for such request: Please be aware that a request for remission is limited to consideration of the five factors listed below, as they may relate to the reasonableness of the amount of the civil penalty assessed. Requesting remission is not the proper procedure for contesting whether the violation(s) occurred or the accuracy of any of the factual statements contained in the civil penalty assessment document. Because a remission request forecloses the option of an administrative hearing, such a request must be accompanied by a waiver of your right to an administrative hearing and a stipulation and agreement that no factual or legal issues are in dispute. PC-2017-0004 FINDINGS AND DECISION AND ASSESSMENT OF CIVIL PENALTIES ) Acting pursuant to delegation provided by the Secretary of the Department of Environmental Quality and the Director of the Division of Water Resources (DWR), I, Jon Risgaard, Section Chief of the Water Quality Regional Operations Section of the DWR, make the following: I. FINDINGS OF FACT: A. Ryan Matthew Butler owns and operates Matt Butler Farms, a swine operation in Sampson County. B. Ryan Matthew Butler was issued Certificate of Coverage AWS820218 by DWR, under General Permit AWG 100000 for Matt Butler Farms on October 1, 2014, effective upon issuance, with an expiration date of September 30, 2019. C. Condition No. H' 16. of the General Permit AWG100000 states that the permittee shall designate a certified animal waste management system operator to be in charge of the animal waste management system. The waste management system shall be operated by the Operator In Charge (OIC) or a person under the OIC's supervision. D. DWR staff from the Fayetteville Regional Office (FRO) inspected Butler Farms records on November 2, 2016. It was documented that Matt Butler Farms had no documentation of an actively certified operator in charge. During the annual inspection on December 22, 2015 of Matt Butler Farms it was documented that the designated Operator in Charge (OIC) license was invalid. Matt Butler Farms was sited with a NOD-201 5 -PC-0309. E. On November 17, 2016, DWR issued a Notice of Violation (NOV) / Notice of Intent of Enforcement (NOI) to Ryan Matthew Butler identifying violations of 15A NCAC 2T.1304 and Permit No. AWG100000 for failure to designate a Certified Animal Waste Management System Operator with a valid certification. F. The NOV/NOI was sent by certified mail, return receipt requested and received on December 20, 2016 G. The cost to the State of the enforcement procedures in this matter totaled $282.54. Based upon the above Findings of Fact, I make the following: H. CONCLUSIONS OF LAW. A. Ryan Matthew Butler is a "person" within the meaning of N.C.G.S. 143-215.6A pursuant to N.C.G.S. 143-212(4). B. A permit for an animal waste management system is required by N.C.G.S. 143-215.1. C. The above -cited failure to designate a certified animal waste management system operator with a valid certification to be in charge of the animal waste disposal system in accordance with the facilities permitted waste disposal system violated Condition No. 1116 of the General Permit AWG10000 D. N.C.G.S. 143-215.6A(a)(2) provides that a civil penalty of not more than $25,000.00 may be assessed against a person who fails to apply for or to secure a permit required by N.C.G.S. 143-215.1, or who violates or fails to act in accordance with the terms, conditions, or requirements of a permit required by N.C.G.S. 143-215.1. E. N.C.G.S. 143-215.3(a)(9) and N.C.G.S. 143B-282.1(b)(8) provides that the reasonable costs of any investigation, inspection or monitoring survey may be assessed against a person who violates any regulations, standards, or limitations adopted by the Environmental Management Commission or violates any terms or conditions of any permit issued pursuant to N.C.G_S. 143-215.1, or special order or other document issued pursuant to N.C.G.S. 143-215.2. F. The Section Chief of the Water Quality Regional Operations Section, Division of Water Resources, pursuant to delegation provided by the Secretary of the Department of Environmental Quality and the Director of the Division of Water Resources, has the authority to assess civil penalties in this matter. Based upon the above Findings of Fact and Conclusions of Law, I make the following: III. On February 23, 2004 staff from the Fayetteville Regional Office of the Division of Water=-',':!- Quality visited your swine farm located in Sampson County. That visit was to locate the farm and check on the lagoon level- While inspecting the lagoon, the staff noticed wastewater was coming out of a swine confinement house through openings in the foundation walls_ The wastewater had moved to the back of the house and then to a low area between two swine confinement houses. The wastewater was contained in the area between the two confinement houses. Mr. Herring, the on -site representative, knew about the discharge and was waiting on a repairman to come and fix the wall. Division of Water Quality staff recommended that Mr- Herring erect a dam to contain the wastewater and put the wastewater back into the lagoon. Staff returned that afternoon and found that Mr. Herring had constructed a dam and was actively putting the wastewater into the lagoon. Staff advised Mr. Herring that any release of waste from the waste treatment system required notification to the regional office. The Division of Water Quality requests that the following items be addressed: l . Anytime wastewater is noticed leaving the waste treatment system, the discharge or release of waste should be contained and put back into the waste treatment system as quickly as possible. 7;NEINNAr N.
