On October 12, 2017, staff of the NC Division of Water Resources (Division), Water Quality Regional
Operations Section (WQROS), inspected the Felton Hobbs Farm and the permitted waste disposal system.
We wish to thank Mr. Felton Hobbs and Mrs. Greer Moore, who were present and assisted during the
inspection.
As a result of this inspection, you are hereby notified that, having been permitted to have a non -discharge
permit for the subject animal waste disposal system pursuant to 15A NCAC 2T .1304, you have been
found to be in violation of your permit as follows:
Violation 1:
Failure to operate and maintain at all times the collection and spray application fields. (Permit No.
AWG100000 Section Conditions 11 1).
It was documented with pictures that the spray application fields and storage structures have not been
maintained as specified in your Certified Animal Waste Management Plan.

Required Corrective Action for Violation 1:
Cut and harvest the weeds and what Bermuda that may be on the spray application fields to allow for
planting of your over seed crop by November 30, 2017 as stated in your October 12, 2017 annual
inspection. Maintain all fields as designated in your Certified Animal Waste Management Plan. Maintain
all waste structures'and waste collection system as designated in your permit.
Violation 2:
Failure to maintain a vegetative cover as specified in the facility's Certified Animal Waste Management
Plan on all land application fields. No waste shall be applied upon areas where the crop is insufficient for
nutrient utilization. (Permit No. AWGI00000 Section H 2).
It was documented that your Bermuda fields have not been harvested during the 2017 growing season.
Required Corrective action for Violation 2:
Keep all spray application fields maintained as required in your Certified Animal Waste Management
Pian. Do not apply animal waste on fields that have not been maintained and are viable to receive the
nitrogen applied. Cut and remove the weeds and what Bermuda that may be on the field to allow for
planting your over seed crop by November 30, 2017 as stated in your October 12, 2017 annual
inspection.
Violation 3:
Applying waste at rates exceeding the agronomic rate of the nutrient of concern for the receiving crop.
(Permit No. A WG i 00000 Section 114). It was documented that you over applied nitrogen on zone B to
the winter cover crop for the 2016-2017 season.
Required Corrective action for Violation 3:
In the future do not over apply waste at rates that exceed the agronomic rate of the nutrient of concern for
the receiving crop. Do not apply waste outside of the acceptable crop window listed in the Certified
Animal Waste Management Plan.
Violation 4:
Failure to maintain the vegetative cover on your lagoons by keeping them mowed and accessible in
accordance with the facilities Certified Animal Waste Management Plan and Permit. (Permit No.
AWG 100000 Section H 12).
It was documented that you have not maintained the vegetative cover on the four lagoons at your farm.
The vegetation was overgrown and too thick to walk through to complete a visual inspection of your
lagoon walls to look for any seepage or other possible damage.

Required Corrective action for Violation 4:
Mow all four lagoons down to the toe of the dike by November 30, 2017 as stated in your October 12,
2017 annual inspection.
Violation 5:
Failure to maintain a highly visible and readable waste -level gauge in your lagoons to mark the level of
waste in accordance with the facilities Certified Animal Waste Management Plan and Permit. (Permit
No. AWG 100000 Section 1112).
It was documented that the markers in all four lagoons have not been replaced with markers that can be
read as requested and noted in previous inspection reports for several years. A two by four with nails
driven on the side at one inch's intervals after 19 inches that have now rusted off is not acceptable.
Required Corrective action for Violation 5:
Replace each gauge with a highly visible and readable marker set to the lowest point of the lagoon dike
by someone qualified to perform this task. The lagoon banks must be mowed first to complete this
requirement. These requirements must be completed by November 30, 2017 as stated in your October 12,
2017 annual inspection.
The Division of Water Resources requests that, in addition to the specified corrective action above, please
submit the following items on or before December 15, 2017:
1. An explanation from the OIC for this farm regarding how these violations occurred.
2. A list from the OIC concerning the steps that will be taken to prevent these violations from
occurring in the future.
You are required to take any necessary action to correct the above violations on or before
November 30, 2017. Please include in your response all corrective actions already taken and a schedule
for completion of any corrective actions not addressed.
Failure to comply with conditions in the facility's permit may result in a recommendation of enforcement
action, to the Director of the Division of Water Resources who may issue a civil penalty assessment of
not more that twenty-five thousand ($25,000) dollars against any "person" who violates or fails to act in
accordance with the terms, conditions, or requirements of a permit under authority of G.S. 143-215.6A.

In response to your NOTICE OF VIOLATION NOV-2017-PC-0680 for Felton Hobbs Farm (82-208) dated
November 20, 2017, 1 submit the following responses to the violations noted.
Violation 1: Failure to maintain collection and spray fields: The spray fields were cleaned up after the
inspection and I plan to do a better job with weed control in the future. I planted my overseed before
November 30, as required. I also have a wheat crop I can apply to this winter.
Violation 2: Failure to maintain a vegetated cover as specified by the CAWMP: I will re -sprig my coastal
bemwda fields in the spring of 2018.
Violation 3: Applying waste at rates exceeding the agronomic rate of the receiving crop: I had an
abnormally high waste sample during the period of time in question and I should have re -sampled but
did not. I will more closely monitor my waste application activities and keep my application records current
so as to avoid this occurring in the future.
Violation 4: Failure to maintain the vegetative cover on my lagoons by keeping them mowed and
accessible: I have mowed the tops and side slopes of my lagoons to allow better access. This was done
soon after the inspection and before November 30, 2017.
Violation 5: Failure to maintain a highly visible and readable waste -level gauge in my lagoons: I have
contacted Smithfield on numerous occasions and they have assured me they would replace these for me.
As of this letter they have not but they have scheduled the replacement for the week of January 8, 2018. 1
have discussed this with Curtis Barwick and he has assured me that if Smithfield did not replace my
gauges by January 15, 2018 that he would do so on that date.
I apologize for the tardiness of this response and I have taken these matters seriously. I have not been
receiving normal pig placements for a long time and my cash flow is not steady. However, I realize my
obligations and will complete the tasks that have not been completed in a timely manner. I will do
everything in my power to see that other violations do not occur in the future.

were notified by Greer Moore of a high freeboard level in the lagoon 1. We swish to thank Mrs. Moore for
notifying DWQ of this incident.
As a result of this incident, you are hereby notified that, having been permitted to have a non -discharge
permit for the subject animal waste disposal system pursuant to 15A NCAC 2T Section .1 '300, you have
been found to be in violation of your Certified Animal Waste Management Plan and the Swine Waste
System General Permit No. AWG100000 that you are covered to operate under, as follows:
Deficiency 1:
Failure to maintain waste levels in your lagoon/storage ponds in accordance with the facility's Certified
Animal Waste Management Plan in accordance with Condition V. 2. of Swine Waste System General
Permit No. AWG 100000.
On May 30, 2012 a lagoon/storage pond level was documented at 18.00 inches in lagoon 1. A level of 19
inches is the maximum level allowed by your permit and Certified Animal Waste Management Plan.
Required Corrective Action for Deficiency 1:
DWQ has received a copy of your 30 Day Plan of Action (POA) for the high freeboard occurrence. Take
all necessary additional steps to insure lagoon levels remain in compliance with Section 2 of your permit.

On October 04, 2011, staff of the NC Division of Water Quality (DWQ), Aquifer Protection Section (APS),
inspected the Felton Hobbs Farm and the permitted waste disposal system. We wish to thank Mr. Felton Hobbs and

As a result of this inspection, you are hereby notified that, having been permitted to have a non -discharge permit for
the subject animal waste disposal system pursuant to 15A NCAC 2T .1304, you have been found to be in violation
of your permit as follows:
Violation 1:
Failure to properly operate and maintain land application equipment and fields in accordance with your permit that
resulted in excessive ponding (Permit NoAWS820208 Section 1I 1& 5)
On October 04, 2011 a compliance inspection was conducted at your facility. An inspection of your spray
application fields it was documented that the above ground piping system used for spraying waste had leaked
during your last spray event. It was also documented that this had occurred during past events. The leaking pipe
caused excessive ponding in two areas of the field.
Required Corrective Action for Violation 1:
The DWQ ask that you replace this system with a more efficient method to eliminate the leaking that was also
documented during your inspection in October 2010 that resulted in a discharge. "Phis new system nnust be designed
by a Technical Specialist and installed according to design. If you must use the old system prior to completing the
new design and installation, repair and monitor continually during operation to prevent any leaks or ponding.
Recover any remaining ponded waste and return to your lagoon.

The Division of Water Quality requests that, in addition to the specified corrective action above, please submit the
following items on or before November 15, 2011: -
1. An explanation frons the OIC for this faros regarding how this violation occurred.
2. A list from the OIC concerning the steps that will be taken to prevent this violation from occurring in the
future.
You are required to take any necessary action to correct the above violations as soon as possible and to
provide a written response to this Notice by November 1, 2011. Please include in your response all corrective
actions already taken and a schedule for completion of any corrective actions not addressed.
Failure to comply with conditions in a permit may result in a recommendation of enforcement action, to the
Director of the Division of Water Quality who may issue a civil penalty assessment of not more that twenty-five
thousand ($25,000) dollars against any "person" who violates or fails to act in accordance with the terms,
conditions, or requirements of a permit under authority of G.S. 143-215.6A.
